`OPPOSER’S RESPONSE TO AI’PLICANT’S ATTORNEY’S MOTION TO WITHDRAW
`
`Opposer does not oppose this request but Opposer requests that the Board issue an Order
`
`pursuant to TBMP 513.01 to set a date for Applicant to appoint a new attorney. TBMP 513.01
`
`states:
`
`“If the request to withdraw is granted, the Board will suspend proceedings and allow the
`
`party a stated period of time (usually 30 days) in which to appoint a new attorney or other
`
`authorized representative (and inform the Board thereof), or to file a paper stating that it desires to
`
`represent itself. If the party fails to take such action, the Board may issue an order to show cause
`
`why default judgment should not be entered against the party based on the party's apparent loss of
`
`interest in the case.”
`
`Since the Applicant is a corporation, Applicant cannot appear pro se in this proceeding. It
`
`should be clear to the Board based on the pending motion that the Applicant is out of business and
`
`
`
`has no intention of defending this proceeding or to pursue the subject trademark application.
`
`In
`
`addition, this proceeding has been pending for over two years and Applicant has made minimal
`
`effort to participate. Instead, Applicant has switch attorneys three times,
`
`Based on the aforesaid, Opposer requests that the Board set a date for Applicant to
`
`appointment new counsel or be in default.
