`1030 Brussels, Belgium, and owner of the registered mark ASSISTME [Registration No. 3910105],
`having filed its AMENDED NOTICE OF OPPOSITION on May 30, 2012, pursuant to Section 13 of
`the Trademark Act of 1946 (15 U.S.C. § 1063), against the registration of the applied—for mark,
`ASSISTMELIVE [Serial No. 85414764], by Applicant, ASSISTMELIVE, INC, a California corporation,

`IV. CONCLUSION
`
`For reasons set forth above, Opposer belief in its own understanding of what constituted a "reply brief”,
`under FRCP 502.02(b), Opposer’s decision to forego submission of a BRIEF IN RESPONSE TO APPLlCANT’S
`MOTION TO STRIKE MATTERS FROM NOTICE OF OPPOSITION meets the standard set forth under
`Somero v. Hendry General Hospital, 467 So.2d 1103, 1106 (Fla. 4th DCA 1985) as ”reasonable
`misunderstanding” of the cited FRCP; as Opposer underscores the United States Court of Customs and
`Patent Appeals reversal of the Knickerbocker Toy Co. v. Faultless Starch C0,, 175 USPQ, 417, 423
`(CCPA 1972); and, therefore, contends that, as its AMENDED NOTTICE OF OPPOSITION should and must
`include the OPPOSER’S ADDED CLAIMS, under Section IV of Opposer’s AMMENDED NOTICE of
`OPPOSITION, by which OPPOSER affirms it will be damaged by the registration of Serial No. 85414764
`ASSISTMELIVE in Class 42, as such registration would constitute not only Trademark Infringement,
`pursuant to Section 13 of the Trademark Act of 1946 (15 U.S.C. § 1063) and therefore cause subsequent
`damage to Opposer’s registered trademark for reasons cited in Opposer’s AMENDED NOTTICE OF
`OPPOSITION, but registration would also violate Opposer’s COPYRIGHT PROTECTION of the mark
`ASSISTME [VAA000176484], see EXI-IIBiT 2, while infringing also upon OPPOSER’S FIRST AMENDMENT
`RIGHT of PRIVACY, pursuant to Opposer’s use of protected COMMERCIAL SPEECH [see, Friedman v.
`Rogers, 99 S. Ct. 887 (1979), Virginia State Bd. of Pharmacy v. Virginia Citizens Consumer Council, Inc.,
`425 U.S. 748, 761-62 (1976)], from which Opposer’s copyrighted design serves as Opposer’s private trade
`name, ASSISTME. While not asserted in Opposer’s AMENDED NOTTICE OF OPPOSITION, Opposer
`nevertheless asserts that registration of the Applicant's applied—for mark ASSISTMELIVE would invariably
`produce a direct contravention of the Anticybersquatting Consumer Protection Act [The Protection Act
`(ACPA), 15 U.S.C. § 1125(d)]; as the Applicant's registration of the domain [assistmelive.com] continues
`to dilute Opposer’s ”hub & spoke” Online marketing channels which are all centralized around Opposer’s
`main Online marketing channel [assistme.com].

`Accordingly, Opposer prays that The Board will sustain Opposer’s MOTION OF EXCUSABLE
`NEGLECT, for the reasons stated above, so that The Board may entertain Opposer’s subsequent
