`·1· ·I think you and I have previously discussed the use of
`
`·2· ·the discovery depositions in support of the positions --
`
`·3· ·in other words, those could be used not necessarily in
`
`·4· ·the same manner as the trial testimony, but that those
`
`·5· ·would be introduced into the record for the purpose of
`
`·6· ·determination -- or use for determination by the TTAB; is
`
`·7· ·that correct.
`
`·8· · · · · · · · · · ·MR. GRIFFITH:· I think what we
`
`·9· ·discussed and decided was that the depositions --
`
`10· ·discovery depositions of the opposing witnesses could be
`
`11· ·used by each party.· In other words, NOJA can use the
`
`12· ·depositions of the two employees of S&C; and S&C can use
`
`13· ·the two depositions of Mr. Wilson and Mr. Campanalie in
`
`14· ·addition to Mr. O'Sullivan without taking the trial
`
`15· ·testimony over again.
`
`16· · · · · · · · · · ·MR. PENN:· Okay.· All right.· Very
`
`17· ·good.· Okay, good.
`
`18· · · ·With that in mind -- well, I guess I need -- in any
`
`19· ·event -- you know, let's go off the record for a second.
`
`20· · · · · · · · · · ·MR. GRIFFITH:· Sure.
`
`21· · · · · · · · · · · · · · ·(Discussion off the record.)
`
`22· · · · · · · · · · ·MR. PENN:· Okay.· We can go back on
`
`23· ·the record.

`
`·1· · · · · · · · · · · · · DIRECT EXAMINATION
`
`·2· · · ·BY MR. PENN:
`
`September 27, 2018
`
`Page 6
`
`·3· ·Q· ·All right.· Mr. Wilson, since you've already -- we've got
`
`·4· · · ·certain items that are already in the record and the
`
`·5· · · ·purpose of today's deposition is somewhat limited.· It's
`
`·6· · · ·not as broad as the discovery deposition that was taken
`
`·7· · · ·previously by Mr. Griffith.· I think you'll find that
`
`·8· · · ·today's deposition is much more -- it's shorter and more
`
`·9· · · ·to the point as opposed to much more open ended like a
`
`10· · · ·discovery deposition.
`
`11· · · · · ·That being said, there are the same general rules
`
`12· · · ·that apply with any deposition.· That is, that all of
`
`13· · · ·your answers be verbal.· In other words, don't shake your
`
`14· · · ·head or nod, give us a yes or no.
`
`15· · · · · ·If on cross-examination Mr. Griffith is asking you
`
`16· · · ·questions and he asks you a yes or no, you need to answer
`
`17· · · ·the yes or no, but you can explain your answer.
`
`18· · · · · ·If you don't understand one of my questions, please
`
`19· · · ·feel free to, you know, stop me and ask me to clarify the
`
`20· · · ·question, but I'll try to make it as clear as possible.
`
`21· · · · · ·Do you have any questions, Mr. Wilson?
`
`22· ·A· ·I do not.
`
`23· ·Q· ·All right.· Very good.· All right.
`
`24· · · · · ·Let's just start out by telling me -- I want to talk
`
`25· · · ·about your background, both in terms of education and

`
`·2· · · ·introduce what I will mark as Exhibit -- this will be
`
`·3· · · ·Opposer's Exhibit 1.· And I'd ask you if you can pull out
`
`·4· · · ·your resume.
`
`·5· ·A· ·I have it in front of me.
`
`·6· ·Q· ·And if you can give that to the court reporter, she'll
`
`·7· · · ·put a sticker on it.
`
`·8· · · · · · · · · · · · · · · · ·(Exhibit No. 1 marked for
`
`·9· · · · · · · · · · · · · · · · · identification.)
`
`10· ·A· ·All right.
`
`11· ·Q· ·(By Mr. Penn)· All right.· So let's just talk generally
`
`12· · · ·about your -- this resume, the document that's been
`
`13· · · ·marked as Exhibit 1.
`
`14· · · · · ·Is this a true and accurate depiction of your
`
`15· · · ·education and work experience?
`
`16· ·A· ·(Perusing.)
`
`17· · · · · ·Yes, it is with the exception of professional
`
`18· · · ·license and certification.· I did not renew the certified
`
`19· · · ·professional and supply management certification.
`
`20· ·Q· ·Okay.
`
`21· · · · · ·At the time that you got me this resume last year,
`
`22· · · ·you did in fact have that certificate and now you do not?
`
`23· ·A· ·That's correct.
`
`24· ·Q· ·Okay.
`
`25· · · · · ·Tell me briefly about your education of college and

