`Applicant‘s bona fide intention to use the mark HEALS in commerce pursuant to § 1(b) of

`the Trademark Act.

`On information and belief, Applicant made no use of the mark HEALS prior

`to the filing of Application Serial No. 88/635,065 and has not commenced use of the mark

`HEALS in commerce in connection with any of the goods covered by said application.

`Opposer is one of the world’s leading and well recognized manufacturers
`
`and distributors of natural pharmaceutical products and provides information and advice
`
`regarding health, quality of life, and beauty care, which Opposer calls “Healthcare

`designed by nature.”

`Long prior to the filing date of Application Serial No. 88/635,065 on

`September 28, 2019, Opposer adopted, used and is using in commerce the mark and

`trade name —HEEL for homeopathic pharmaceutical preparations, including gels and

`ointments for application to the skin (hereafter “homeopathic preparations”). Opposer is
`
`the owner of the trademark —HEEL, having continuously used said mark for
`
`homeopathic preparations in commerce since September 1978.

`Registration Nos. 1,462,472, 5,377,667 and 5,494,954 are prima facie
`
`evidence of the validity thereof, Opposer's ownership and exclusive right to use the
`
`marks ~HEEL and -HEEL Healthcare Designed by Nature in commerce and are
`
`constructive notice of Opposer’s ownership thereof, all as provided by §§ 7(b) and 22 of
`
`the Trademark Act of 1946. As Opposer’s right to use the mark -HEEL in commerce
`
`has become incontestable, Registration No. 1,462,472 is conclusive evidence of
`
`Opposer's right to use that mark in commerce on the goods specified in the registration,
`
`as provided by §§ 15 and 33(b) of the Trademark Act of 1946.

`By virtue of Opposer‘s long, continuous use and substantial promotion and
`
`sale of goods covered by Registration No. 1,462,472 and its maintenance of high quality
`
`standards relating thereto, purchasers, consumers and users of such products, and
`
`others, have come to recognize the mark -HEEL as an indication of origin in Opposer,
`
`as a consequence of which Opposer has established valuable goodwill and exclusive
`
`rights in the mark and trade name -HEEL.
`
`(10) Applicant’s mark HEALS and Opposer’s trade name and mark ~HEEL are
`
`essentially identical in sound, appearance and connotation. The “leaf design” in
`
`Applicant’s mark is intended to create an association of Applicant’s mark with natural
`
`skin care and other products, which is the field in which Opposer operates.
`
`(11) Opposer’s natural products, including its products provided in gel and
`
`ointment or lotion form, are intended to enhance and improve health and wellbeing.
`
`Based on the identification of goods in its application, Applicant’s skin lotions,
`
`preparations for skin care, and other goods covered by its application clearly also are
`
`intended to enhance and improve health and wellbeing.

`(12) There clearly is a commercial relationship between the goods for which
`
`Applicant seeks registration and Opposer’s goods and services. As such, confusion is
`
`likely between Opposer’s mark and Applicant’s essentially identical mark for similar or
`
`related and/or overlapping goods and services.
`
`(13) Opposer's homeopathic preparations and related services sold, offered for
`
`sale or intended to be sold or offered for sale under the name and mark -HEEL and/or
`
`the mark ~HEEL Healthcare Designed by Nature are identical and/or closely related
`
`products and services which are or are likely to be sold, distributed and advertised
`
`through the same or overlapping channels of trade to the same or overlapping classes
`
`of purchasers so that purchasers, prospective purchasers, users and others are likely to
`
`be confused, mistaken or deceived into the belief, contrary to fact, that Applicant’s
`
`goods offered under the mark HEALS emanate from and/or are in some way sponsored
`
`or approved by Opposer or are otherwise related to Opposer's —HEEL products and
`
`services, thereby damaging Opposer.
`
`(14) Applicant is not lawfully entitled to the registration which it seeks for the
`
`reason, inter alia, that the mark HEALS for Applicant’s goods so resembles Opposer's
`
`previously used and registered trade name and mark ~HEEL and the mark HEEL
`
`Healthcare Designed by Nature as to be likely to cause confusion, to cause mistake or
`
`to deceive within the meaning of Section 2(d) of the Federal Trademark Act, thereby
`
`damaging Opposer.
`
`WHEREFORE, Opposer prays that the present opposition be sustained and the
`
`registration of HEALS sought by Applicant be refused.
