`In the matter of Application Serial No. 87/315,983 (“the ‘983 Application”), filed on

`January 27, 2017 by Applicant Bkon LLC (“Applicant”), for the mark RAINCRAFT: Opposer
`
`Sazerac Brands, LLC (“Sazerac” or “Opposer”), believes that it will be damaged by registration
`
`of the mark shown in the above-identified application, and hereby opposes the same in
`
`accordance with the provisions of Section 13 of the Trademark Act of July 5, 1946 (15 U.S.C. §
`
`1063). The grounds for this Opposition are as follows:
`
`PARTIES AND STANDING
`
`1.

`Opposer Sazerac Brands, LLC is a limited liability company organized under the
`
`laws of Delaware with its principal place of business in Louisville, Kentucky.
`
`2.
`
`On information and belief, Applicant Bkon LLC is a limited liability company
`
`with an office address in Newark, Delaware.
`

`Opposer is the owner of U.S. Reg. No. 3,306,396 (“the ‘396 Registration”), an
`
`incontestable registration for the mark RAIN [stylized], issued October 8, 2007, for use in
`
`connection with “vodka” in Class 33, based on a claim of use in commerce since 2006. See
`
`Exhibit 1.
`

`Opposer also owns U.S. Reg. No. 3,442,010 (“the ‘010 Registration”), an
`
`incontestable registration for the mark RAIN ORGANICS [& design], issued June 3, 2008, for
`
`use in connection with “vodka distilled from organic grains” in Class 33, based on a claim of use
`
`in commerce since 2008. See Exhibit 2.
`

`Opposer and Applicant are both engaged in the marketing and sale of liquor and
`
`are thus direct competitors.
`

`
`As a competitor, and as the owner of record of prior registrations for similar
`
`marks for similar and/or related goods, Opposer has standing to bring this action.

`FACTS
`
`Opposer’s Marks
`

`Opposer, with and through its affiliates, markets and sells a number of different
`
`types of brands of alcoholic beverages and distilled spirits, including vodkas, whiskeys, tequilas,
`
`liqueurs, and other spirits, and has done so for over a century.
`

`
`Opposer, through its predecessor in interest, first adopted the RAIN [stylized]
`
`mark for use in connection with vodka in 2006, and use of the mark continues to the present day.
`
`For over ten years, Opposer, together with its predecessors in interest, has invested substantial
`
`amounts of money, time and effort in developing, establishing, promoting and selling its
`
`products in connection with the RAIN [stylized] mark.
`

`Opposer, through its predecessor in interest, first adopted the RAIN ORGANICS
`
`[& design] mark for use in connection with vodka in 2008, and use of the mark continues to the
`
`present day. For over ten years, Opposer, together with its predecessors in interest, has invested
`
`substantial amounts of money, time and effort in developing, establishing, promoting and selling
`
`its products in connection with the RAIN ORGANICS [& design] mark. The RAIN [stylized]
`
`Mark and the RAIN ORGANICS [& design] Mark shall be collectively referred to herein as the
`
`“RAIN Marks.”
`
`10.
`
`As a result of its efforts, Opposer has developed substantial goodwill in the RAIN
`
`Marks, and they are valuable assets of Opposer.
`
`11.
`
`Opposer markets products bearing the RAIN Marks to all categories of alcohol
`
`drinkers.
`
`12.
`
`Opposer’s products bearing the RAIN Marks are sold throughout the United
`
`States where alcoholic beverages are typically sold. This includes “off premises” sales at liquor
`
`stores, grocery stores, and other retail outlets and “on premises” sales at bars, restaurants, and
`
`other locations.
`
`13.
`
`Opposer and its predecessors in interest have been diligent in protecting
`
`Opposer’s rights in the RAIN Marks. As noted above, Opposer is the owner of the ‘396
`
`Registration and the ‘010 Registration, each of which has attained incontestable status under
`
`Sections 14 and 15 of the Act.
`
`Applicant’s Mark
`

`
`Applicant filed the subject ‘983 Application on January 27, 2017, seeking
`
`registration of the mark RAINCRAFT for use in connection with inter alia “carbonated alcoholic
`
`
`

`beverages, except beer; alcoholic beverages, except beer, containing dried fruits, herbs, spices
`
`and vegetation” in Class 33, based on a claim of intent-to-use the mark in U.S. commerce.
`
`15.
`
`The ‘983 Application was published in the Official Gazette on March 6, 2018,
`
`with extensions of time to oppose the application granted to Opposer until September 2, 2018.
`
`16.
`
`Upon information and belief, given the long-standing and prominent use of the
`
`RAIN Marks by Opposer, Applicant must have known of Opposer’s rights in the RAIN Marks.
`
`Also, given Opposer’s prior federal registrations for the RAIN Marks, Applicant had at least
`
`constructive notice of Opposer’s rights in the RAIN Marks.
`
`FIRST GROUNDS FOR OPPOSITION:
`PRIORITY & LIKELIHOOD OF CONFUSION

`Opposer hereby repeats and re-alleges the allegations contained in paragraphs 1
`
`17.

`through 16 above as if fully set forth herein.

`As described above, Opposer is the owner of common law and registered rights in
`
`the RAIN Marks.
`
`19.
`
`Opposer’s use in commerce and registrations of the RAIN Marks long predate any
`
`priority date Applicant can claim for its RAINCRAFT Mark.
`
`20.
`
`The marks in question – RAIN [Stylized] and RAIN ORGANICS [& Design]
`
`versus RAINCRAFT – are highly similar.
`
`21.
`
`The goods claimed in the ‘983 Application are highly similar and/or closely
`
`related to Opposer’s goods. Because there are no restrictions set forth in the ‘983 Application as
`
`to the channels of trade, it is presumed that Applicant’s goods will be sold in the same channels
`
`of trade and to the same intended customers as Opposer’s.

`Upon information and belief, Applicant’s goods would travel and/or be promoted
`
`in the same or similar channels of trade as Opposer’s, for sale to the same class of consumers.
`

`There is a likelihood that consumers and potential consumers of either Opposer or
`
`Applicant will be confused or deceived into believing that the goods emanate from the same
`
`source, or that one is somehow sponsored by or affiliated with the other, all to the great
`
`detriment of the goodwill which Opposer has built in its RAIN Marks.
`
`24.
`
`As a result of this likely confusion, Opposer is likely to be irreparably harmed and
`
`damaged by the allowance of the ‘983 Application.
`
`25.
`
`Opposer has not consented and does not consent to Applicant’s use or registration
`
`of Applicant’s proposed mark in the United States.
`
`
`
`WHEREFORE, Opposer respectfully requests that the Board sustain this Opposition, and
`
`refuse registration of the ‘983 Application, and grant such other and further relief as the Board
`
`deems just and proper.