`
`·1· · · ·subsequent.· I don't need the high school so much.
`
`·2· ·A· ·Okay.· So in college I graduated with a degree in
`
`·3· · · ·finance.· I had a Navy scholarship and so therefore I had
`
`·4· · · ·to take the Navy engineering prerequisites to get into
`
`·5· · · ·their engineering school to become an engineering
`
`·6· · · ·officer.· And so that meant that in addition to my
`
`·7· · · ·finance program, I took physics, naval science, and
`
`·8· · · ·engineering calculus through calc 3.
`
`·9· ·Q· ·Okay.
`
`10· · · · · ·Now did you get an engineering degree?
`
`11· ·A· ·I did not.· I had -- it would be a finance and naval
`
`12· · · ·science.
`
`13· ·Q· ·Gotcha.· And after -- I know you did some time in the
`
`14· · · ·Navy.· I want to kind of tab forward ahead to that first
`
`15· · · ·position in the private sector, which would have been the
`
`16· · · ·Honeywell?
`
`17· ·A· ·Okay.
`
`18· ·Q· ·Is that correct?
`
`19· ·A· ·Yes.
`
`20· ·Q· ·What did you do for Honeywell?
`
`21· ·A· ·So I was a buyer planner and so discreet integrated
`
`22· · · ·circuits as well as working with the factory for defense
`
`23· · · ·avionics to forecast needs and working with the engineers
`
`24· · · ·of those specific products to plan for -- often in the
`
`25· · · ·world of integrated circuits you've got a lot of

`
`·1· · · ·obsolescence that needs to be planned for.· It's like
`
`·2· · · ·what -- what grade of chip is going to come next.· And
`
`·3· · · ·also did some bill of material planning.
`
`·4· ·Q· ·What are integrated circuits?
`
`·5· ·A· ·Oh, okay.
`
`·6· · · · · ·So an integrated circuit is where you take --
`
`·7· · · ·probably the simplest way of describing an integrated
`
`·8· · · ·circuit is where you have a number of discreet components
`
`·9· · · ·that perform an operation.
`
`10· · · · · ·So the chip in your computer is going to be an
`
`11· · · ·example of an integrated circuit that we're most familiar
`
`12· · · ·with.· So instead of just -- so a discreet component is
`
`13· · · ·like a resister.· It does one thing.· It resists current
`
`14· · · ·whereas, an integrated circuit is typically designed to
`
`15· · · ·have an input and an output.
`
`16· ·Q· ·All right.
`
`17· · · · · ·And after you left Honeywell you went to work at
`
`18· · · ·Sandia National Laboratories; is that correct?
`
`19· ·A· ·Correct.
`
`20· ·Q· ·What'd you do there?
`
`21· ·A· ·So I was a contracts manager and this would involve
`
`22· · · ·working with various departments, engineering teams.· One
`
`23· · · ·ex -- it's easiest to -- and they're a nuclear research
`
`24· · · ·lab.· Part of the Department of Energy.
`
`25· · · · · ·And so one example of a project that I worked on was

`·1· · · ·an early -- boy, the words are escaping me now.· But it
`
`·2· · · ·was an early machine where you could put in -- load in
`
`·3· · · ·your computer-aided design program and a laser fitted on
`
`·4· · · ·a gantry crane to produce very large fittings and
`
`·5· · · ·assemblies.
`
`·6· ·Q· ·So when you say that you were a contract manager for --
`
`·7· · · ·it says "for large Department of Energy Procurements,"
`
`·8· · · ·what are Department of Energy Procurements?
`
`·9· ·A· ·Oh, okay.
`
`10· · · · · ·So -- and the way they would define it and I
`
`11· · · ·can't -- so at my level, you had to have a master's
`
`12· · · ·degree in order to, you know, work on these procurements
`
`13· · · ·and there was a dollar level.· And I forget what that
`
`14· · · ·threshold was.· But that was defined by that Department
`
`15· · · ·as a large procurement.
`
`16· · · · · ·So what it basically meant was that I would be
`
`17· · · ·working on the million-dollar procurements.
`
`18· ·Q· ·And what were you actually doing?
`
`19· ·A· ·Oh, okay.
`
`20· · · · · ·So I would find out the needs of the engineering
`
`21· · · ·department and interpret those into a commercially viable
`
`22· · · ·document so that we could go out and source it and work
`
`23· · · ·with the suppliers to ensure that the Department of
`
`24· · · ·Energy and Sandia Labs received what they had contracted
`
`25· · · ·for.

