`Gazette on August 20, 2019 in the name of Weichert Co. (“Applicant”).

`The grounds for this Opposition are as follows:
`

`Opposer is a Wisconsin corporation with its principal place of business at 6000
`
`American Parkway, Madison, Wisconsin 53783.

`Upon information and belief, Applicant is a New Jersey corporation with its

`principal place of business at 1625 Route 10 East, Morris Plains, New Jersey 07950.

`Opposer’s Marks
`

`Since its founding in 1927, Opposer, previously known as Farmers Mutual
`
`Insurance Company, has become a nationally recognized insurance provider that offers auto,
`
`home, life, and other types of insurance coverage and financial services to consumers.
`

`
`Opposer is the nation’s 13th largest property and casualty insurance group. It
`
`currently ranks number 306 on the Fortune 500 list and reported over 27.5 billion in total assets in
`
`2018.
`

`
`Opposer’s services are distributed and sold by a network of independent insurance
`
`agents located throughout the country, which are licensed to conduct business under Opposer’s
`
`numerous and well-known trademarks.
`

`Opposer spends substantial expenditures of time, effort and other resources in
`
`advertising and promoting its services, including but not limited to, commercial TV advertising,
`
`featuring celebrity spokespeople; recently acquiring the naming rights of Miller Park, home of the
`
`MLB team Milwaukee Brewers; sponsoring the American Family Insurance Championship, a
`
`PGA Tour event; and sponsorship of numerous localized events throughout the U.S. through its
`
`DreamBank initiative and its Dream Movement.

`Since at least 1989, Opposer has used, and is now using, the ALL YOUR
`
`PROTECTION UNDER ONE ROOF mark (Reg. No. 2,880,618) in connection with its insurance
`
`and financial services (the “UNDER ONE ROOF Mark”).
`

`Examples of Opposer using its UNDER ONE ROOF Mark in connection with
`
`Opposer’s services are attached as Exhibit A.

`The relevant consuming public has come to recognize Opposer’s UNDER ONE
`
`ROOF Mark as a designation of a single source of goods and services, namely Opposer and its
`
`goods and services.
`

`Since at least 1962, the Opposer has used, and is now using, a family of marks
`
`incorporating a roofline design, which include the AMERICAN FAMILY INSURANCE and
`
`Design mark (Reg. No. 773,380), in connection with various insurance and real estate services (the
`
`“Roof Design Marks”).
`

`Examples of Opposer using its Roof Design Marks in connection with Opposer’s
`
`services are attached as Exhibit A.
`

`
`The relevant consuming public has come to recognize Opposer’s Roof Design
`
`Marks as designations of a single source of goods and services, namely Opposer and its goods and
`
`services.
`

`
`Additionally, Opposer’s UNDER ONE ROOF Mark and Roof Design Marks, have
`
`been and are still being used in combination and conjointly in advertising and promotion of its
`
`services, in such a way that they have come to be associated together as indications of origin in
`
`the mind of the buying public.
`

`
`In particular, the ALL YOUR PROTECTION UNDER ONE ROOF and the
`
`American Family Insurance and Design registrations are frequently combined and used together
`
`for marketing and advertising, as arranged below:
`
`(the “Combined Mark”).

`The relevant consuming public has come to recognize Opposer’s Combined Mark
`
`as a designation of a single source of goods and services, namely Opposer and its goods and
`
`services.
`

`Accordingly, Opposer has accumulated common law rights in its UNDER ONE
`
`ROOF Mark, Roof Design Marks, and Combined Mark in connection with goods and services
`
`shown in Exhibit A, as well as any related goods and services and goods and services included in
`
`a reasonable zone of expansion.
`

`In addition to common law rights, Opposer owns the following U.S. Registrations
`
`issued by the U.S. Patent and Trademark Office (“USPTO”) for the following trademarks in its
`
`UNDER ONE ROOF Mark and Roof Design Marks, and will rely upon same in this proceeding:

`The registrations listed in Table 1 above are valid, subsisting, in full force and
`
`effect, and constitute prima facie evidence of Opposer’s exclusive right to use the UNDER ONE
`
`ROOF and Roof Design Marks in U.S. commerce in connection with the services specified in the
`
`registrations.
`
`19. Moreover, the above registrations are incontestable pursuant to 15 U.S.C. § 1065(b)
`
`and constitute conclusive evidence of Opposer’s exclusive right to use the marks for the services
`
`specified in the registrations.
`

`True and correct copies of printouts from the USPTO’s TESS database showing
`
`current status and title of the registrations listed above in Table 1 are attached as Exhibit B.
`

`
`Each of these registrations issued well before the January 8, 2019 filing date of the
`
`opposed intent to use Application.
`

`Opposer also owns the following pending federal application for an additional Roof

`Marks, and Combined Mark (collectively, “Opposer’s Marks”).

