`incorporated herein by reference as Exhibit A. ("Opposer's Family of LAVERA Marks").

`3. Upon information and belief, Leivaira Inc. ("Applicant") is a Canadian corporation with an
`
`address at Suite 302, 3601 Hwy 7 East, HSBC Tower, Markham, Ontario, Canana L3ROM3 and seeks to
`
`register the mark LEIVAIRA for:
`
`Class 35:: Import and export agencies; Customs clearance services
`
`Class 41:Education services, namely, providing classes, seminars, and workshops on real estate,
`financial planning and investing
`
`pursuant to U.S. Application Serial No. 86493030 filed on December 31, 2014 under Section 1(a) of the
`
`U.S. Trademark Act ("Applicant's Mark" or "Applicant's Application"). Opposer does not oppose
`
`registration of Applicant's mark in Class 42 as set forth in Applicant's Application.

`Applicant's Mark LEIVAIRA is likely to cause confusion with Opposer's Family of
`
`LAVERA Marks when used for the services in Classes 35 and 41 as set forth in Applicant's Application,
`
`is likely to deceive purchasers and potential purchasers of Applicant's services and Opposer's goods
`
`and/or services into erroneously believing that there is some relationship between Opposer and Applicant,
`
`or that Opposer has authorized, sponsored, or licensed Applicant's use of the mark LEIVAIRA in
`
`violation of 15 U.S.C. § 1052(d).

`Opposer has used its Family of LAVERA Marks for over twenty five years throughout
`
`the world and in the U.S. since, at least, 1999. Opposer has established a well known reputation under its
`
`Family of LAVERA Marks in the same market in which and to the same customers to which Applicant
`
`does or will market and sell its Class 35 and 41 services. Thus, it is highly likely that confusion will
`
`occur between the two marks at issue.

`Registration of Applicant's Mark will damage Opposer since such registration will give
`
`color of exclusive statutory rights to Applicant in the mark LEIVAIRA in derogation and violation of the
`
`prior and superior federal rights of Opposer.

`WHEREFORE, Opposer Laverana GmbH & Co. KG believes that it will be damaged by the
`
`registration of U.S. Application Serial No. 86493030 for the mark LEIVAIRA in Classes 35 and 41 and,
`
`therefore, respectfully requests that the Trademark Trial and Appeal Board refuse registration of
`
`Applicant's Mark under 15 U.S.C. §1052(d).
