`Monster Energy Company, a Delaware corporation, located and doing business at

`1 Monster Way, Corona, California 92879, (“Opposer”) believes that it will be damaged by
`
`registration of U.S. Trademark Application Serial No. 87/704766 (“Application”) for the mark
`
`LICORICE MONSTER filed by I Love Sugar, Inc (“Applicant”) and therefore opposes the
`
`same.
`
`
`
`As grounds for opposition, it is alleged:
`

`
`By the Application filed on December 1, 2017, Applicant seeks to obtain registration
`
`on the Principal Register of the trademark LICORICE MONSTER for “Clothing, namely, t-shirts,
`
`tank tops, sweat shirts, sweatpants, jackets, hats, caps being headwear, swimwear apparel, active
`
`wear apparel in the nature of shirts, pants, jackets, and swimwear apparel” in International Class
`
`25, “Candies; confectionery made of sugar and sugar substitutes” in International Class 30, and
`
`
`

`“Retail store services featuring candy, bulk candy, novelty candy, confectionery-based goods,
`
`chocolate, clothing, accessories and gift items” in International Class 35. Applicant’s
`
`Application is based on Applicant’s alleged intent-to-use the mark in interstate commerce.

`Since at least 2002, long before the filing date of the Application, Opposer has
`
`been, and still is, engaged in the development, marketing, and/or sale of nutritional supplements,
`
`beverages, clothing, hats, and other accessories and products under the marks MONSTERTM and
`
`MONSTER ENERGY® and related marks, all containing “MONSTER.” Opposer’s family of
`
`MONSTER Marks
`
`includes, for example,
`
`the following: MONSTERTM, MONSTER
`
`ENERGY®, MUSCLE MONSTER®, PUNCH MONSTER®, JUICE MONSTER®, JAVA
`
`MONSTER®, MONSTER ASSAULT®, MONSTER REHAB®, UBERMONSTER®, M
`
`MONSTER ENERGY®, LO-CARB MONSTER ENERGY®, MONSTER ENERGY ULTRA
`
`BLUE®, MONSTER ENERGY ULTRA RED®, MONSTER ENERGY ULTRA BLACK®,
`
`MONSTER ENERGY ULTRA CITRON®, MONSTER ARMYTM,
`
`®, and
`
` ® (hereinafter collectively the “MONSTER Marks”).

`Since at least before the filing date of the Application, Opposer has continuously
`
`used and promoted its MONSTER Marks. By virtue of Opposer’s continuous and substantial use,
`
`the MONSTER Marks have become famous identifiers of Opposer such that consumers have
`
`come to recognize a family of MONSTER Marks with which Opposer markets and sells its
`
`goods and services. Opposer’s family of MONSTER Marks is the subject of substantial and
`
`
`

`continuous marketing and promotion by Opposer in connection with its MONSTER line of
`
`drinks, nutritional supplements and other items such as clothing, accessories, and sports gear,
`
`including, for example, t-shirts, hooded shirts, hooded sweatshirts, sweat shirts, jackets, pants,
`
`bandanas, sweat bands, headgear, and other products. Examples of Opposer’s clothing bearing
`
`the MONSTER Marks are shown below:

`Opposer’s beverages bearing its MONSTERTM Marks have been and/or are
`
`currently sold or distributed at locations throughout the U.S., including where candy and other
`
`food and beverages items are sold for consumption off-premise, such as grocery stores,
`
`convenience stores, club stores, and gas station stores, and for consumption on-premise such as
`
`restaurants, bars, sports venues, theme parks and cinemas. Opposer also uses its MONSTERTM
`
`Marks in connection with its Monster Beastro restaurant. The following are images of the
`
`Monster Beastro restaurant showing exemplary use of the MONSTER Marks in connection with
`
`the restaurant:

`Opposer also has and continues to widely market and promote its family of
`
`MONSTER Marks to consumers by, for example, displaying the MONSTER Marks extensively
`
`on apparel, merchandise, and on product samplings; on billions of cans; on promotional and
`
`point of sale materials; in magazines and other publications; on the monsterenergy.com website,
`
`monsterarmy.com website and other Internet websites and social media sites; and at trade shows,
`
`concert tours and live events. In addition, Opposer promotes the MONSTER Marks through, for
`
`
`

`example, the sponsorship of music festivals, athletes, and sports events that are televised
`
`nationwide and internationally.
`

`In addition, since at least as early as 2003, restaurant and bar services have been
`
`provided at Opposer’s VIP and hospitality areas at events sponsored or attended by Opposer.
`
`Opposer’s family of MONSTER Marks are displayed in connection with these restaurant and bar
`
`services. Restaurant and bar services have been offered by Opposer at events held across the
`
`U.S., including, but not limited to, Arenacross events, NASCAR events, the MONSTER
`
`ENERGY® Cup, SXSW, the Arnold Classic, the MONSTER ENERGY® DUB Show Tour, the
`
`X Games, Supercross events, and the Warped Tour, among others.
`

`Opposer has built up, at great expense and effort, valuable goodwill in its family of
`
`MONSTER Marks and has developed strong common law rights in Opposer’s MONSTER
`
`Marks, which have appeared on billions of cans of beverages and nutritional supplements and in
`
`extensive nationwide promotions. Opposer’s common law rights in its family of MONSTER
`
`Marks predate the filing date of the Application, and Opposer relies on its common law trademark
`
`rights.
`

`In addition to Opposer’s common law rights, Opposer owns and relies on the
`
`incontestable U.S. Trademark Registration No. 3,908,601 (the “’601 Registration”) for the mark
`
`® for “clothing, namely, t-shirts, hooded shirts and hooded sweatshirts, sweat shirts,
`
`jackets, pants, bandanas, sweat bands and gloves; headgear, namely, hats and beanies” in
`
`International Class 25, which registration issued January 18, 2011 and is based on an application
`
`filed in the United States Patent and Trademark Office (“PTO”) on April 2, 2009. The filing date
`
`of Opposer’s ’601 Registration is prior to the filing date of the Application. True and correct

`Opposer owns and relies on U.S. Trademark Registration No. 5,114,854 (the

`“’854 Registration”) for the mark MONSTER ENERGY® for “Restaurant services; bar
`
`services” in International Class 43, which registration issued January 3, 2017 and is based on an
`
`application filed in the PTO on December 2, 2013. The filing date of Opposer’s ’854
`
`Registration is prior to the filing date of the Application. True and correct copies of the specifics
`
`of the ’854 Registration obtained from the PTO’s TESS and Assignment databases are attached
`
`hereto as Exhibit 2 and made of record.

`Opposer owns and relies on U.S. Trademark Registration No. 5,114,853 (the “’853

`Registration”) for the mark

`® for “restaurant services; bar services” in International Class
`
`43, which registration issued January 3, 2017 and is based on an application filed in the PTO on
`
`November 27, 2013. The filing date of Opposer’s ’853 Registration is prior to the filing date of the
`
`Application. True and correct copies of the specifics of the ’853 Registration obtained from the
`
`PTO’s TESS and Assignment databases are attached hereto as Exhibit 3 and made of record.

`11. Opposer owns and relies on U.S. Trademark Registration No. 4,721,433 (the “’433

`Registration”) for the mark MONSTER ENERGY® for “promoting goods and services in the
`
`sports, motorsports, electronic sports, and music industries through the distribution of printed, audio
`
`and visual promotional materials; promoting sports and music events and competitions for others”
`
`in International Class 35, which registration issued April 14, 2015 and is based on an application
`
`filed in the PTO on March 12, 2014. The filing date of Opposer’s ’433 Registration is prior to the