`

`
`·4· · · ·buying process?
`
`·5· ·A· ·No, that would be with Honeywell Defense Avionics.
`
`·6· ·Q· ·Okay.
`
`·7· · · · · ·Oh, because you were a buyer planner when you were
`
`·8· · · ·at Honeywell?
`
`·9· ·A· ·Correct.
`
`10· ·Q· ·All right.
`
`11· · · · · ·And then you moved and you were at Boxlight
`
`12· · · ·Corporation.· So tell me about Boxlight.
`
`13· ·A· ·So at Boxlight, I managed the operations of the company
`
`14· · · ·which included tech support, the warehouse operations,
`
`15· · · ·the service operations.
`
`16· ·Q· ·What did they sell?
`
`17· ·A· ·They sold LCD -- liquid crystal displays -- and DLP,
`
`18· · · ·which is Texas Instruments' brand for digital light
`
`19· · · ·processing chip-enabled projectors.
`
`20· · · · · ·So you've used them before.· It's what you plug your
`
`21· · · ·computer in to display your computer image up on the
`
`22· · · ·wall.
`
`23· ·Q· ·Gotcha.
`
`24· · · · · ·And then it looks like you had your own business for
`

`·1· ·A· ·Yeah.· And that was a company where we installed these
`

`

`
`·9· ·A· ·Correct.
`
`10· ·Q· ·And you were at Puget Sound for it appears about
`
`11· · · ·12 years?
`
`12· ·A· ·Yes.
`
`13· ·Q· ·And did your position and your roles change throughout
`
`14· · · ·that time, or were they pretty much the same throughout?
`
`15· ·A· ·I was brought on as a senior buyer, but having the most
`
`16· · · ·experience, I quickly took on the role of supervisor.
`
`17· · · ·And eventually, I actually received the title and got
`
`18· · · ·paid for that.· However, the role remained primarily the

`

`
`·5· · · · · · · · · · · · ·MR. PENN:· Back on the record.
`
`·6· ·Q· ·(By Mr. Penn)· Mr. Wilson, I think when we took a break
`
`·7· · · ·there for a moment, you were just starting to tell us
`
`·8· · · ·about your roles at Puget Sound Energy.
`
`·9· ·A· ·Okay.
`
`10· · · · · ·Yeah, and then primarily my role was supervision of
`
`11· · · ·the material buyers and working as a team leader on large
`
`12· · · ·projects.
`
`13· ·Q· ·So tell me about your, at specifically, at Puget Sound
`
`14· · · ·Energy, what it meant to be a material buyer?
`
`15· ·A· ·So what we told folks that asked that question, you know,
`
`16· · · ·when I was at Puget Sound Energy, was that if it comes in
`
`17· · · ·a truck, my team buys it; if it has a heartbeat, the team
`
`18· · · ·across the row buys it.
`
`19· ·Q· ·And -- okay.· And what do you mean -- go ahead and
`
`20· · · ·elaborate on that.
`
`21· ·A· ·Okay.
`
`22· · · · · ·So consultants and software programmers and
`
`23· · · ·temporary labor and the folks that cut the grass, was all
`
`24· · · ·handled by the services department.

`
`·1· · · · · ·So you handled the purchasing of any goods?
`
`·2· ·A· ·Correct.
`
`·3· ·Q· ·And --
`
`·4· ·A· ·There's a little bit of crossover with stuff like
`
`·5· · · ·repairs, but we usually worked it out.
`
`·6· ·Q· ·And what kind of -- I mean, as a -- Puget Sound Energy is
`
`·7· · · ·a utility company, correct?
`
`·8· ·A· ·That is correct.
`
`·9· ·Q· ·And so it provides electric to customers in a certain
`
`10· · · ·geographic area; is that correct?
`
`11· ·A· ·So they're combined utility, which means that they
`
`12· · · ·provide gas service and electric power.
`
`13· ·Q· ·And what's the geographic area?
`
`14· ·A· ·It goes north to the Canadian border; south to about
`
`15· · · ·Centralia, Central Washington; east to just over the
`
`16· · · ·mountains and Kittitas, Washington; and west to the
`
`17· · · ·Kitsap Peninsula.
`

