`2100 Highway 55 Medina, Minnesota, 55340 (“Polaris” or “Opposer”), believes that it will be

`damaged by the registration of the RZRZOO and design mark shown in Application Serial No.
`
`88/280024 (the “Application”), filed January 28, 2019, by Xia Hui, an individual with an address
`
`of No. 1402, Building 3, No. 8, Tiyu E. Street, Qiaoxi District, Shijiazhuang, Hebei CHINA
`
`050000 (“Applicant”), and hereby opposes registration of the mark on the following grounds:
`

`By the Application herein opposed, Applicant is seeking to obtain under the
`
`provisions of the Trademark Act of 1946 as amended, registration on the Principal Register of
`
`the trademark RZRZOO and design for dog leashes; reins; saddlebags; saddles; clothing for pets;
`
`collars for animals; harness fittings; harness for animals; harness straps; leashes for animals;
`
`pads for horse saddles; and saddlery of leather in International Class 18 (“Applicant’s Mark”).
`
`The Application alleges that Applicant’s Mark was first used in commerce in January 1, 2019.
`

`Applicant filed its Application on January 28, 2019. The Application published for
`
`opposition on July 16, 2019. This Notice of Opposition is timely filed on or before the 30-day
`
`deadline from the date of publication.
`

`Polaris is a leading manufacturer of recreational vehicles, snowmobiles,
`
`motorcycles, and parts and accessories. It is the manufacturer and owner of the well-known and
`
`iconic RZR branded all-terrain utility vehicles as well as accessories and clothing associated
`
`therewith. Polaris is the owner of the following U.S. Trademark Registrations:

`Exhibits A – H. Collectively, these marks will be referred to as the “RZR Marks.”

`Polaris’s registered RZR Marks are valid and subsisting and are prima facie
`
`evidence of Polaris’s exclusive right to use the RZR Marks in commerce on the goods and
`
`services specified in each registration. Moreover, Polaris’s Registration No. 4047705 is
`
`incontestable and is conclusive evidence of Polaris’s exclusive right to use the RZR Marks in
`
`commerce on the goods and services specified in that registration.

`Since at least as early as May 1, 2007, Polaris has used the mark RZR in the
`
`United States. Said use has been continuous since that date. None of Polaris’s registered
`
`trademark rights identified above have been abandoned.
`

`
`Polaris products offered under the RZR Marks are sold and promoted through
`
`authorized dealers and distributors, through Polaris’s website, https://rzr.polaris.com/, and a
`
`variety of online sources to include Amazon.com and others.
`

`
`Polaris’s RZR Marks are distinctive and point directly and uniquely to Polaris.
`
`Polaris’s RZR Marks are well known in the United States. Polaris has extensively marketed and
`
`promoted its products under the RZR Marks and has sold hundreds of millions of dollars of RZR
`
`products in the United States. The RZR brand has also been the subject of unsolicited media
`
`mentions, including on television, radio, print media, and online.
`

`Polaris’s RZR brand and products enjoy a loyal customer base who are active on
`
`social media posting images of and stories about RZR branded products and their adventures and
`
`positive experiences associated therewith.
`

`
`Polaris’s RZR brand is used by Polaris in connection with a broad array of
`
`products in addition to recreational vehicles, including but not limited to apparel, bags, toys,
`
`stickers, posters, cups, mugs, and more.
`

`
`Polaris has priority over Applicant’s Mark at issue in this proceeding. Polaris
`
`began using its RZR Marks long before the filing date and asserted first use date of the
`
`Application.
`

`
`Applicant’s Mark is confusingly similar to Polaris’s RZR Marks.
`
`Applicant’s Mark contains the entirety of the term RZR.
`
`
`

`
`
`13.
`
`Applicant’s inclusion of an additional term—ZOO—does not prevent confusion
`
`or lessen the likelihood of confusion.
`

`
`RZR is the dominant portion of Applicant’s Mark.
`

`Applicant’s inclusion of the design element
`
`does not prevent confusion
`
`or lessen the likelihood of confusion.

`Rather, inclusion of the design element
`
`amplifies the likelihood of
`
`confusion. First, the star design in the upper right area of the circle is confusingly similar to the
`
`star design used by Polaris:
`
`. Use of a star design in conjunction with
`
`use of the mark RZR gives consumers another reason to associate Applicant’s Mark with Polaris
`
`and its RZR Marks.
`

`
`Second, the alleged eagle design could also be viewed as a mountain, representing
`
`the outdoors. Consumers of RZR branded products equate many of the RZR branded products
`
`with use outdoors, such as use of all-terrain utility vehicles which are typically used on rough
`
`terrain or for off-roading.
`

`The goods offered in connection with Applicant’s Mark are related to the goods
`
`offered under Polaris’s RZR Marks. Applicant’s Mark is used in connection with, for example,
`
`clothing for pets; dog leashes; collars for animals; and saddlery of leather. This is related to and
`
`overlaps with goods offered under the RZR Marks such as clothing and storage bags. Indeed,
`
`entities that sell clothing to humans under a particular brand often offer clothing for pets under
`
`the same brand, e.g., NFL brands and Louis Vuitton.

`Applicant’s Mark is confusingly similar to Polaris’s RZR Marks and is likely to
`
`create a false association with Polaris. The parties’ marks have an overall confusingly similar
`
`appearance, sound, meaning and commercial impression. Consumers will mistakenly believe
`
`that Applicant’s goods and services are connected with, affiliated with and/or sponsored by
`
`Polaris when the same is not true.
`

`Due to the confusingly similar nature of Applicant’s Mark and Polaris’s RZR
`
`Marks, the closely related nature of the goods provided by the respective parties, consumers and
`
`potential consumers are likely to believe that Applicant’s goods originate from Polaris, resulting
`
`in a likelihood of confusion in the marketplace, and damage to Polaris.
`

`The Application contains no restrictions as to the channels of trade used in
`
`promoting and selling the identified goods under Applicant’s Mark. Accordingly, it is presumed
`
`that the pet, animal, and saddlery products promoted and sold under Applicant’s Mark occupy all
`
`ordinary and normal channels of trade for such goods. Upon information and belief, the goods
`
`and services provided by Polaris under its RZR Marks and the goods provided by Applicant
`
`under its mark will be promoted and sold in overlapping and similar channels of trade to the
`
`same consumers or class of consumers.

`Because of the related nature of the goods and services; the use of overlapping
`
`and similar channels of trade; and the confusingly similar nature of the marks in overall
`
`appearance, sound, meaning and commercial impression, the use of Applicant’s Mark is likely to
`
`cause confusion, or mistake, such that consumers wrongly believe Applicant’s goods are those of
`
`Polaris, or are otherwise endorsed, sponsored, or approved by Polaris causing further damage to
`
`Polaris.

`Registration of the mark shown in Application Serial No. 88/280024 will also
`
`result in damage to Polaris as it stands as an inappropriate bar to Polaris’s ability to expand its
`
`RZR mark, and creates a cloud on Polaris’s title to its mark pursuant to Section 2(d) of the
`
`Trademark Act consistent with the allegations stated above.
`
`WHEREFORE, Polaris asks that its Notice of Opposition be sustained and that
`
`Application Serial No. 88/280024 for the mark RZRZOO and design in connection with the
`
`products set forth therein be refused.
