`Opposer, Conopco, Inc. d/b/a Unilever (“Conopco” or “Opposer”), a corporation

`organized and existing under the laws of New York with a place of business at 800

`Sylvan Avenue, Englewood Cliffs, New Jersey 07632, believes that it will be damaged
`
`by registration of the purported mark HYDRA CARE (hereinafter the “Mark”), for
`
`“[c]osmetic creams for skin care; [c]osmetics; [n]on-medicated skin care creams and
`
`lotions; [n]on-medicated skin care preparations; [n]on-medicated skin care preparations,
`
`namely, creams, lotions, gels, toners, cleaners and peels; [n]on-medicated skin care
`
`preparations, namely, skin tonic; [n]on-medicated skin toners; [n]on-medicated skin
`
`serums; [s]kin care products, namely, non-medicated skin serum” (“Applied-For-Goods”)
`
`in International Class 3, as shown in Application Serial No. 88/687,148, filed on
`
`November 11, 2019 (hereinafter the “Application”), based on an intent to use, in the
`
`
`

`name of MW Labs, Inc. (hereinafter “MW Labs” or “Applicant”). Opposer has been
`
`granted an extension of time to oppose until June 1, 2020, and hereby opposes the
`
`Application under Section 2(e)(1) of the Lanham Act, 15 U.S.C. § 1052(e)(1).
`
`As grounds for the opposition, Opposer, through its undersigned counsel, alleges
`
`as follows:
`

`Opposer is a world-renowned manufacturer, distributor and seller of
`
`personal care products, including moisturizers, lotions, toners, cleansers, beauty bars,
`
`exfoliants, peels, serums, masks, treatment creams, sun protection products, bb
`
`creams, body washes, body polishes, hair care products, hand washes, deodorants and
`
`antiperspirants (hereinafter referred to as “Personal and Skin Care Products”).
`

`
`For decades, Opposer has been engaged and is currently engaged in the
`
`manufacture, distribution, sale, advertising and promotion of its Personal and Skin Care
`
`Products throughout the United States and throughout the world under a variety of
`
`brands.
`

`
`In the United States, Opposer currently markets, distributes and sells
`
`Personal and Skin Care Products under, among others, its renowned DOVE ®,
`
`POND’S®, CARESS®, and CLEAR® brands.
`
`4.
`
`Upon information and belief, Applicant, MW Labs is a Georgia corporation
`
`having its principal place of business at 2734 Ogeechee Road, Savannah, Georgia
`
`31405.
`
`5.
`
`Upon information and belief, MW Labs is also engaged in the
`
`manufacture, distribution and sale of skin care products.
`

`
` Upon information and belief, on November 11, 2019, Applicant filed a
`
`trademark application (U.S. Trademark Application Serial No. 88/687,148) to register
`

`HYDRA CARE in International Class 3 for “[c]osmetic creams for skin care; [c]osmetics;

`
`and peels; [n]on-medicated skin care preparations, namely, skin tonic; [n]on-medicated
`
`skin toners; [n]on-medicated skin serums; [s]kin care products, namely, non-medicated
`
`skin serum.”

`Upon information and belief, Applicant, through its counsel, disclaimed all
`
`exclusive right to use “care” apart from the mark as shown through an Examiner’s
`
`Amendment that was issued on February 17, 2020.
`

`“Hydra” and “hydro” are Greek prefixes that are commonly used to refer to
`
`water such as in the words hydration, hydrant, hydraulic, hydraulics, hydrogen, and
`
`hydrophobia See MacMillan Dictionary at
`
`https://www.macmillandictionary.com/us/dictionary/american/tablet and
`
`https://msu.edu/~defores1/gre/roots/gre_rts_afx2.htm.

`Upon information and belief, the term “hydra” is used by numerous beauty
`
`and skin care companies to describe products with moisturizing or hydrating properties,
`
`benefits or effects including, but not limited to, as Chanel®, Dior®, Clarins®, Lancome®
`
`and L’Oreal®. Annexed hereto as Exhibit 1 are representative examples of third-party
`
`uses of “hydra” in connection with beauty and skin care products.
`

`
`Upon information and belief, Chanel, Dior and Clarins market and promote
`
`special targeted beauty and skin care lines touting special moisturizing or hydrating
`
`properties, benefits or effects under trademarks that incorporate the prefix “hydra.”
`
`Annexed hereto as Exhibit 2 are print-outs showing the Chanel “Hydra Beauty”, Dior
`
`
`

`“Hydra Life” and Clarins “Hydra Essential” beauty and skin care lines—all featuring the
`
`prefix “hydra.”
`

