`for cosmetic use in class 3, based on use since at least as early as 1898.
`The registration is incontestable and has been renewed.

`Reg. No. 1,889,576 — Red Cross Design, dated April 18, 1995, for first aid
`kits, adhesive bandages, topical preparations for medical and therapeutic
`use, medical adhesive tape, gauze, sterile cotton for medical purposes, and
`wound dressings in class—5, based on use since at least as early as 1898.
`A The registration is incontestable and has been renewed.

`Reg. No. 3,178,913 — JOHNSON & JOHNSON FIRST AID & Red Cross
`Design, dated December 5, 2006, for adhesive medical tapes, gauze pads,

`Opposer first used and registered each of its Red Cross Marks prior to Applicant’s
`
`application filing date of August 18, 2011.

`Based on information and belief, Applicant cannot establish use of the mark
`
`covered by Ser. No. 85/401,841 prior to Opposer’s first use of the Red Cross Marks.

`The goods on which Opposer uses its Red Cross Marks and the goods covered by

`Applicant’s application Ser. No. 85/401,841 the are identical.

`The goods on which Opposer uses its Red Cross Marks and the goods covered by

`Applicant’s application Ser. No. 85/401,841 are closely related.

`The goods on which Opposer uses its Red Cross Marks and the goods covered by

`Any registration which matures from application Ser. No. 85/401,841 would be

`read by competitors in the field as enabling Applicant to display the Cross Design depicted
`
`therein in any color, including red, in Violation of 18 U.S.C. § 706.

`The proposed use and registration by Applicant of a mark incorporating a cross
`
`design displayed in red for the goods identified in application Ser. No. 85/401,841 is likely to
`
`cause confusion, mistake or deception by having the public erroneously assume or believe that
`
`those goods emanate from Opposer, or are in some other way associated or connected with
`
`Opposer because of Opposer’s prior use and registration of the Red Cross Marks, all to Opposer's
`
`irreparable damage.
`
`For the reasons set forth herein, Opposer believes and believing asserts that it will be
`
`damaged by the registration of application Ser. No. 85/401,841. Accordingly, Opposer prays that
`
`this Opposition be sustained, and that Applicant be refused registration of the DERMAL LIFE
`
`ADVANCED SKIN CARE SOLUTIONS & Cross Design mark sought to be registered in
`
`application Ser. No. 85/401,841.
`
