`NOTICE OF OPPOSITION
`
`
`
`DEEP SOUTH BARRELS, L.L.C., a limited liability company organized and existing
`
`under the laws of the State of Texas, with its principal place business at 2849 Miller Ranch Road,
`
`STE 533, Pearland, Texas 77584 (hereafter “Opposer” or “Opposer DSB”) believes it is or will be
`
`damaged by registration on the Principal Register of the marks BOOTLEG KIT shown in Appln.
`
`No. 87122053, and hereby opposes the same.
`
`As grounds of opposition it is alleged that:
`

`
`Thousand Oaks Barrel, LLC (“Thousand Oaks” or “Applicant”) seeks to register
`
`BOOTLEG KIT as a mark for kits for aging and flavoring of distilled spirits comprising oak wood
`
`barrels, flavors for adding to distilled spirits, and instructions on how to flavor and age distilled
`
`spirits; as evidenced by the publication of the mark in the Official Gazette of January 3, 2017.
`

`Opposer is and has been engaged in the development, marketing, advertising, sale
`
`and/or distribution of various products, accessories, and kits utilized in the home distilling and
`
`aging of spirits as well as various other products and services related or complimentary thereto.
`

`Opposer has engaged in such activities since 2010.
`
`Opposer has used the terms BOOTLEG BOX and for a brief time, BOOTLEG KIT
`
`generically to identify multiple home-distilling product lines that are offered for sale at fairs and
`
`festivals in several different states and from its website. Opposer continues to sell its BOOTLEG
`
`BOX home-distilling product lines.
`

`The term “bootleg” is widely used society as well as the home-distilling, spirits,
`
`law enforcement industries generically to identify the act of illegal trafficking in liquor in violation
`
`of legislative restrictions on its manufacture, sale, or transportation. The word apparently came
`
`into general use in the Midwest in the 1880s to denote the practice of concealing flasks of illicit
`
`

`liquor in boot tops when going to trade with Indians. The term became part of the American
`
`vocabulary when the Eighteenth Amendment to the U.S. Constitution effected the national
`
`prohibition of alcohol from 1920 until its repeal in 1933. In terms of alcohol bootlegging, a 1926
`
`article identified several different categories of activities that made up the profession of
`
`bootlegging, including re-distillation or recooking, homebrewing and accessory stores, and
`
`homemade wine, ciders and cordials. See Willing, Joseph K. "The profession of bootlegging."
`
`The ANNALS of the American Academy of Political and Social Science 125.1 (1926): 40-48.
`
`Since that time, the term bootleg has been broadened, encompassing multiple forms of copying
`
`and distribution of products which are not sanctioned by the original manufacturer or producer of
`
`a good. Exhibit A, attached hereto, shows common generic uses of the term “bootleg” related to
`
`the aging or flavoring of distilled spirits comprising oak wood barrels, flavors for adding to
`
`distilled spirits, and instructions on how to flavor and age distilled spirits. Exhibit A includes how
`
`the term bootleg is descriptive of a wide variety of activities. Finally, Exhibit A demonstrates the
`
`common usage of the term bootleg in association with “kit” to describe a collection of goods that
`
`would enable the consumer to bootleg alcohol, either through transport or home aging or flavoring.
`

`Applicant also uses the term “bootleg” generically to identify the product it sells,
`
`home-distilling kits, in its own advertisements.
`
`7.
`
`Application No. 87122053 does not contain a color claim and used in any font,
`
`style, size or color in connection with Applicant’s products.
`
`8.
`
`The KIT portion of the BOOTLEG KIT mark, as shown in Application No.
`
`87122053 has been disclaimed.
`
`CLAIM 1: Applicant’s Mark is Generic and/or Descriptive
`

`Opposer repeats and realleges paragraphs 1-8 above as if fully set forth herein.

`Applicant’s alleged BOOTLEG KIT mark is incapable of distinguishing its goods
`
`from like goods of others, including Opposer, because others, including Opposer, have used and
`
`continue to use and have the right to use such term generically in connection with the same, and
`
`closely related products.
`

`Alternatively, if Applicant’s alleged mark is not deemed to be generic, it is merely
`
`descriptive of the practical and/or conceptual use of the product, and is incapable of acquiring
`
`secondary meaning, as the Applicant cannot show substantial exclusivity of use.
`

`
`If Applicant is able to obtain registration for the mark which is the subject of this
`
`Opposition, Opposer, among others would be damaged because there would be a cloud on its
`
`ability to use the terms “bootleg,” “bootleg box,” and/or “bootleg kit” as they has been used,
`
`namely to identify a group of items sold together, such as products, instructions, and/or accessories
`
`related to the aging or flavoring of distilled spirits comprising oak wood barrels, flavors for adding
`
`to distilled spirits, and instructions on how to flavor and age distilled spirits.
`

`The registration which is the subject of this Opposition would accord Applicant a
`
`prima facie exclusive right to use the mark for the goods identified in the Application. Such
`
`registration would be a source of damage and injury to DSB, its customers, and others who use
`
`and have a right to use common language to identify their products, and particularly the practical
`
`and/or conceptual use of the product, of their products which is a feature commonly used to
`
`designate the aging or flavoring of alcohol that is not sanctioned by the original distiller.
`

`By reason of the foregoing, Opposer is likely to be harmed by registration of
`
`Application No. 87122053 for the mark BOOTLEG KIT.
`
`CLAIM 2: Fraud
`

`Opposer repeats and realleges paragraphs 1-14 above as if fully set forth herein.

