`In the matter of an application to register a trademark under the Trademark Act of
`
`1946, Serial No. 88/892177 for the above-referenced mark, filed April 28, 2020, in the
`name of Practical Hat Manufacturing Co (hereinafter “Applicant”), published for
`opposition in the Trademark Official Gazette of August 25, 2020, the Opposer Stanco
`
`USA Inc. believes that it may be damaged by registration of said alleged trademark and
`
`hereby opposes same. The grounds for opposition are as follows:
`
`The Opposer, Stanco USA Inc. is an Hawaiian corporation (hereinafter

`“Opposer” and/or “Stanco”), located and doing business at 1314 S. King Street,
`Honolulu, HI 96814.
`

`Commencing long prior to the filing date of the application opposed herein,
`
`Opposer Stanco, through its predecessors in interest and title, has been and is now
`
`engaged in the manufacture and sale in commerce of various goods under the
`
`trademarks BONTEX and
`
` (hereinafter Opposer’s BONTEX® Marks), in
`connection with various goods including impregnated cellulose fiber web product in
`
`sheet and/or roll form resembling leather for use in manufacture; artificial leather in the
`
`form of sheets and/or roll for use in manufacture, and especially for use in the
`
`manufacture of bags, trunks, travelling bags; and shoe insoles and shoe insole material,
`
`
`
`backing for belts, visors, brims, and size bands in hats and head wear (hereinafter
`“Opposer’s Goods”).
`3. Opposer, Stanco, has extensively and continuously used Opposer’s
`BONTEX® Marks in commerce in connection with Opposer’s Goods, advertised,
`offered for sale, sold and rendered in commerce by Stanco, and to identify and

`designate same, and to distinguish its good and business from those of others.
`Opposer is the owner of the following U.S. registrations for Opposer’s
`BONTEX® Marks, which are valid and subsisting, and constitute conclusive evidence of
`the validity of the registered mark(s), Opposer’s ownership thereof, and Opposer’s
`exclusive right to use Opposer’s BONTEX® Marks in commerce for the goods recited
`therein:

`Copies of each of said registrations, together with a TSDR print-out showing status and

`title, are attached hereto as Exhibits A-C.

`Since long prior to the filing date of the opposed application, Opposer has

`extensively used, promoted, advertised, marketed, distributed/sold Opposer’s Goods,
`and promoted its business under and in connection with Opposer’s BONTEX® Mark(s)
`to the public, through various channels of trade and in commerce, with the result that
`the trade, Opposer’s customers and the public in general have come to know and
`recognize Opposer’s BONTEX® Mark(s) and associate same with Opposer and/or the
`goods produced, advertised, marketed, distributed and sold directly or indirectly by
`
`Opposer. Opposer thus has built up substantial goodwill in connection with the sale of
`its goods under Opposer’s BONTEX® Mark(s).
`Upon information and belief, Applicant filed Application Serial No.

`88/892177 on April 28, 2020, seeking registration of

`following goods: Berets; Cap peaks; Cap visors; Hat frames; Hats; Headwear;

`Headwear, namely, hats, caps; Hoods; Paper hats for use as clothing items; Top hats;
`Toques; Visors being headwear (hereinafter “Applicant’s Goods”), and claiming first use
`of the mark as of April 21, 2020.

`Applicant’s opposed
` mark is likely to be confused with

`Opposer’s BONTEX® Mark(s) in that it is virtually identical to, a colorable imitation of,
`and/or confusingly similar to, Opposer's prior and aforesaid BONTEX® Mark(s).
`Upon information and belief, the Applicant’s Goods identified in Application
`Serial No. 88/892177 opposed herein are the same, similar and/or related to the goods
`in connection with which Opposer uses Opposer’s BONTEX® Mark(s), and/or will be
`sold and/or offered through the same and/or similar channels of trade, and/or to the
`

`same general class of purchasers, in and to which Opposer’s Goods are marketed,
`offered and/or sold.
`

`Long prior to the filing date and/or claimed date of first use recited in the
`
`opposed application, Opposer used Opposer's BONTEX® Mark(s) in commerce
`
`throughout the United States, and Opposer's above-noted registrations have achieved
`
`incontestable status; and, as a result, there is no question that Opposer has priority as
`
`to use of Opposer’s BONTEX® Mark vis-à-vis Applicant’s opposed
` mark.
`10. Upon information and belief, Applicant had actual knowledge of Opposer’s
`prior use and registration of Opposer’s BONTEX® Mark(s) and Opposer’s products
`offered under Opposer’s BONTEX® Marks; but Applicant nevertheless adopted and
`
`sought to obtain registration of the opposed mark
`goodwill and reputation in Opposer’s BONTEX® Mark(s).
`
` so as to trade off of the

`The registration and/or use of Applicant’s
`the opposed application is likely to cause confusion, mistake, and/or to deceive as to
`origin, sponsorship, and/or association of Applicant's Goods sold under Applicant’s
`
` mark set forth in

`opposed

` mark vis a vis Opposer and/or Opposer’s BONTEX® Mark(s),
`and/or to mislead purchasers of Applicant's Goods and/or Opposer's Goods, and/or the
`
`public in general, into believing that Applicant's Goods are sold by, emanate from,
`
`and/or in some way, directly or indirectly, are associated with and/or sponsored by
`Opposer, and/or Opposer’s BONTEX® Mark(s) and/or Opposer's Goods, and/or
`business, or vice versa, to the damage and detriment of Opposer.

`12. Applicant’s opposed
` mark is barred from registration
`because it consists of or comprises a mark which so resembles Opposer’s BONTEX®
`Mark(s) as to be likely, when used in connection with the goods identified in the
`
`published application opposed herein, to cause confusion, mistake, or deception with
`Opposer’s BONTEX® Mark(s) and the prior registrations therefor within the meaning of
`15 U.S.C. § 1052(d).

`In view of the foregoing, if Applicant is granted registration of the

` mark opposed herein, and Applicant obtains such rights as are conferred
`
`under the Principal Register of the Trademark Act of 1946, Applicant will obtain unlawful

`gain and advantage to which it is not entitled under the Trademark Act of 1946, to the
`
`detriment and harm of Opposer.

`WHEREFORE, Opposer, Stanco, believes and avers that it will be damaged by
`
`registration of the published

` mark, and respectfully requests that
`
`Application Serial No. 88/892177 be rejected and refused registration, that no
`
`registration issue thereon, and that this Opposition be sustained by issuance of a

`judgment in favor of Opposer, and for such other relief as may be necessary and