`·1· · · · · ·So my team, it would be everything from conductor;
`
`·2· · · ·meter tags, which is, you know, a very small item that
`
`·3· · · ·goes on your meter; to power transformers where we took
`
`·4· · · ·power off the BPA lines -- Bonneville Power
`
`·5· · · ·Administration lines -- and then put them on the PSE
`

`
`·7· · · · · ·So that would be the range.· Everything from meter
`
`·8· · · ·tags to power transformers.
`
`·9· ·Q· ·And everything in between?
`
`10· ·A· ·And everything in between.
`
`11· ·Q· ·Would you buy switches?
`
`12· ·A· ·Yes.
`
`13· ·Q· ·And do switches come in different shapes?· Sizes?
`
`14· ·A· ·Yes.
`
`15· ·Q· ·Would you buy different types of switches for different
`
`16· · · ·types of uses?
`
`17· ·A· ·Yes.
`
`18· ·Q· ·And in terms of the process for buying various components
`
`19· · · ·for the electrical system, can you give me a little bit
`
`20· · · ·of the process that Puget Sound used?· What you were
`
`21· · · ·involved in?
`
`22· ·A· ·So the standard process for a transmission and
`
`23· · · ·distribution equipment would be that, we would work with
`
`24· · · ·standards to --
`

`
`·1· · · · · ·When you say "standards," you're talking about
`
`·2· · · ·standards of a group of people, correct?
`
`·3· ·A· ·Correct, correct.· Standards engineering.
`
`·4· ·Q· ·Okay.
`
`·5· · · · · ·And what is standards engineering group?· What do
`
`·6· · · ·they do?
`
`·7· ·A· ·Okay.
`
`·8· · · · · ·What they do is that they evaluate -- they'll take a
`
`·9· · · ·need from the transmission and distribution engineers and
`
`10· · · ·they'll take a look at the available technologies as well
`
`11· · · ·as what's suggested by the using organization, the
`
`12· · · ·operational organization.· And they'll make a
`
`13· · · ·determination of what is going to be coded, meaning
`
`14· · · ·that -- what coded means is that they're going to write
`
`15· · · ·up a description and enter it into the catalog and
`
`16· · · ·we'll -- and they'll list approved suppliers, approved
`
`17· · · ·model numbers, approved equipment.
`
`18· ·Q· ·Okay.
`
`19· · · · · ·So then going back to what you were saying, you
`
`20· · · ·would use -- you would get with standards?
`
`21· ·A· ·Correct.
`
`22· ·Q· ·To do what?
`
`23· ·A· ·So if we -- a lot of our work with standards would be to
`
`24· · · ·verify -- if we had questions over what was on a request
`
`25· · · ·for a quote, that would be a team that we would go to for

`·1· · · ·the answers.· Especially if we saw something where, you
`
`·2· · · ·know, it was not clear or there might have been a mistake
`
`·3· · · ·or the model number did not exist, then we were to work
`
`·4· · · ·with standards to resolve those issues.
`
`·5· · · · · ·And once they -- sometimes we would get a
`
`·6· · · ·requisition in where a product was not coded.· There was
`
`·7· · · ·nothing in the catalog for us to buy, or it was an
`
`·8· · · ·open -- and that's when we would work most closely with
`
`·9· · · ·standards and then the requesting organization to make
`
`10· · · ·sure that the description was complete and that a bid
`
`11· · · ·could be made by the manufacturers on that request for
`
`12· · · ·quote.
`
`13· ·Q· ·And my original question was -- for you was, you know,
`
`14· · · ·the buying process.
`
`15· ·A· ·Oh, okay.· So let's see.
`
`16· · · · · ·So the standard process is going to be, we would get
`
`17· · · ·a requisition, we'd verify that we understood the request
`
`18· · · ·for quote, we would go out to the suppliers that were
`
`19· · · ·listed on the request that we would get from our system.
`
`20· · · · · ·And then we would -- depending upon the equipment,
`
`21· · · ·we would either get back the quotes and then we would
`
`22· · · ·call a meeting to evaluate the quotes from the various
`
`23· · · ·suppliers, or if it was a low -- a lower dollar, mature
`
`24· · · ·technology that was, you know, easily misunderstood --
`
`25· · · ·easily understood, we would then place the purchase