`Opposer’s Marks are symbolic of the extensive goodwill and consumer recognition

`that Opposer has established through substantial expenditures of time, effort, and other resources
`
`in the advertising and promotion of the goods and services Opposer sells and offers for sale.

`Since Opposer’s Marks have been in use for decades, have been promoted
`
`extensively through a range of media, and have generated billions of dollars in assets, Opposer and
`
`its Marks are famous and are synonymous with Opposer and its high-quality services.
`
`Applicant’s Mark
`

`
`Applicant filed an intent to use application with the USPTO on January 8, 2019 for
`
`the design plus word mark:

`(“Applicant’s Mark”).
`

`The application was assigned Serial No. 88/253,175 (the “Application”).
`
`The Application is for “real estate agency services; financial services, namely, real
`
`estate investment, real estate property, title and insurance brokerage; and mortgage brokerage and
`
`lending” in Class 36 and “mortgage and real estate closing services” in Class 45.

`Applicant has disclaimed the right to use “REAL ESTATE MORTGAGE
`
`INSURANCE CLOSING SERVICES” apart from the mark as shown.
`

`Applicant’s Mark was published for opposition in the Official Gazette on August
`
`20, 2019.

`Any use by Applicant of Applicant’s Mark, is without the consent, authorization,
`
`or license of Opposer.

`Opposer repeats, re-alleges and incorporates by reference paragraphs 1–32 above.

`Opposer’s rights in Opposer’s Marks are superior to any rights Applicant may have
`
`in Applicant’s Mark.
`

`
`Applicant’s Mark is confusingly similar to Opposer’s UNDER ONE ROOF Mark
`
`in appearance, sound, and commercial impression.
`
`36.
`
`Particularly, the salient portion of Applicant’s Mark, namely the phrase “all under
`
`one roof,” is nearly identical in appearance, sound, and commercial impression to Opposer’s
`
`UNDER ONE ROOF Mark, namely the phrase “all your protection under one roof.” Indeed, all
`
`four words--“all under one roof”--appear in the same order in the phrase “all your protection under
`
`one roof.”
`

`Applicant’s Mark is confusingly similar to Opposer’s Roof Design Marks in
`
`appearance and commercial impression.
`

`Particularly, the roof design feature of Applicant’s Mark is similar to Opposer’s
`
`Roof Design Marks in that they all depict triangular, peaked-shaped roof lines:

`Indeed, confusing similarity is exacerbated as the roof lines and phrases from
`
`Opposer’s Combined Mark and Applicant’s Mark are nearly identical and laid-out in a similar
`
`fashion:

`The services listed in the Application are similar to the services Opposer has
`
`provided and continues to provide in connection with Opposer’s Marks. As explained above,
`
`Opposer provides wide-ranging insurance and real estate services. These are identical in nature
`
`to, or at the very least have substantial overlap with, the services for which Applicant filed.
`

`
`Upon information and belief, Applicant and Opposer operate in the same channels
`
`of trade and sell to the same class of purchasers.
`

`
`Accordingly, Applicant’s Mark is likely to suggest to the relevant purchasing public
`
`a false affiliation, connection, or association of Applicant and Applicant’s services with Opposer
`
`and Opposer’s services, with consequent injury to Opposer, the trade, and the public.
`

`
`Thus, the Application should be rejected under Lanham Act § 2(d), 15 U.S.C.A. §
`
`1052(d).

`Through extensive use and promotion, Opposer’s Marks have become distinctive

`and famous as defined under Section 43(c)(1) of the Lanham Act, as amended, 15 U.S.C. §

`1125(c)(1).

`Opposer’s Marks achieved their enormous and widespread public recognition and
`
`fame within the meaning of 15 U.S.C. § 1125(c) before the Application’s filing date of January 8,
`
`2019.
`
`48.
`
`Applicant’s use of Applicant’s Mark for the services specified in the Application is
`
`likely to dilute the distinctive quality of Opposer’s Marks and to decrease the capacity of Opposer’s
`
`marks to identify and distinguish Opposer, with consequent injury to Opposer, the trade, and the
`
`public.
`
`PRAYER FOR RELIEF
`
`WHEREFORE, Opposer believes and avers that it is being and will continue to be damaged
`
`by the registration of Applicant’s Mark, as aforesaid, and requests that said Application be rejected,
`
`that no registration or registrations be issued thereon to Applicant, and that this Opposition be
`
`sustained in favor of Opposer.
`
`Opposer has appointed Johanna M. Wilbert, a partner of the law firm of QUARLES &
