`In the matter of trademark Application Serial No. 77/959,462 filed March 15, 2010, and
`
`published for opposition in the Official Gazette of September 16, 2014, ALM Media Properties, LLC
`
`("Opposer"), a Delaware limited liability company, having a business address of 120 Broadway, 5th
`
`Floor, New York, NY 10271, believes that it will be damaged if a registration issues for the services
`
`therein identified and hereby opposes the registration of said trademark. The grounds for opposition
`
`are set forth below.
`
`Background
`
`1.
`
`Applicant seeks to register "IP Insider" as a trademark for “on-line journals,
`
`namely, blogs featuring intellectual property coverage,” as evidenced by the publication of said
`
`mark in the Official Gazette of September 16, 2014.
`
`2.
`
`Opposer and its related companies, including ALM Media, LLC, comprise the
`
`nation's leading source of news and information for the legal industry. Opposer is a global leader
`
`in specialized business news and information. Trusted reporting delivered through innovative
`
`technology is the hallmark of Opposer’s award-winning media properties, which include
`
`Law.com, The American Lawyer, Corporate Counsel, The National Law Journal and The New
`
`

`
`York Law Journal. Headquartered in New York City with 16 offices worldwide, Opposer’s
`
`brands have been serving their markets since 1843.
`
`Opposer’s “IP Insider” Trademark
`
`3.
`
`Since at least as early as February 10, 2010, ALM has used the trademark “IP
`
`Insider” in connection with a print and online column featuring news, information and
`
`commentary concerning the legal field. The column appears within Opposer’s Corporate
`
`Counsel
`
`print
`
`publication
`
`and
`
`at
`
`the
`
`Corporate
`
`Counsel website
`
`at
`
`http://www.corpcounsel.com/ip-insider. ALM began promoting the trademark on at least as
`
`early as February 10, 2010, and began using the mark in commerce on at least as early as
`
`February 12, 2010.
`

`
`As a result of Opposer’s continuous use of its “IP Insider” mark since at least as
`
`early as February 10, 2010, and its continuous use of the mark in commerce since at least as
`
`early as February 12, 2010, for the goods and services described above, the mark has become
`
`well-known, has become associated exclusively with Opposer, and has become a very valuable
`
`asset of Opposer.
`

`Opposer’s "IP Insider" mark is inherently distinctive as used in connection with
`
`Opposer's goods and services or, alternatively, has acquired distinctiveness for Opposer’s goods
`
`and services.
`
`Applicant’s “IP Insider” Trademark
`
`6.
`
`Applicant bases his application to register "IP Insider" upon his alleged use of the
`
`mark in commerce since at least as early as January 29, 2010.
`

`On information and belief, Applicant’s alleged first date of use in commerce, as
`
`stated in the preceding paragraph, is false because he did not make a commercial use of the mark
`
`until March 12, 2010, or even later.
`

`
`On March 25, 2010, Opposer wrote to Applicant and challenged Applicant’s
`
`alleged first date of use because the “Welcome Message” on Applicant’s blog was dated
`
`February 12, 2010. In that letter, Opposer noted that Applicant filed his trademark application
`
`immediately following a conversation on March 15, 2010, with Opposer’s in-house counsel in
`
`which Opposer’s in-house counsel expressed concern regarding Applicant’s initial use of the
`
`mark. In the same letter, Opposer asked Applicant to provide information or documentation
`
`supporting the alleged first date of use of January 29, 2010. See Exhibit A.
`

`On April 9, 2010, Applicant responded to Opposer in writing and stated that he
`
`could establish his first date of use “through documents that have been electronically filed and
`
`stored,” but refused to provide the purported documents. Instead, he offered to assign the
`
`trademark and transfer the associated domain to Opposer in exchange for $25,000 and free
`
`advertising in Opposer’s magazines. Opposer rejected Applicant’s proposal. See Exhibit B.
`

`On approximately August 9, 2011, Applicant changed the name of his blog to “IP
`
`Closeup.” See Exhibit C.
`

`
`Applicant appears to make a continuing diminutive use of the mark “IP Insider” at his
`
`“IP Closeup” website, but he improperly uses the ® symbol with the mark – the mark is not
`
`registered in the U.S. Patent and Trademark Office – and it is not clear whether Applicant has
`
`continuously used the “IP Insider” mark at his website since he changed the name of his blog on
`
`August 9, 2011. See Exhibit D.

`Count I - Fraud
`

`The allegations contained in the preceding paragraphs are incorporated herein.
`
`Upon information and belief, and based upon the results of Opposer’s
`
`investigation and the correspondence between the parties, Applicant knowingly made false,
`
`material misrepresentations of fact in filing his application for the “IP Insider” trademark herein
`
`opposed. Specifically, Applicant knew or should have known that any activities of his preceding
`
`the launch of his blog on February 12, 2010 did not constitute use of the mark in commerce.
`

`Opposer has previously asked Applicant to provide information that would
`
`support a date of first preceding February 12, 2010, but Applicant has refused to provide such
`
`information.
`

`Based upon the aforementioned acts, Opposer committed fraud in filing the
`
`application herein opposed and stating a knowingly false date of first use and first use in
`
`commerce for the “IP Insider” mark.
`

`
`By virtue of the foregoing, if the aforementioned application is permitted to
`
`proceed to registration, with all the presumptions afforded to a registration issued on the
`
`Principal Register, it will be a source of potential harm to Opposer, who uses a similar trademark
`
`for similar goods and services.

