`APPLICANT’S MOTION TO AMEND APPLICATIONS

`Pursuant to 37 C.F.R. § 2.133 and § 514 of the Trademark Board Manual of
`
`Procedures, Glow and Greens, LLC, through its attorneys, hereby respectfully moves the
`
`Board to amend the opposed application at issue in the instant case, specifically the
`
`identification of goods and services contained therein.
`
`Applicant requests the following changes to Application No. 88/916,838 (proposed
`
`new language underlined and proposed language for deletion stricken through):
`
`“Nutrition counseling; Consulting services in the fields of health and
`
`nutrition; Counseling services in the fields of health, nutrition and lifestyle
`
`wellness; Food nutrition consultation; Providing a web site featuring
`
`information on health and nutrition; Providing a website featuring
`
`information about nutrition; Providing a website featuring information
`
`about health, wellness and nutrition; Providing information about dietary
`
`
`

`supplements and nutrition; Providing information in the field of nutrition;

`Such that the identification of goods be amended to state:
`
`“Nutrition counseling; Consulting services in the fields of health and
`
`nutrition; Counseling services in the fields of health, nutrition and lifestyle
`
`wellness; Food nutrition consultation; Providing information about dietary
`
`supplements and nutrition; Providing information in the field of nutrition;
`
`Providing information, news and commentary in the field of nutrition,
`
`health and wellness; all of the foregoing provided by a registered dietician,
`
`and none of the foregoing services being offered online or through video
`
`or streaming video in the fields of yoga, fitness instruction, or exercise
`
`instruction”
`
`As grounds for this motion, Applicant states that the above proposed amendments
`
`more accurately convey the goods and services that Applicant offers and intends to offer
`
`in conjunction with the GLOW + GREENS mark, which is the subject of the application
`
`at issue in this matter. Moreover, and in compliance with 37 C.F.R. § 2.71(a), the
`
`proposed amendments serve to clarify and limit but in no way broaden the identification
`
`of goods and services.
