`at 1100 Avenue of the Americas, New York, New York 10036, believes it will be damaged by

`the registration of the trademark MAAXTV in International Class 9 for “Apparatus for

`recording, transmission or reproduction of sound or images” in Application Serial No.

`79/128,186 (the “Application”), filed by CDN Sweden AB (“Applicant”), and hereby opposes
`
`the same.

`As grounds for this opposition, Opposer alleges:

`Opposer is a well-known operator of premium pay television channels which are

`delivered through television, the Internet and electronic communication networks, including
`
`wireless networks and mobile media services.

`2. Since long prior to the filing of Applicant’s Application Serial No. 79/128,186,

`Opposer has marketed, distributed and sold its premium and pay television services under the

`trademarks CINEMAX and MAX, and uses a variety of other MAX-formative marks in

`By virtue of the popularity of Opposer’s services offered or sold in connection

`with the MAX Marks, and its advertising and promotion of the MAX Marks, Opposer has built

`up and now owns an extremely valuable goodwill which is symbolized by its MAX Marks.

`Applicant’s use and/or proposed use of MAAXTV for “Apparatus for recording,
`
`transmission or reproduction of sound or images” in Class 9 (“Applicant’s Goods”) in the
`
`Application is without Opposer’s consent or permission.

`Opposer believes that Applicant’s use and/or proposed use of MAAXTV for

`Applicant’s Goods is likely to cause confusion, mistake, or deception in that consumers may be
`
`likely to believe Applicant’s Goods are Opposer’s goods or the goods of a person or company

`that is sponsored, authorized or licensed by, or in some other way legitimately connected with,

`Opposer.
