`In the matter of U.S. Trademark Application Serial No. 88907189, Merck KGaA, with a

`business address of Frankfurter Strasse 250, 64293 Darmstadt, Germany (“Opposer”), believes
`
`that it is or will be damaged by the registration of the trademark METAPHENOL 27 (hereinafter,
`
`“Applicant’s Mark”), as reflected in U.S. Trademark Application Serial No. 88907189, in the
`
`name of NewMarket Health, LLC, a limited liability company, incorporated under the laws of
`
`the State of Maryland, with an address 16 W. Madison St., Baltimore, Maryland 21201
`
`(hereinafter, “Applicant”), and hereby opposes the same.
`
`As grounds for its opposition, Opposer, by and through its undersigned attorneys, alleges as
`
`follows:
`

`Opposer is a leading science and technology company, and producer and distributor
`
`of high-quality pharmaceutical products.
`
`

`Founded in 1668, Opposer is one of the oldest and largest pharmaceutical and
`
`chemical companies in the world and operates in over 60 countries.
`
`3.
`
`Opposer has become internationally known for its novel medical and pharmaceutical
`
`products, which are some of the most renowned and well-respected pharmaceutical products in the
`
`world.
`
`4.
`
`Opposer is the owner of all rights, title, and interest in and to the marks
`
`METAFOLIN and
`
` (hereinafter, “Opposer’s Marks”) for dietary supplements;
`
`chemical preparations and raw materials; calcium salt of L-5-methyltetrahydrofolic or L-
`
`methylfolate (hereinafter, “Opposer’s Goods”).
`

`
`As an alternative to folic acid, Opposer’s Goods offer good stability, solubility, and
`
`bioavailability.
`
`6.
`
`Upon information and belief, there have been a billion daily doses of Opposer’s
`
`Goods bearing Opposer’s Marks, since the introduction of Opposer’s Goods in 2001.
`
`7.
`
`Upon information and belief, Opposer’s Goods bearing Opposer’s Marks has an
`
`extensive record of success with regulatory authorities and fulfills the specifications of the United
`
`States Pharmacopoeia (USP) and in some cases exceeds these specifications.
`
`8.
`
`Opposer has expended vast amounts of time, effort, and money in developing,
`
`advertising, and publicizing the sale of Opposer’s Goods in connection with Opposer’s Marks.
`
`9.
`
`As a result of Opposer’s efforts, the high quality of Opposer’s Goods, and
`
`Opposer’s extensive use, advertising, and promotion of Opposer’s Marks and Opposer’s Goods,
`
`Opposer’s Marks and Opposer’s Goods have become famous.
`
`10.
`
`Consumers have come to associate Opposer’s Marks and Opposer’s Goods
`
`exclusively with Opposer, and Opposer has acquired a valuable reputation and goodwill among

`consumers as a result.
`
`11.
`
`Opposer’s Marks are distinctive indicators of the origin of Opposer’s Goods and
`
`are extremely valuable symbols of Opposer’s goodwill.
`

`Since long prior to any date on which Applicant can rely, Opposer has continuously
`
`used in commerce Opposer’s Marks for Opposer’s Goods.
`
`13.
`
`In addition to Opposer’s common law rights, Opposer owns incontestable trademark
`
`registrations of Opposer’s Marks, Reg. Nos. 2526532, 3001087, and 3605194. Print-outs of said
`
`registrations from the electronic database records of the United States Patent and Trademark Office
`
`(hereinafter, “USPTO”) are attached hereto as Exhibit A.
`

`Opposer’s registrations are valid and subsisting and are conclusive evidence of
`
`Opposer’s exclusive right to use Opposer’s Marks in commerce in connection with Opposer’s
`
`Goods, related goods and services, and/or goods and services within Opposer’s scope of natural
`
`expansion.
`
`15.
`
`Since long prior to any date on which Applicant can rely, Opposer has continuously
`
`used in commerce Opposer’s Marks for Opposer’s Goods.
`
`16.
`
`Notwithstanding Opposer’s prior rights in and to Opposer’s Marks, on May 8, 2020,
`
`Applicant filed an application with the USPTO for Applicant’s Mark, Serial No. 88907189 (the
`
`“Application”), for “Dietary and nutritional supplements” in Class 5 (“Applicant’s Goods”).
`
`17.
`
`There is no issue of priority as the filing date of the Applications and/or any alleged
`
`dates of first use in commerce of Applicant’s Mark are subsequent to Opposer’s filing date,
`
`registration date, and/or actual use in commerce of Opposer’s Marks, individually and collectively.
`

`
`Opposer has been harmed, and continues to be harmed, by the Application.

`Applicant’s Mark is so similar to Opposer’s Marks in sound, appearance, meaning,

`and/or commercial impression as to be likely to cause confusion, mistake, or deception as to the
`
`source of origin or sponsorship of the goods and services for which the marks are used or are
`
`intended to be used on or in connection with.
`

`Applicant’s Mark is likely to cause the mistaken belief that Applicant’s Goods
`
`originate with, are sponsored by, and/or are otherwise affiliated with Opposer.
`
`22.
`
`Applicant’s Goods, as set forth in the Application, are the same as or similar to
`
`Opposer’s Goods, are or will be offered for sale to the same general class of purchasers, and are
`
`or will be sold through the same or similar channels of trade in which Opposer’s Goods are or will
`
`be sold.
`
`23.
`
`Applicant’s Mark is a colorable imitation or misappropriation of Opposer’s Marks
`
`and will enable Applicant to reap where it has not sown by trading on the goodwill of Opposer’s
`
`business as symbolized by Opposer’s Marks.
`
`24.
`
`Applicant’s Mark is likely to cause irreparable loss, injury, and damage to
`
`Opposer’s business and to the extensive goodwill and reputation associated with Opposer’s Marks.

`Upon information and belief, the registration or commercial use of Applicant’s

`Mark will cause, or is likely to cause, dilution of the distinctive quality of Opposer’s Marks and

`
`Goods/Services.

`WHEREFORE, Opposer believes it will be damaged by the registration of Applicant’s
`
`Mark for Applicant’s Goods, as set forth in the Application, and as such respectfully requests that
`
`the present opposition be sustained and registration of Applicant’s Mark be denied.