`In connection with the submission of Application No. 87122053 Applicant declared
`
`that no other persons have the right to use the mark in commerce, either in the identical form or in
`
`such near resemblance as to be likely to cause confusion, when used in connection with the
`
`goods/services of such other persons. At the time of the submission, Applicant had full knowledge
`
`that other persons in the industry had been using the terms BOOTLEG and KIT together and
`
`separately to describe a lot or group of products to age or flavor alcohol in a way not sanctioned
`
`by the original manufacturer.
`
`17.
`
`In addition, on information and belief, third parties in the home-distilling industry
`
`were making use of the term BOOTLEG KIT to describe fundamental characteristics of their
`
`home-distilling products in the years prior to Applicant’s submission.
`
`18.
`
`Applicant’s statements to the Patent and Trademark Office that no other persons
`
`have the right to use the mark in commerce were false and known to be false when made.
`
`19.

`
`Applicant’s conduct constitutes fraud on the Patent and Trademark Office.
`
`By reason of the foregoing, Opposer is likely to be harmed by a registration of
`
`Application No. 87122053 for the mark BOOTLEG KIT.
`
`21. WHEREFORE, Deep South Barrels, L.L.C. prays that registration of the mark of
`
`Application No. 87122053 for the identified product be denied, and that this Opposition be
`
`sustained. The Trademark Trial and Appeal Board is hereby authorized to charge the opposition
`
`filing fee of $300.

`Prohibition ended the legal sale of liquor and thereby
`created demand for an illicit supply. The earliest
`bootleggers began smuggling foreign-made
`commercial liquor into the United States from across
`the Canadian and Mexican borders and along the
`seacoasts from ships under foreign registry. Their favourite sources of supply were the
`Bahamas, Cuba, and the French islands of St. Pierre and Miquelon, off the southern coast of
`Newfoundland. A favourite rendezvous of the rum-running ships was a point opposite
`Atlantic City, New Jersey, just outside the three-mile limit beyond which the U.S.
`government lacked jurisdiction. The bootleggers anchored in this area and discharged their
`loads into high-powered craft that were built to outrace U.S. Coast Guard cutters.
`
`This type of smuggling became more risky and expensive when the U.S. Coast Guard began
`halting and searching ships at greater distances from the coast and using fast motor
`launches of its own. Bootleggers had other major sources of supply, however. Among these
`were millions of bottles of “medicinal” whiskey that were sold across drugstore counters on
`real or forged prescriptions. In addition, various American industries were permitted to use
`denatured alcohol, which had been mixed with obnoxious chemicals to render it unfit for
`drinking. Millions of gallons of this were illegally diverted, “washed” of noxious chemicals,
`mixed with tap water and perhaps a dash of real liquor for flavour, and sold to speakeasies
`or individual customers. Finally, bootleggers took to bottling their own concoctions of
`spurious liquor, and by the late 1920s stills making liquor from corn had become major
`suppliers. Faultily distilled batches of this “rotgut” could be dangerously impure and cause
`blindness, paralysis, and even death.

`Bootlegging helped lead to the establishment of American organized crime, which
`persisted long after the repeal of Prohibition. The distribution of liquor was necessarily more
`complex than other types of criminal activity, and organized gangs eventually arose that
`could control an entire local chain of bootlegging operations, from concealed distilleries and
`breweries through storage and transport channels to speakeasies, restaurants, nightclubs,
`and other retail outlets. These gangs tried to secure and enlarge territories in which they
`had a monopoly of distribution. Gradually the gangs in different cities began to cooperate
`with each other, and they extended their methods of organizing beyond bootlegging to the
`narcotics traffic, gambling rackets, prostitution, labour racketeering, loan-sharking, and
`extortion. The national American crime syndicate, the Mafia, arose out of the coordinated
`activities of Italian bootleggers and other gangsters in New York City in the late 1920s and
`early ’30s.
`
`In 1933 Prohibition was abandoned. The bootlegger did not become extinct, however. In the
`early 21st century, alcohol was still prohibited in a number of U.S. counties and
`municipalities, and bootlegging continued to thrive as an illegal business.
