`Pursuant to 37 CFR §2.117 and the Trademark Trial and Appeal Board Manual of

`Procedure (TBMP) Chapter 510.02(a), Opposer Ghost Management Group, LLC (“Opposer”)
`
`hereby moves for an Order suspending this Opposition pending the disposition of Civil Action
`
`No. 8:18-cv-337, Ghost Management Group, LLC v. Octavio Sanchez, in the U.S. District Court
`
`for the Central District of California Southern Division.
`
`In the Federal Court action, Opposer filed a complaint alleging that Applicant’s use of the
`
` mark constitutes trademark infringement, trade dress infringement,
`
`trademark dilution, copyright infringement, cybersquatting, California common law unfair
`
`
`

`competition and California statutory unfair competition of Opposer’s WEEDMAPS® and
`
`WEEDMENU® trademarks.
`
`A copy of Opposer’s Complaint, Civil Cover Sheet and Reports on the Filing of an
`
`Action are attached hereto as Exhibit A.
`
`Opposer’s rights in its WEEDMAPS® and WEEDMENU® trademarks are a central issue
`
`in both the opposition proceeding and the civil litigation. As such, Opposer states that the
`
`pending civil litigation will have a direct bearing on the opposition proceeding and as such,
`
`suspension should be granted. See 37 CFR §2.117(a); General Motors Corp. v. Cadillac Club
`
`Fashions Inc., 22 USPQ2d 1933 (TTAB 1992); T.B.M.P. § 510.02(a). Further, an answer in the
`
`civil litigation has been filed.
`
`Accordingly, Opposer respectfully requests
`
`that
`
`the above-captioned opposition
`
`proceeding be suspended pending final resolution of Civil Action No. 8:18-cv-337.

`The Court has original subject matter jurisdiction over the claims for

`trademark dilution, copyright infringement, and

`cybersquatting pursuant to '15 U.S.C. §§ '1 '1

`'16 and 1 121 (a), as these claims arise
`
`under the laws of the United States. The Court has supplemental jurisdiction over
`
`the claims in this Complaint which arise under state statutory and common law
`
`pursuant to 28 U.S.C. §§ 1338(b) and 1367(a), because the state law claims are so
`
`related to the federal claims that they form part of the same case or controversy and
`
`derive from a comm on nucleus of operative facts.

`This Court has personal

`jurisdiction over Defendant Mr. Sanchez

`because, on information and belief, he is domiciled and resides in this Judicial

`District and maintains a place of business within this Judicial District from which

`he has conducted the business complained of herein.

`Weedmaps is a limited liability company organized and existing under

`the laws of the State of Delaware, having a principal place of business at 4']

`Discovery, Irvine, California 92618.

`Upon information and belief, Defendant Mr. Sanchez is an individual

`domiciled and conducting business at '12'l54 Cherrylee Drive, El Monte, California

`GENERAL ALLEGATIONS

`Weedmaps provides, among other things, the weedmapscom website

`and related mobile application, which provide, among other things, marketing
`
`services to marijuana dispensaries, delivery services, doctors, and brands in states
`
`and countries which have legalized marijuana (whether for adult-use or medical
`
`purposes), educational information for its users, and an online community where
`
`marijuana users can interact with one another.

`Weedmaps provides

`its users with information regarding legal
`
`cannabis industry dispensaries, delivery services, doc-tors, and brands in locations
`
`across the United States and internationally where cannabis has been legalized
`
`(whether for adult-use or medical purposes), including Alaska, Arizona, California,
`
`Colorado, Delaware, Florida, Hawaii, Illinois, Louisiana, Maryland, Massachusetts,
`
`Michigan, Minnesota, Mississippi, Montana, Nevada, New Mexico, New York,
`
`North Dakota, Oregon, Pennsylvania, Rhode
`
`Island, Texas, Washington,
`
`Washington DC, and West Virginia, as well as Australia, Canada, Germany,
`
`Ireland, Puerto Rico, Spain, and Switzerland,

`Upon information and belief, Mr. Sanchez conducts business under

`the d/b/a Weedmenu including, for example, through the weedmenuorg website

`others by providing a website featuring coupons,
`
`rebates, price-comparison
`
`information, product reviews,
`
`links to the websites of others, and discount
`
`information, On-line cataloging of the goods of others; electronic catalog services
`
`featuring herbal products, online services, namely,
`
`inventory monitoring and
`
`management for herbal products” in Class 35, and “Providing on-line forums for
`
`transmission of messages among computer users concerning herbal products” in
`
`Class 38, which was registered on the Principal Register on April 16, 2013. The
`
`’512 Registration is based on an application filed in the United States Patent and
`
`Trademark Office (“PTO”) on May 5, 201 l and claims a date of first use of August
`
`2008. A copy of the Registration Certificate for the ’512 Registration is attached
`
`hereto as Exhibit 1.

`12. Weedmaps owns U.S. Mark Registration No. 4,321,513 (the “’513

`
