`NOTICE OF OPPOSITION

`Ranir, LLC, a limited liability company of the State of Delaware, having its
`
`principal place of business at 4701 East Paris Avenue SE, Grand Rapids, Michigan 4951?.
`
`(hereinafter referred to as "Ranir" or "Opposer") believes it will be damaged by the registration of
`
`the mark shown in the above-identified application on the Principal Register by Split Rock
`
`Scientific, Inc. (hereinafter referred to as "Split Rock" or “Applicant") and hereby opposes the
`
`same .
`

`As grounds for the opposition, Opposer, upon information and belief, alleges as follows:
`
`1.
`
`Opposer is, and for many years has been, engaged in the manufacture and sale of
`
`dental bite guards.
`
`2.
`
`Opposer is the owner of U.S. Trademark Registration No. 3,309,935 for the mark
`
`REST ASSURED for dental bite guards and Trademark Registration No. 4,227,552 for the mark
`
`REST ASSURED EXTRA COMFORT for dental bite guards, as well as Application No.
`
`85/460,020, filed on October 31, 2011, for the mark REST ASSURED READY TO WEAR for
`
`dental bite guards, all of which are in Class 10.
`

`In accordance with Trademark Rule of Practice 2.122(cl_)( 1), current printouts of
`
`information from the electronic database records of the United States Patent and Trademark Office
`
`showing the current status and title of each of Opposer’s registrations set forth in Paragraph 2 are
`
`attached hereto as Exhibits 1-3.
`

`Opposer’s dental bite guards are sold throughout the United Sates by various retail
`
`outlets for resale to consumers.
`

`Opposer has sold its dental bite guards since well prior to Applicant’s filing date of
`
`December 17, 2012.
`

`App1icant’s mark RestAssure employs the dominant term “Rest Assure” which is
`
`one letter short of the same word used in Opposer’s family of “REST ASSURED” trademarks.
`
`7.
`
`The Class 10 therapeutic mouthpieces for the prevention of snoring on which
`
`Applicant has applied for registration of RestAssure are virtually identical to Opposer’s REST
`
`ASSURED, REST ASSURED EXTRA COMFORT, and REST ASSURED READY TO
`
`WEAR brand goods and, on information and belief, will travel through the same channels of trade
`
`to the same consumers.

`As a result of such widespread use by Opposer of its REST ASSURED and REST
`
`ASSURED EXTRA COMFORT trademarks for dental bite guards since well prior to Applicant’s
`
`application for registration of RestAssure for Class 10 therapeutic mouthpieces for the prevention
`
`of snoring listed in application Serial No. 85/804,757, registration of the RestAssure application
`
`for therapeutic mouthpieces for the prevention of snoring in Class 10 would result in a likelihood of
`
`confiision as to the source of the goods of the respective parties.

`The registration of App1icant’s mark will cause damage to Opposer.
`
`WI-IEREFORE, Opposer prays that this Opposition be sustained and the registration of
`
`Applicant’s mark in Class 10 for therapeutic mouthpieces for the prevention of snoring be refused.
