`Monster Energy Company, a Delaware corporation, located and doing business at

`1 Monster Way, Corona, California 92879, (“Opposer”) believes that it will be damaged by
`
`registration of U.S. Trademark Application Serial No. 88/430484 (“Application”) for the mark
`
`MEGA MONSTERS (“Applicant’s Mark) filed by, (“Applicant”) and therefore opposes the
`
`same.
`
`
`
`As grounds for opposition, it is alleged:
`

`By the Application filed on May 14, 2019, Applicant seeks to obtain registration
`
`on the Principal Register of the trademark MEGA MONSTERS for “toy vehicles; electronic toy
`
`vehicles; electronically operated toy motor vehicles; non-electronic toy vehicles; radio controlled
`
`toy vehicles; radio-controlled toy vehicles; remote-controlled toy vehicles” in International Class
`

`28 based on Applicant’s alleged first use of the mark in interstate commerce since August 28,

`Since at least 2002, long before the filing date of the Application, Opposer has
`
`been, and still is, engaged in the development, marketing, and/or sale of nutritional supplements,
`
`energy drinks, clothing, sports helmets and equipment, gloves, and other products under the
`
`marks MONSTERTM and MONSTER ENERGY® and related marks, all containing
`
`“MONSTER.” Opposer’s family of MONSTER Marks includes, for example, the following:
`
`MONSTERTM, MONSTER ENERGY®, MONSTER REHAB®, MUSCLE MONSTER®,
`
`PUNCH MONSTER®, MONSTER ASSAULT®, UBERMONSTER®, JUICE MONSTER®,
`
`JAVA MONSTER®, M MONSTER ENERGY®, LO-CARB MONSTER ENERGY®,
`
`
`
`®, and
`
`® (hereinafter, collectively the “MONSTER Marks”). Since at
`
`least as early as 2003, Opposer has been, and still is, engaged in the promotion of live events,
`
`including, but not limited to, sports events and competitions, and the promotion of goods and
`
`services in the sports industry in connection with its MONSTER Marks.

`Since at least before the filing date of the Application and alleged date of first use
`
`of the mark, Opposer has continuously used and promoted its MONSTER Marks. By virtue of
`
`Opposer’s continuous and substantial use, the marks have become famous identifiers of Opposer
`
`and consumers have come to recognize a family of MONSTER Marks with which Opposer
`
`markets and sells its goods and services. Opposer’s MONSTER Marks are the subject of
`
`

`substantial and continuous marketing and promotion by Opposer in connection with its energy
`
`drinks and clothing.

`In addition, long before the filing date of the Application and the alleged date of
`
`first use, Opposer has used or licensed the use of its MONSTER Marks in connection with goods
`
`such as die-cast cars, remote control cars, radio controlled cars, and numerous other products.
`

`Opposer also markets and promotes its family of MONSTER Marks extensively

`on billions of cans of beverages and nutritional supplements; on apparel, merchandise, and on
`
`product samplings; on promotional and point of sale materials; in magazines and other industry
`
`publications; on the monsterenergy.com website and other Internet websites and social media
`
`sites; and at trade shows, concert tours and other live events.

`Opposer’s famous MONSTER Marks and related marks form a global brand that
`
`has appeared on billions of products and in extensive nationwide promotions. As a result, Opposer
`
`has built up, at great expense and effort, valuable goodwill in its MONSTER Marks, and has
`
`developed strong common law rights in the marks.

`Opposer’s common law rights in its MONSTER Marks predate the filing date of
`
`the Application and the alleged date of first use in commerce of Applicant’s Mark, and Opposer
`
`relies on these common law trademark rights in this Opposition.
