`Terrasoul Superfoods, LLC, a Texas limited liability company, having a place of business
`
`at 1001 NE Loop 820, Suite 525, Fort Worth, Texas, believes that it is or would be damaged by
`
`the issuance of registration of the mark shown in application Serial No. 87/871,307 filed by Inner
`
`Discipline and published for opposition on September 3, 2019 and hereby opposes the same.
`
`As grounds for opposition, Opposer alleges that:
`
`1.
`
`Opposer Terrasoul Superfoods, LLC (“Opposer”) is an organic food sourcing
`
`company that offers consumers an array of superfoods. It is dedicated to providing the highest
`
`quality raw superfoods at unbeatable prices. It products are sold through wholesalers, directly
`
`to consumers, as well as in bulk to companies that operate juice bars.
`
`2.
`
`One of the products Opposer presently offers is a “Red Velvet Latte” drink mix.
`
`This product, used to create red velvet lattes, has a red velvet flavor and features beetroot
`
`

`powder, which gives the drink its red color. While this product is currently being sold to
`
`Opposer’s juice bar customers, who use it to mix and sell red velvet lattes, Opposer also has
`
`imminent plans to make this drink mix available to consumers in boxes that would include
`
`eight sachets, each containing an individual serving.
`

`Despite its use of the term in commerce, Opposer has not sought registration of
`
`“red velvet latte,” as this is a common and widely-used term that designates a particular type
`
`of drink.
`

`
`According to the United States Patent and Trademark Office records, on or
`
`about April 10, 2018, Applicant Inner Discipline (“Applicant”) filed Application Serial
`
`No. 87/871,307 (the “Application”).
`
`5.
`
`As amended, the Application seeks to register the standard character mark
`
`VELVET LATTE (“Applicant’s Mark”) for “Beetroot-derived powders used in the
`
`preparation of beverages” (“Applicant’s Goods”).
`
`6.
`
`The Application was filed based on an intent-to-use the mark in commerce
`
`under Section 1(b) and has not been amended to allege use.
`
`7.
`
`The Application includes a disclaimer of the term “latte” apart from the mark
`
`as a whole. Specifically, in the Application, no claim is made to the exclusive right to use
`
`“latte” apart from the mark as shown. The Application, however, does not have any disclaimer
`
`of the term “velvet.”
`
`8.
`
`The Application was published for opposition on September 3, 2019 and
`
`Opposer timely files this Notice of Opposition, opposing all of the goods for which
`
`registration is sought.
`

`Registration of the applied-for VELVET LATTE mark should be denied as the
`
`mark does not serve as a source identifier but is instead generic, or in the alternative merely
`
`descriptive and lacks secondary meaning, for the goods for which registration is sought.
`
`10. Opposer will be damaged by registration of the VELVET LATTE mark as shown
`
`in the Application, as Opposer is a competitor of Applicant and has a need to use the term “velvet
`
`latte” to describe its own products.
`
`11. While Opposer attempted to resolve this dispute prior to the filing of this Notice of
`
`Opposition, during the course of the parties’ discussions, it became clear that should the
`
`Application be allowed to register, Opposer will be damages as Applicant believes that the applied-
`
`for VELVET LATTE mark would be infringed by a competitor’s use of the term “red velvet latte”
`
`for drink mixes.
`
`12. As Opposer is already using the term “red velvet latte” in conjunction with its drink
`
`mixes containing beetroot powder and has plans to expand this use, Opposer has a real interest in
`
`this proceeding and a reasonable basis for its belief that it will be damaged should Applicant’s
`
`Mark register.
`

`
`The term VELVET LATTE does not serve as a source identifier for Applicant’s
`
`Goods but is instead generic, or in the alternative merely descriptive and lacks secondary
`
`meaning, for Applicant’s Goods.
`
`14.
`
`The term “velvet latte” refers to a particular type of drink and is used
`
`interchangeably with the terms “red velvet latte,” “velvet beetroot latte,” and “beetroot latte.”
`
`15. While some recipes and drink mixes use red food coloring to obtain the red hue
`
`traditional associated with velvet lattes (as well as other types of red velvet desserts), in the
`
`organic and natural food arena, beetroot power or beet juice is used in making velvet lattes
`
`
`

`(and other red velvet products).
`
`16. Attached as Exhibit A, hereto, are true and correct copies of printouts from the
`
`Internet showing generic use of the terms “velvet latte” and “red velvet latte” to identify a
`
`particular type of drink; as shown in Exhibit A, many of these drinks explicitly include
`
`“beetroot powder.”
`
`17.

`In the context of food and beverage items, the United States Patent and
`
`Trademark Office has recognized that “velvet” and “red velvet” are generic or descriptive
`
`terms and has required that these terms be disclaimed. Attached as Exhibit B, hereto, are
`
`examples of federal registrations in which the term “velvet” is disclaimed (as well as printouts
`
`from USPTO’s Trademark Status & Documents Retrieval (TSDR) database showing their
`
`present status).
`
`18.

`The relevant public would recognize that the term “velvet latte,” when used with
`
`“beetroot-derived powders used in the preparation of beverages,” to identify the type of drink
`
`that the powders may be used to make and not the source of the powders. As such, the mark
`
`is generic or, alternatively, merely descriptive and without secondary meaning.
`
`19. Alternatively, as Applicant itself acknowledges, the term “velvet” conveys a
`
`quality, characteristic, or feature of Applicant’s goods—namely that the goods are velvety
`
`(that is, they are smooth to the taste). For example, in a response to an Office Action filed on
`
`or about February 1, 2019, Applicant argued that “velvet latte” relates to the “smooth quality
`
`of the drink.” For this alternative reason, the mark is descriptive of the goods for which
`
`registration is sought and lacks secondary meaning as applied to those goods.
`
`20. As the VELVET LATTE mark is generic or, alternatively merely descriptive and
`
`lacks secondary meaning, for the goods covered by the Application, Applicant’s Mark cannot be
`
`

`registered on the Principal Register and should be refused registration.

`WHEREFORE, Opposer prays that Application Serial No. 87/871,307 be rejected, that no

`registration be issued thereon to Applicant, and that this Opposition be sustained in favor of

`it i got a hit of turmeric so i thought i may
`not like it. I made it up with some barista
`style oat milk and a little stevia and to my
`surprise i really liked it. Similar to regular
`chai and a hint of turmeric and surprisingly
`creamy too. Would recommend, especially
`if you're used to earthy tastes or chai lattes.

`You will be issued a return address of where to send your goods, and they must be received

`back within (14) fourteen days of the purchase date, in the condition they originally arrived in, to

`be eligible for either a replacement or a full refund of the purchase price less freight costs. Please

`note that every effort is taken to ensure that we pack your order as safely as possible – but

`damage does occur from time to time – especially in the transit of glass items.
