`Joseph J. Norton (“Opposer”) believes that he will be damaged by registration of the mark

`GREEN HEAD BUG JUICE, as identified in U.S. Trademark Application Serial No. 88/177,404

`(the “Application”) filed by Gregg Connell (“Applicant”), and hereby opposes registration of the
`
`Application.
`
`
`
`As grounds for the opposition, Opposer alleges as follows:
`
`A. Opposer and its Prior Rights in the BUG JUICE Marks.
`
`1.
`
`Opposer Joseph J. Norton is a citizen of the United States, residing in Brighton,
`
`Michigan.
`
`2.
`
`Opposer owns several valid, subsisting, uncancelled and unrevoked registrations in
`
`the U.S. Patent and Trademark Office containing or comprising the phrase “BUG JUICE”
`
`(collectively, the “BUG JUICE Marks”), including the following:

`Design) for “anti-inflammatory itch cream” in International Class 5 (Reg. No. 4,839,681)

`(collectively, with the BUG JUICE Marks, the “Opposer’s Marks”).

`Registration certificates and the Trademark Status & Document Retrieval (TSDR)

`documents printed from the USPTO website for the Opposer’s Marks identified above are attached
`
`as Exhibit A.
`
`5.
`
`Opposer’s U.S. Registration No. 3,759,320, U.S. Registration No. 3,786,339, U.S.
`
`Registration No. 3,808,602, U.S. Registration No. 3,871,617, U.S. Registration No. 4,066,741,
`
`and U.S. Registration No. 4,236,968 have attained incontestable status.
`
`6.
`
`Opposer does business under the name Bug Juice Brands and produces and
`
`distributes fruit-flavored beverages, as well as candy, clothing, toys, inflammatory itch cream, and
`
`other products under the Opposer’s Marks set forth above.
`
`7.
`
`Opposer has marketed and sold fruit flavored beverages, paper, plastic, and cloth
`
`banners, storage bins, and clothing in interstate commerce in the United States under the trademark
`
`BUG JUICE since at least as early as 1990.
`
`8.
`
`Opposer has expended considerable
`
`time and expense on
`
`the creation,
`
`development, advertising and promotion, and enforcement of the Opposer’s Marks. As a result,
`
`the public has come to know, identify, and recognize a vast array of BUG JUICE products as
`
`originating with or authorized by Opposer.
`
`9.
`
`The goodwill represented by the Opposer’s Marks is a valuable and important asset
`
`of Opposer, and because of this, Opposer exerts strict control over the Opposer’s Marks.
`
`
`
`B. Applicant and its Confusingly Similar Mark.
`
`11.
`
`On information and belief, Applicant is a United States citizen, with an address of
`
`307 7th Ave, Ortley Beach, New Jersey 08751.

`On November 1, 2018, notwithstanding Opposer’s prior and senior rights in and to
`
`the
`
`Opposer’s Marks,
`
`Applicant
`
`filed
`
`an
`
`application
`
`for
`
`the mark
`
`GREEN HEAD BUG JUICE in the United States, which was assigned U.S. Application No.
`
`88/177,404.
`
`13.
`
`The goods covered by the Application are “Insect repellents” in International Class
`
`5.
`
`14.
`
`The Application was published in the USPTO’s Official Gazette (Trademarks)
`
`April 9, 2019. This Opposition is timely pursuant to the U.S. Trademark Trial & Appeal Board’s
`
`May 9, 2019 order allowing Opposer until August 7, 2019 to file its Notice of Opposition.
`
`
`
`C. Opposer Will Be Harmed If the Application Registers.
`
`15.
`
`Applicant’s filing date, November 1, 2018, is more almost three decades after
`
`Opposer’s first use of its BUG JUICE mark.
`
`16.
`
`Applicant’s mark is confusingly similar in terms of sight, sound, meaning, and
`
`commercial impression to each of the marks in the family of BUG JUICE Marks, prominently
`
`sharing the same term “BUG JUICE.”
`
`17.
`
`The goods marketed under Opposer’s Marks are commonly consumed or used in
`
`connection with outdoor activities and at summer camp. The goods for which Applicant seeks
`
`registration of its Application, namely insect repellent, is often used in connection with those same
`
`activities.
`
`18.
`
`On information and belief, Opposer’s products under the Opposer’s Marks are
`
`marketed to and provided through the same channels of trade as Applicant’s goods.

`Applicant’s applied-for mark GREEN HEAD BUG JUICE is confusingly similar
`
`to Opposer’s prior-used and registered BUG JUICE Marks, and therefore, if Applicant’s mark is
`
`allowed to register in connection with the goods covered by the Application, it would likely cause
`
`confusion and mistake among consumers concerning the origin, source, ownership, or sponsorship
`
`of Applicant’s goods in violation of 15 U.S.C. § 1052(d).
`

`
`In view of the strength of Opposer’s BUG JUICE Marks, the duration and extent
`
`of Opposer’s use and advertising of its BUG JUICE Marks, the nationwide use of Opposer’s BUG
`
`JUICE Marks, and the degree of recognition of Opposer’s BUG JUICE Marks, Opposer’s BUG
`
`JUICE Marks have become famous throughout the United States. Opposer’s BUG JUICE Marks
`
`were famous prior to the filing date of the Application. Given Opposer’s national fame and renown,
`
`Applicant’s GREEN HEAD BUG JUICE Application is dilutive of, and will continue to dilute,
`
`the distinctive quality of Opposer’s BUG JUICE Marks in violation of 15 U.S.C. §§ 1125(c) and
`
`1063(a). Accordingly, Opposer will be irreparably damaged by registration of Applicant’s applied-
`
`for mark GREEN HEAD BUG JUICE.
`
`21.
`
`Further, deficiencies or faults in the quality of Applicant’s goods covered by the
`
`Application are likely to reflect negatively upon and seriously injure the reputation which Opposer
`
`has established for its products and marketed under Opposer’s Marks. This confusion is likely to
`
`result in loss of revenues to Opposer and damage to its reputation.
`
`22.
`
`For these reasons, registration of the Application is contrary to the provisions of
`
`Section 2 and 43 of the Lanham Act, 15 U.S.C. § 1052, and Opposer would be damaged thereby.
`
`23.
`
`In order to protect the public against confusion and deceit, and to protect the BUG
`
`JUICE Marks from infringement, dilution, and unfair competition, registration of Applicant’s
`
`
`
`

`GREEN HEAD BUG JUICE Application should be refused under Sections 2(d), 43(c)(1) and 13
`
`of the Lanham Act, 15 U.S.C. §§ 1052(d) and 1063.
`
`
`
`WHEREFORE, Opposer respectfully requests that said Application Serial No.
`
`88/177,404 be rejected, that no registration be issued thereon to Applicant, that this Opposition be
`
`sustained in favor of Opposer and that the Trademark Trial and Appeal Board grant such other and
`
`further relief as it deems just and appropriate.
`
`The requisite filing fee prescribed by 37 C.F.R. § 2.6(a)(17) should be charged to Deposit
`
`Account No. 502876. If there are any additional fees due in connection with this Notice of
`
`Opposition, they should also be charged to Deposit Account No. 502876, and any excess fees
`
`should be credited to the same.
`
`All correspondence relating to this matter should be directed to the undersigned attorneys