`Count II – Likelihood Confusion under Section 2(d)
`

`The allegations contained in the preceding paragraphs are incorporated herein.
`
`On information and belief, Applicant did not begin using his “IP Insider” mark
`
`until February 12, 2010.
`

`As Opposer began using its “IP Insider” on February 10, 2010 and began using
`
`the trademark in commerce on February 12, 2010, Opposer is the prior user of the “IP Insider”
`
`trademark.
`

`The respective marks are similar in sight, sound and meaning.
`
`Opposer's goods and services and Applicant's services are related and
`
`complementary. They each include a blog and/or online column concerning legal matters and,
`
`more specifically, legal matters in the field of intellectual property.
`

`To the extent Applicant’s application is not restricted by trade channel,
`
`Applicant's services and Opposer's goods and services are likely to be offered to an overlapping
`
`class of purchasers through the same and similar channels of trade.
`

`
`Applicant's "IP Insider" trademark as used in connection with the services
`
`identified in its application so resembles Opposer's "IP Insider" mark as used in connection with
`
`the goods and services that it is likely to cause confusion, mistake or deception.
`
`24.
`
`If Applicant is permitted to register the mark "IP Insider" for the services
`
`identified in the application herein opposed, confusion of the trade and public is likely to result,
`
`such confusion resulting in damage and injury to Opposer.
`

`
`Purchasers, potential purchasers and the relevant public, upon seeing Applicant's
`
`"IP Insider" mark would be likely to believe in error that such services are provided in
`
`association or affiliation with or under the sponsorship of or license from Opposer.
`

`If Applicant is permitted to register its mark for the services set forth in the
`
`application herein opposed, persons familiar with the goods and services of Opposer would be
`
`likely to engage Applicant's services as services sponsored by or produced in affiliation with or
`
`under the sponsorship of Opposer. Furthermore, any defect, objection to or fault found with
`
`Applicant's services provided under its mark would necessarily reflect on and seriously injure the
`
`reputation that Opposer has established for its goods and services under the "IP Insider" mark.

`If Applicant is granted a registration for the mark herein opposed, it would obtain
`
`thereby at least a prima facie exclusive right to use the mark. Such registration would be a source of
`
`damage and injury to Opposer and Opposer's customers.

`WHEREFORE, Opposer prays that registration of the mark of Application Serial No.
`
`77/959,462 be refused and that this opposition be sustained.

`15. I would like to know what is the proof of your dates?

`of Responsible Licensing” to be held in
`NYC’s financial district on March 12.

`There are still some audiences that believe that NPE, or non-practicing entity, is just another
`term for patent “troll.” To them patent holders who wish to license their inventions but do not
`sell products are suspect. More suspicious are companies that refuse to recognize that there
`are vast differences in the quality of asserted patents and the business that own them.
`
`NPE 2015: The Business of Responsible licensing will examine those differences
`and ways to combat misconceptions among patent holders. The conference will attract both
`non-practicing and practicing patent holders of all sizes, as well as investors, law firms, and
`law makers. NPE 2015 , which will
`
`be held in NY’s financial district at the

`Businesses that engage in responsible

`them, and large parts of the patent market, in a negative light,” writes conference organizer
`Richard Lloyd.

`“But at the same time, many NPEs’ business models are proving successful. A growing band
`of public IP companies (PIPCOs) have attracted new investors to the sector. The licensing
`strategies of many NPEs have never been more sophisticated, with several emphasising a
`shift away from litigation. And the growing confidence in the sector can be seen in several
`businesses committing themselves to best practices and playing an active role as the
`licensing sector considers adopting industry-wide standards.”

`IP thought-leaders who will be present at the conference include John Lindren, CEO of
`Conversant, which has taken a leadership role promoting best practices for patent licensing,
`Hon. Randall R. Rader , former Chief Judge of the Court of Appeals for the Federal

`all but over,” said Gerald Holtzman, President of Personalized Media Communications, an

`Despite impediments like IPRs, software-adverse decisions like CLS Bank v. Alice, and
`aggressive anti-NPE lobbying, significant patent agreements are stilling being transacted. The
`key to their success, says Bramson, who is responsible for more than 1,000 patent licenses
`and sales over a 40 year career, is quality and need.
`
`“Licensing is about money,” says the patent attorney and strategist who was recorded in our
`offices in late December. “Surely, the sugar-plum visions of a few years ago need to be
`rethought, but that does not mean there aren’t good opportunities out there for those willing
`to conduct the necessary due diligence. Patent monetization is about risk and reward, and if
`after careful analysis the potential damages are still there, then you at least have the basis of
`discussion. The last thing a patent monetizer wants to do is win the battle but lose the war.
`
`“Rumor has it that the Rockstar deal got done because of pressures exerted by some of their
`investors, notably Apple and Microsoft . There is a complex network of relationships and
`needs that fuel agreements between big parties, and direct revenue is frequently only a part
`of it.”
`
`Patent Value in Perspective
`
`While it’s difficult to calculate the precise current value of Rockstar (the company) based on
`its December 23rd patent sale to RPX, it is safe to say that it is a quarter to a half of the
`$4.5B that it’s investors, Apple, Microsoft, Sony, Ericsson, EMC and

`Blackberry, paid in 2011. That said, $1B to $2B value on a single patent portfolio in the
`current anti-enforcement environment is nothing to sneeze at.
`

`These investors also had complex needs and unique resources, the most important of which
`appeared to be keeping the patents out of Google’s hands. In Apple and Microsoft’s case,
`they also had huge amounts of cash on their balance sheet to deploy.
`
`“I expect that there will be a clearing out of patent monetization businesses in the next couple
`of years,” continues Bramson, who founded and served as CEO of InterDigital Technology
`Corp. “But that’s not to say there aren’t still opportunities out there. Smartphones are one of
`many industries that rely on patents to compete. Sectors like medical technology and smart
`cars are heating up, and 3-D printing is likely to be huge.”