`
`·2· ·Q· ·Okay.
`
`·3· · · · · ·And I'm going to get a little bit more into the
`
`·4· · · ·buying process a little more specifically as we move
`
`·5· · · ·through the deposition?
`
`·6· ·A· ·Okay.
`
`·7· · · · · ·Yeah, as you see, you could almost do a tree
`
`·8· · · ·diagram -- or a decision tree, because there was the
`
`·9· · · ·standard process.· And then there's process when it was
`
`10· · · ·more of an engineered product that we didn't have a set
`
`11· · · ·item in the catalog.
`
`12· ·Q· ·If there was -- if it's a new product, something that
`
`13· · · ·wasn't in the catalog, something that was an engineered
`
`14· · · ·product, how many different people would be involved in
`
`15· · · ·the buying process from, you know, determining the need
`
`16· · · ·to identifying a particular product who ultimately, you
`
`17· · · ·know, getting to the point where a P.O. was issued?
`
`18· ·A· ·The best example would be a power transformer.· And even
`
`19· · · ·though those were in the catalog, because of the size of
`
`20· · · ·the investment being made by the utility, often around
`
`21· · · ·$3 million, you would have the project team involved and
`
`22· · · ·that representative would be the engineer for the project
`
`23· · · ·and the project manager.
`
`24· · · · · ·You would have the standards folks involved.
`
`25· · · ·Typically, a supervisor and the specific standards

`
`·2· · · · · ·And you would have the purchasing agent.
`
`·3· · · · · ·And you may have an operations person, such as a
`
`·4· · · ·technical field services.
`
`·5· ·Q· ·And what about products that were not necessarily
`
`·6· · · ·$3 million products, but sort of less expensive products,
`
`·7· · · ·would there --
`
`·8· ·A· ·Yeah, if it's like -- if it's well-defined with good
`
`·9· · · ·descriptions and there was no request by engineering to
`
`10· · · ·be involved, the buyer could then send it out to the
`
`11· · · ·approved manufacturers list, receive the bid replies, and
`
`12· · · ·place the order.
`
`13· ·Q· ·And when you say, "send it out," you're talking about a
`
`14· · · ·bid request.· In other words, he knows what the product
`
`15· · · ·is and they do have a -- and Puget Sound may have had a
`
`16· · · ·list of approved manufacturers for a particular type of
`
`17· · · ·product?
`
`18· ·A· ·Yes.
`
`19· ·Q· ·Okay.
`
`20· · · · · ·And I guess some products are -- you have like, when
`
`21· · · ·you talk about a catalog, is that a catalog like
`
`22· · · ·literally a physical catalog that has products in it with
`
`23· · · ·prices and you just order them?
`
`24· ·A· ·No.
`

`·1· · · ·equipment that was -- that -- and it wasn't just used by
`
`·2· · · ·buyers.· This would also be used by operations personnel.
`
`·3· · · · · ·So say like you were ordering an overhead switch.
`
`·4· ·Q· ·Right.
`
`·5· ·A· ·Might as well use that as an example.· The operations
`
`·6· · · ·person could say hmm, I need a switch at this location on
`
`·7· · · ·this circuit.· They would open up the catalog and they
`
`·8· · · ·would see what was approved and they would say, Okay, I
`
`·9· · · ·need a 15kV switch that operates on all three phases and
`
`10· · · ·has -- and is gang operated, meaning that all three
`
`11· · · ·phrases open and close as one, and has a 20-foot
`
`12· · · ·extension bar and gearbox on the bottom of it for the
`
`13· · · ·lineman to operate it.
`
`14· · · · · ·Then they would look at -- they would find it in the
`
`15· · · ·catalog; they would look at the number that was
`
`16· · · ·associated with it, which would be called then a material
`
`17· · · ·ID; and then they would put in a requisition for that
`
`18· · · ·particular switch.
`
`19· · · · · ·Then the requisition reaches purchasing; and the
`
`20· · · ·purchasing agent would look at it and say, Yes, I know
`
`21· · · ·this switch and this is a good material ID number, I'm
`
