`NOTICE OF OPPOSITION

`Novartis AG (“Opposer”), a corporation organized and existing according to the laws of
`
`Switzerland, located and doing business at CH-4002, Basel, Switzerland, believes that it will be
`
`damaged by the issuance of a registration for the mark NOVAERUS, applied for in Application
`
`Serial No. 86/271,259, and by the issuance of a registration for the mark NOVAERUS & Design,
`
`applied for in Application Serial No. 86/271,268, both for “Plasma field technology units
`
`comprising of an air sterilization apparatus used to eradicate airborne pathogens for medical
`
`purposes” in International Class 10 (together, the ‘‘Applications’’), and therefore opposes the
`
`same. As grounds for the opposition, Opposer, by its attorneys Fross Zelnick Lehrman & Zissu,
`
`P.C., alleges as follows:
`

`Opposer is the owner of the trademark and trade name NOVARTIS in connection
`
`with a wide Variety of pharmaceutical preparations for human and veterinary medicines.
`
`Opposer has used the mark NOVARTIS in commerce since at least as early as 1997, and the
`
`mark is now famous.
`
`2.
`
`Novartis is the owner of the following U.S. trademark registrations:
`
`0 NOVARTIS, Reg. No. 2,336,960, registered April 4, 2000, for pharmaceuticals in
`
`International Class 5.
`

`0 NOVARTIS, Reg. No. 2,997,235, registered September 20, 2005, for veterinary
`
`pharmaceuticals in International Class 5.
`

`These registrations are valid, subsisting and in full force and effect, and constitute
`
`evidence of the validity of the marks and of Opposer’s exclusive right to use them on the goods
`
`identified in the registrations. Both registrations have also become incontestable under
`
`Section 15 of the Trademark Act. Printouts from the United States Patent and Trademark
`
`Office’s online databases reflecting these registrations are attached as Exhibit A.
`

`
`On information and belief, Novaerus US, Inc (“Applicant”) is a corporation
`
`organized and existing according to the laws of Delaware, located and doing business at Suite
`
`250, 1408 Westshare Blvd., Tampa, Florida 33607.
`
`5.
`
`On May 5, 2014, Applicant filed the Applications based on first use in commerce
`
`on August 6, 2012.
`
`6.
`
`The Applications filing date, and any other date Applicant can rely on, is after
`
`Opposer’s first use date for its NOVARTIS mark.
`
`7.
`
`The Applications filing date, and any other date Applicant can rely on, is also
`
`long after Opposer’s NOVARTIS mark had become famous.
`
`8.
`
`The NOVAERUS and NOVAERUS & Design marks to be registered by
`
`Applicant are confusingly similar in sound, appearance, and commercial impression to
`
`Opposer’s registered, long-used and famous trademark NOVARTIS, in that, inter alia, the term
`
`NOVAERUS has the same first four letters and final letter of the NOVARTIS mark and the
`
`marks sound identical, save that Applicant has removed the letter 2‘.
`

`Moreover, the goods covered in the Applications are related to products and
`
`services offered by Opposer under its NOVARTIS mark, including without limitation
`

`Upon information and belief, Applicant applied to register the NOVAERUS and
`
`NOVAERUS & Design marks with full knowledge of Opposer’s rights to the NOVARTIS mark
`
`and with full knowledge of Opposer’s then-existing federal trademark registrations for the
`
`NOVARTIS mark.
`

`The registration of Applicant’s marks is inconsistent with Opposer’s prior rights
`
`in the NOVARTIS mark and is inconsistent with Opposer’s statutory grant of exclusivity of use
`
`of the registered NOVARTIS mark, and would destroy Opposer’s investment and goodwill in its
`
`NOVARTIS mark.
`

`The NOVAERUS and NOVAERUS & Design marks sought to be registered by
`
`Applicant are so similar to Opposer’s NOVARTIS mark as to be likely to cause confusion, or to
`
`cause mistake, or to deceive the purchasing public by creating the erroneous impression that
`
`App1icant’s goods are authorized, licensed or sponsored by Opposer, or in some other way
`
`connected with Opposer. As such, any use or registration of the marks NOVAERUS or
`
`NOVAERUS & Design by Applicant would violate Section 2(d) of the Lanham Act, 15 U.S.C.
`
`§ 1052(d).
`

`
`Because Opposer’s NOVARTIS mark is famous, Applicant’s use and registration
`
`of the highly similar marks NOVAERUS and NOVAERUS & Design will dilute the
`
`distinctiveness of Opposer’s mark by blurring or tarnishing it. Accordingly, Applicant’s use and
`
`registration of NOVAERUS and NOVAERUS & Design is in violation of Section 43 (c) of the
`
`Federal Trademark Act, 15 U.S.C. § l125(c).
`
`14.
`
`By reason of the foregoing, Opposer is likely to be harmed by registration of one
`
`or both of the Applications.
