`On January 15, 2020, the Board issued an order granting Applicant’s consented
`
`motion to extend its time to respond to Opposer’s motion for judgment as a discovery
`
`sanction.1 Applicant was allowed until February 14, 2020, to file its response to the
`
`motion. No response has been filed.
`
`In view thereof, Opposer’s motion for judgment as a discovery sanction (filed
`
`November 25, 2019) is granted as conceded. See Trademark Rules 2.120(h) and
`
`2.127(a).
`
`Accordingly, judgment is entered against Applicant, the opposition is sustained,
`
`and registration to Applicant is refused.
`
`
`1 Applicant’s response to Opposer’s motion for discovery sanctions was due on Monday,
`December 16, 2019. See Trademark Rule 2.127(a). Thus, the parties’ consented motion for an
`extension of time to respond to the motion was untimely. Nevertheless, because the motion
`was consented, the Board exercised its discretion to construe it as a consent motion to reopen
`the time period for Applicant to respond to the motion for discovery sanctions by 30 days.
