`APPLE INC. (“Opposer”) hereby moves the Board for entry of notice of default against

`Applicant Apple Pie Repair LLC (“Applicant”) on Opposer’s claims in opposition to registration
`
`of Application Serial No. 86/403,651.
`

`
`The Board’s July 8, 2015 Notice set an August 17, 2015 deadline for Applicant to file
`
`and serve an Answer in this proceeding. Applicant has failed to file or serve its Answer.
`

`
`In accordance with Rule 55(a) of the Federal Rules of Civil Procedure, 37 CFR
`
`§ 2.106(a), and TBMP § 312, Opposer moves the Board for entry of notice of default against

`Applicant. It is appropriate for the Board to enter notice of default against Applicant because

`Applicant failed to file and serve its Answer before the August 17, 2015 deadline.
