`lamps; lighting apparatus, namely, lighting installations; lights for vehicles; pocket searchlights;
`
`searchlights; electric Chinese lanterns; film stage lighting apparatus; lamp bulbs; LED lights;
`
`street lamps in International Class 11, filed March 18, 2016, by Shenzhen Ailaike Technology
`
`Co., Ltd., a Chinese limited company having an address at Room 101, 15th Building,
`
`Zhangkeng’erqu, Minzhi Street, Longhua District, Shenzhen, Guangdong, China (“Applicant”).

`Opposer opposes registration of Applicant’s Mark. As the grounds for opposition, Opposer
`
`alleges as follows:

`Opposer owns numerous trademarks including but not limited to SHURFINE,
`
`SHUR FINE, SHUR SAVING, SHUR SHOT, SHURFRESH, and SURECOMFORT for various

`3,557,355; 3,543,602; 3,546,829; 3,557,357; 3,557,359; 4,318,808; 4,576,111; 4,628,829;

`4,637,304; 5,000,932).

`Applicant’s Mark so resembles Opposer’s previously registered SHUR FINE,
`
`SHURFINE, SHURFRESH, SHUR SAVING, SURECOMFORT, and SHUR SHOT marks as to
`
`be likely, when used on or in connection with the goods or services of the Applicant, to cause
`
`confusion, mistake or to deceive within the meaning of Section 2(d) of the Lanham Act, 15
`
`U.S.C. § 1052(d).

`Opposer, since prior to Applicant’s filing date or any date of first use upon which
`
`Applicant can rely, has used and not abandoned the marks SHUR FINE and SHURFINE for a
`
`variety of grocery and household products sold in grocery, convenience, and drug stores.
`

`Opposer, since prior to Applicant’s filing date or any date of first use upon which
`
`Applicant can rely, has used and not abandoned the mark SHURFRESH for a variety of grocery
`
`products sold in grocery, convenience, and drug stores.
`
`5.
`
`Opposer, since prior to Applicant’s filing date or any date of first use upon which
`
`Applicant can rely, has used and not abandoned the mark SHUR SAVING for a variety of
`
`grocery and household products sold in grocery, convenience, and drug stores.
`
`6.
`
`Opposer, since prior to Applicant’s filing date or any date of first use upon which
`
`Applicant can rely, has used and not abandoned the mark SURECOMFORT for adult
`
`incontinence products, namely, diapers and incontinence garments sold in grocery, convenience,
`
`and drug stores.

`Opposer, since prior to Applicant’s filing date or any date of first use upon which
`
`Applicant can rely, has used and not abandoned the mark SHUR SHOT for dietary supplements
`
`and energy drinks sold in grocery, convenience, and drug stores.
`
`8.
`
`Opposer’s marks all have a recognizable common characteristic, namely, the
`
`SHUR-prefix, and are all used for related goods and services.
`
`9.
`
`Since prior to Applicant’s filing date or any date of first use upon which
`
`Applicant can rely, goods and services bearing or offered under Opposer’s SHUR-prefix marks
`
`have been displayed together in advertising and promotional materials and in retail channels
`
`through which the goods and services are offered or sold.
`

`
`As a result of Opposer’s longstanding use and promotion of the SHUR-prefix
`
`marks for related goods and services, the public, prior to Applicant’s filing date or any date of
`
`first use upon which Applicant can rely, has come to recognize goods and services bearing the
`
`SHUR-prefix marks, and identified collectively by SHUR-prefix marks, as goods and services
`
`coming from a single source, namely, Opposer.
`
`11.

`Accordingly, since prior to Applicant’s filing date or any date of first use upon
`
`which Applicant can rely, Opposer’s SHUR-prefix marks have been a family of marks,
`
`recognized by the public as such.
`
`12.
`
`Applicant’s Mark is so similar to Opposer’s family of marks that, when used on
`
`or in connection with the goods or services of the Applicant, it is likely to be perceived as
`
`another member of Opposer’s family of marks, and is likely to cause confusion, mistake, or
`
`deception within the meaning of Section 2(d) of the Lanham Act, 15 U.S.C. § 1052(d).
`

`Opposer will be damaged by the registration sought by Applicant insofar as such
`
`registration will constitute prima facie evidence of the validity of the registration, Applicant’s

`ownership of the SURLIGHT mark for the goods and services claimed by U.S. Trademark
`
`Application Serial No. 86/944852, and Applicant’s exclusive right to use the SURLIGHT mark
`
`in association with the goods and services claimed by U.S. Trademark Application Serial No.
`
`86/944852, when in fact, Applicant is not entitled to the full scope of such rights by virtue of
`
`Opposer’s prior and continuous use of the Shurfine family of marks described herein, which are
`
`used in connection with related goods and services, and which are sold in the same channels of
`
`trade, as those claimed by U.S. Trademark Application Serial No. 86/944852.
`
`14.

`Based on the foregoing, registration of the SURLIGHT mark, as shown by U.S.
`
`Trademark Application Serial No. 86/944852 is likely to cause injury and damage to Opposer.
`
`WHEREFORE, Opposer respectfully requests that registration of the mark SURLIGHT,
`
`as shown by U.S. Trademark Application Serial No. 86/944852, be denied under Section 2(d) of
`
`the Lanham Act, 15 U.S.C. § 1052(d), and that this Notice of Opposition be sustained.
