`Metropolitan Life Insurance Company (“MetLife”), as Respondent and Applicant in the
`
`proceedings identified in the caption above, hereby moves the Trademark Trial and Appeal Board
`
`(“the Board”) to consolidate these proceedings, and futher to suspend the proceedings in light of
`
`a pending civil action for trademark infringement filed by Opposer/Petitioner Selective Insurance
`
`Group, Inc. (“Selective”) in federal district court for the District of New Jersey on October 28,
`
`2015.
`

`Motion to Consolidate
`
`ARGUMENTS
`
`The opposition and cancellation proceedings brought by Selective involve common
`
`questions of law and essentially identical factual allegations. Specifically, Selective opposes
`
`registration of METLIFE AUTO & HOME XCELERATE in logo format and petitions to cancel
`
`MetLife’s registration for METLIFE AUTO & HOME XCELERATE in standard characters,
`
`each covering the same identification of services.
`

`In each proceeding, Selective pleads the same mark, Registration No. 3,177,139, as the basis of
`
`its likelihood of confusion and dilution claims.
`
`When, as here, cases involving common questions of law or fact are pending before the
`
`Board, the Board may order the consolidation of the cases. See TBMP § 511; Fed. R. Civ. P.
`
`42(a); Regatta Sport Ltd. v. Telux-Pioneer Inc., 20 USPQ2d 1154 (TTAB 1991). Consolidation
`
`of the proceedings in these two cases would be in the interest of justice as well as judicial
`
`economy because they involve essentially identical issues of fact and many common legal issues.
`
`In both proceedings, Selective asserts the same mark, Registration No. 3,177,139, against
`
`METLIFE AUTO & HOME XCELERATE in standard character and logo form on the grounds
`
`of likelihood of confusion and dilution. Consolidation of the pending opposition and
`
`cancellation proceedings will result in, among other benefits, greater efficiency for the parties in
`
`discovery, consistency in addressing the same or similar issues, and a more orderly trial of the
`
`issues to the Board. See Helene Curtis Indus. Inc. v. Suave Shoe Corp., 13USPQ2d 1618 (TTAB
`
`1989) (Consolidated cases can be presented on the same record and briefs) and Hilson Research
`
`Inc. v. Society for Human Res. Mgmt., 27 USPQ2d 1423 (TTAB 1993).

`Consolidation is clearly appropriate in this instance and MetLife therefore requests an
`
`appropriate order consolidating the proceedings. See Dating DNA LLC v. Imagini Holdings Ltd.,
`
`94 USPQ2d 1889, 1893 (TTAB 2010) (Consolidation ordered when each proceeding involved
`
`identical parties, similar marks, and related or identical issues).
`
`2. Motion to Suspend for Civil Action
`
`In addition to consolidation of the opposition and cancellation proceedings, MetLife
`
`moves the Board to stay the proceedings pending final disposition of Selective’s trademark
`
`infringement lawsuit. That lawsuit, which involves the same parties, the same marks and related
`
`or identical issues, was filed on October 28, 2015 in the District of New Jersey, Selective Ins.
`
`Group, Inc. v. Metro. Life Ins. Co., Civil Action No. 2:15-cv-07756-WJM-MF (“Civil Action”).1
`
`Pursuant to Section 2.117 of the Rules of Practice in Trademark Cases, Chapter 37 Code of
`
`Federal Regulations, MetLife respectfully requests the suspension of these proceedings, whether
`
`or not the Board grants MetLife’s motion to consolidate. Both the cancellation and the opposition
`
`proceedings are in their earliest stages, prior to initial disclosures and the opening of discovery.
`
`A responsive pleading in the cancellation proceeding is not due until January 11, 2016.
`
`Further, the remedies sought by Selective in the Civil Action include injunctive relief and
`
`damages, but also cancellation of the same MetLife registration Selective now challenges in the
`
`Board on the same legal grounds. The most efficient forum for deciding all of the issues between
`
`the parties is the District Court, thereby avoiding unnecessary, redundant proceedings in two
`
`different forums. See New Orleans Louisiana Saints v. Who Dat? Inc., 99 USPQ2d 1550, 1552
`
`(TTAB 2011) (Suspension ordered in light of civil action alleging infringement of applicant’s
`
`mark and injunctive relief, among other remedies).
`
`

`WHEREFORE, MetLife respectfully requests that these opposition and cancellation
`
`proceedings be consolidated, and that these proceedings be suspended until termination of the

`This is a civil action arising under the trademark laws of the United States, Title

`15, United States Code, Sections 1051 et seg., as amended (hereinafter the “Lanham Act”), 1114
`
`and 1125. This Court has subject matter jurisdiction pursuant to 15 U.S.C. Section 1121 and 28
`
`U.S.C. Sections 1331, 1333, and 136'}'(a) because this Complaint raises federal questions under

`Personal jurisdiction over Defendant is vested in the United States District Court
`
`for the District of New Jersey because, upon information and belief, Defendant does business in
`
`New Jersey and its acts within or directed toward New Jersey have caused Plaintiff injuries
`
`alleged herein. Defendant activeiy promotes its services in New Jersey, has advertised in New
`
`Jersey, and has an Internet site that is accessed from New Jersey. Defendant andfor Defendant’s
`
`agents sell products andfor services directly to New Jersey consumers.
`

`Venue is proper under 28 U.S.C. § 139l(b) because the claim arose in this district
`
`and under 28 U.S.C. § 1391(c).

`Plaintiff Selective Insurance Group, Inc. is a New Jersey corporation having a

`place of business at 40 Wantage Avenue, Branchvilie, NJ 07890.

`Plaintiff is an insurance holding company whereby its wholly-owned subsidiaries

`are in the business ofproviding consumer-focused property and casualty insurance.

`connection with an electronic platform that links an insurance agency’s agency management

`name confusingly similar to or including the Plaintiffs Marks, including: METLIFE AUTO &

`HOME XCELERATE and Design, U.S. Trademark Application Serial No. 86,412,064.

`The Defendant be required to account and pay to Plaintiff all profits derived as a
