`As grounds for the opposition, it is alleged that:

`Opposer, Ferring B.V. ("Opposer"), has acquired all right, title and interest in and

`to the tracleinark PENTASA, together with the goodwill ofthe business symbolized by said
`
`trademark, by virtue of the assignment of the trademark and registration from Farmaceutisk
`
`Laboratorium Ferring AIS to Ferring B.V.

`Opposer, through itself, its predecessor-in-interest and related companies, has for
`
`many years offered for sale and sold in commerce and is now offering for sale and selling in
`
`commerce, pharmaceutical products for the treatment of gastrointestinal disorders and diseases

`under the trademark PENTASA.

`PENTASA trademark, issued May 29, 1984, together with a print-out from the TESS and TARR

`databases showing the title and status of the PENTASA trademark registration, are attached

`Opposer has rights in the PENTASA trademark at least as early as May 29, 1984,

`the date of registration for the PENTASA mark.

`Opposer is the owner of U.S. Trademark Registration No. 4,007,879 for

`PENTASA for "Pharmaceutical preparations and substances for use in the field of
`
`gastroenterology".

`A true and correct copy of U.S. Trademark Registration No. 4,007,879 for the

`PENTASA trademark, issued August 9, 2011, together with a print-out from the TESS and

`TARR databases showing the title and status of the PENTASA trademark registration, are

`consistently high quality, Opposer's trademark PENTASA has earned valuable and extensive
`
`goodwill and l"avo1'abie reputation among the relevant trade and public as symbols which
`
`distinguish Opposer's goods as the source of quality pharmaceutical products.

`Applicant's trademark PENTRA is confusingly similar to Opposer’s trademarl<
`
`PENTASA and is likely. when used in conjunction with the Class 5 goods identified in
`
`Applicant's application, to cause confusion or to cause mistake or to cause deception.

`Applicant's Class 5 goods as set forth in its application are closely related to
`
`Opposer’s goods and would be offered through the same or similar channels of trade, and used
`
`by one or more of the same classes of purchasers and users, such that consumers will be
`
`con'l’usecl. mistaken or deceived into believing that Applicant's goods originate from, are
`
`authorized by or are in some way connected with Opposer.

`Opposer's prior rights in its PENTASA trademark, and would threaten to destroy Opposer's