`Upon information and belief, Applicant has not started marketing or
`
`advertising its products bearing the applied-for-mark HYDRA CARE in the United
`
`States. However, Applicant currently markets and sells the MW Hydra Face Lotion.
`
`12.
`
`As further evidence of the merely descriptive nature of the applied-for-
`
`mark HYDRA CARE, Applicant not only disclaimed the word “care”, but also uses the
`
`term “hydra” descriptively to describe moisturizing, hydrating or hydration promoting
`
`properties, benefits or effects of its MW Hydra Face Lotion products. In its description
`
`for the MW Hydra Face Lotion, MW Labs touts “this Face Lotion allows for serious
`
`hydration.” Annexed hereto as Exhibit 3 is a print-out from MW Labs’ website, located at
`
`http://mwlabs.com/newsDetails.asp?nid=2, showing MW Labs’ descriptive use of
`
`“hydra” in connection with its MW Hydra Face Lotion products.
`
`REGISTRATION SHOULD BE DENIED BECAUSE HYDRA CARE IS MERELY
`DESCRIPTIVE OF THE APPLIED-FOR-GOODS AND HYDRA CARE CANNOT SERVE
`THE SOURCE IDENTIFICATION FUNCTION OF A TRADEMARK
`
`
`Opposer repeats and incorporates by reference as if fully stated herein the
`

`allegations in paragraphs 1 through and including 12 above.

`Applicant’s applied-for-mark HYDRA CARE (which is the subject of United
`
`States Trademark Application Serial No. 88/687,148 ) is merely descriptive of the
`
`qualities, characteristics, features, benefits or effects of the Applied-For-Goods--namely
`
`“[c]osmetic creams for skin care; [c]osmetics; [n]on-medicated skin care creams and
`
`lotions; [n]on-medicated skin care preparations; [n]on-medicated skin care preparations,
`
`namely, creams, lotions, gels, toners, cleaners and peels; [n]on-medicated skin care
`
`
`

`preparations, namely, skin tonic; [n]on-medicated skin toners; [n]on-medicated skin
`
`serums; [s]kin care products, namely, non-medicated skin serum.”

`Indeed, Applicant’s applied-for-mark HYDRA CARE is merely descriptive
`
`of the hydrating properties, benefits and effects of Applicant’s skin care products.
`
`16.
`
`Applicant’s applied-for-mark HYDRA CARE comprises the common prefix
`
`“hydra” which refers to water with the term “care.” Applicant has already disclaimed any
`
`rights to the exclusive use of the word “care.”
`
`17.
`
`When taken together, these two descriptive terms (i.e. “hydra” and “care”)
`
`merely describe a characteristic, benefit or effect of Applicant’s skin care products
`
`namely, that Applicant’s skin care products have hydrating or hydration promoting
`
`properties, benefits or effects by providing hydrating or moisturizing care to dry skin.
`
`18.
`
`Applicant’s combination of the descriptive terms “hydra” and “care” does
`
`not create a distinctive mark. Nor does the combination of these two descriptive terms
`
`alter or diminish the merely descriptive nature of Applicant’s applied-for-mark HYDRA
`
`CARE.
`
`19.
`
`Rather, Applicant’s combination of HYDRA CARE reinforces and confirms
`
`the merely descriptive nature of Applicant’s applied-for-mark.
`
`20.
`
`When considered in its entirety, the applied-for-mark HYDRA CARE
`
`merely describes the moisturizing or hydrating properties, benefits and/or effects of
`
`Applicant’s Applied-For-Goods.
`
`21.
`
`In light of the foregoing, the applied-for-mark HYDRA CARE is likely to be
`
`recognized and understood by the average consumer as merely describing a
`
`characteristic or feature of Applicant’s skin care products, namely their hydrating or
`
`hydration-promoting properties, benefits, or effects.

`Because Applicant’s applied-for-mark HYDRA CARE lacks distinctiveness
`
`and is merely descriptive of the properties, benefits or effects of Applicant’s Applied-For-
`
`Goods, Applicant’s applied-for-mark HYDRA CARE is also incapable of serving the
`
`single source identification function of a trademark.
`
`23.
`
`Opposer and others in the personal and skin care industry are likely to be
`
`damaged by Applicant’s proposed federal registration of HYDRA CARE because such
`
`registration could substantially interfere with Opposer’s (and its competitors’) ability to
`
`make legitimate use of the descriptive term “hydra care” to describe the characteristics,
`
`properties, benefits, and effects of their skin care products.
`
`WHEREFORE, registration by Applicant of HYDRA CARE for the Applied-For-
`
`Goods set forth in the opposed Application would be damaging to Opposer and Opposer
`
`respectfully requests that this opposition be sustained and that the registration sought
`
`by Applicant be denied.

`other highly allergic ingredient is very unwise and tragic.

`I used the hydra quench mask for over 20 years to successfully survive winters in Michgan with dry skin and nut allerergies. How sad they removed such a good
`product and replaced it with a coconut (caprylic) loaded cream. Please tell me the origins and /or sources of caprylic, cetearyl alcohol, cetyl alcohol, stearyl alcohol
`and laureth ingredients in this product, as I believe all these may be derived from coconut too.
