`the same under the provision of Section 13 of the Trademark Act

`of July 5, 1946, as amended, 15 U.S.C. § 1063.
`
`As grounds of opposition, it is alleged that:
`
`1.
`
`Swiza S.A., a Switzerland société anonyme, is the
`
`exclusive owner of all rights, title, and interest in and to
`
`U.S. Trademark Registration No. 4038397 for SWIZA in Class 14,
`
`U.S. Trademark Registration No. 5158797 for
`
`, and U.S.
`
`Trademark Registration No. 5722516 for
`
` in Class 18
`
`(collectively, the “SWIZA Marks”). See printouts from the USPTO
`
`database attached as Exhibit A.
`
`2. Opposer, pursuant to a license from Swiza S.A., has
`
`made continuous and extensive use of the distinctive SWIZA
`
`Marks, which have developed widespread public recognition and
`
`appeal. Opposer has used the SWIZA Marks on or in connection
`
`with traveling bags, toilet bags, laptop bags, backpacks,
`
`wallets, umbrellas, pocketknives, clocks, and online retail
`
`store services in connection with the foregoing goods
`
`(hereinafter, the “Goods and Services”).
`
`3.
`
`Swiza S.A.'s registrations are valid and subsisting
`
`and are conclusive evidence of Swiza S.A.'s exclusive right to
`
`use and license the SWIZA Marks in commerce for the Goods and
`
`
`
`
`
`
`

`Services and for those goods and services within the zone of
`
`natural expansion.

`Opposer, through its license agreement with Swiza
`
`S.A., is authorized to initiate proceedings, including
`
`oppositions, to enforce its rights in the SWIZA Marks in the

`United States.

`5.
`
`Through Opposer’s extensive and continuous use of the
`
`SWIZA Marks, the SWIZA Marks have acquired substantial goodwill
`
`in connection with the Goods and Services.
`
`6. Opposer's extensive marketing, promotion, and use of
`
`the SWIZA Marks in commerce in the United States since at least
`
`as early as July 10, 2015, have caused customers, prospective
`
`purchasers, and the public generally to immediately associate
`
`the SWIZA Marks with Opposer and to expect a variety of
`
`traveling bags, toilet bags, laptop bags, backpacks, wallets,
`
`umbrellas, pocketknives, clocks, and related goods and services
`
`bearing the SWIZA Marks to have a connection with, or
`
`association with, Opposer.
`
`APPLICANT'S MARK IS CONFUSINGLY SIMILAR
`TO THE MARKS LICENSED BY OPPOSER
`

`7. Opposer repeats and realleges the allegations
`
`contained in paragraphs 1 through 6 above, as if fully set forth

`herein.

`"Applicant's Mark") for “Backpacks; Business card cases; Collars

`Handbags; Pet clothing; Pocket wallets; School bags; Umbrellas;
`
`Unfitted vanity cases; Valises” in International Class 18. The
`
`application was published for opposition in the Official Gazette
`
`dated August 18, 2020. See printout from the USPTO database
`
`attached as Exhibit B.
`
`9.

`Application No. 88877468 was filed under Section 1(a)
`
`of the Trademark Act of July 5, 1946 based on alleged use in
`
`commerce in the United States since at least as early as May 20,
`
`2018.
`
`10. Opposer's use of the SWIZA Marks predates Applicant's
`
`application filing date.
`
`11. Opposer’s use of the SWIZA Marks predates Applicant’s
`claimed date of first use in commerce of Applicant’s Mark in the
`
`United States.
`
`12. Applicant's Mark is confusingly similar to Opposer’s
`
`SWIZA Marks.
`

`13. Applicant's Mark is confusingly similar in sight,
`
`sound, and meaning to Opposer’s SWIZA Marks.
`
`14. The use and registration of Applicant's Mark to
`
`identify its goods is likely to cause confusion, mistake, and
`
`deception as to the source, origin, sponsorship, or association
`
`of the goods and will injure Opposer.
`
`15. Any defects, objections, or faults found with the
`
`goods sold and rendered by Applicant under Applicant's Mark,
`
`because of the false association with Opposer, would inflict
`
`upon and seriously injure the reputation of Opposer.
`
`16. The grant of a Certificate of Registration to
`
`Applicant for Applicant’s Mark would be inconsistent with and in
`
`derogation of Opposer's prior rights and would therefore cause
`
`damage and injury to Opposer and deception of and confusion to
`
`the public.
`
`17. In view of the similarity in overall commercial
`
`impression of the respective marks, the related nature of the
`
`goods of the respective parties, and Opposer's priority as to
`
`use of its licensed marks, Opposer alleges that Applicant's Mark
`
`so resembles Opposer's SWIZA Marks as to be likely to cause
`
`confusion, or mistake, or to deceive under Trademark Act
`
`
`

`Sections 2(d), 15 U.S.C. Section 1052(d), and will cause damage
`
`to Opposer and its goodwill represented by its prior-used marks.
`
`For the reasons set forth in the foregoing paragraphs one
`
`through seventeen, Opposer believes that it would be damaged by
`
`the registration of Applicant's Mark, and thus Applicant should
`
`be denied registration of the mark.
`
`WHEREFORE, Opposer prays that this opposition be sustained,
`
`and that Application Serial No. 88877468 be refused
`
`registration.
