`
`II. GROUNDS FOR MOTION OF EXCUSABLE NEGLECT
`
`A.
`
`Opposer moves The Board to sustain Opposer’s MOTION OF EXCUSABLE NEGLECT IN
`RESPESONSE TO OPPOSER’S NON-RESPONSE TO APPLICANT’S MOTION TO STRIKE
`MATTERS FROM NOTICE OF OPPOSITION on the basis that
`
`1) Opposer’s
`to what Opposer
`reasonable misunderstanding as
`(now presumed)
`heretofore understood to mean a "reply brief”. (Somero v. Hendry General Hospital),
`
`Somero v. Hendry General Hospital, 467 So.2d 1103, 1106 (Fla. 4th DCA 1985) "[W]here
`inaction results from clerical or secretarial error, reasonable misunderstanding, a system gone
`awry or any other of the foibles to which human nature is heir, then upon timely application
`accompanied by a reasonable and credible explanation the matter should be permitted to be
`heard on the merits.”; as ”repIy brief”, as cited in,
`
`Federal Rules of Civil Procedure 502.02(b): Briefs and Motions
`
`As Opposer’s reading of the paragraph identified below,
`
`in paragraph (c), which
`
`Opposer understood to pertain to any reply brief, which Opposer understood to
`
`include a MOTION TO STRIKE, ”is discouraged, as the Board generally finds that reply
`briefs‘ have little persuasive value and are often a mere reargument of the points made
`in the main brief”
`
`a)
`
`A reply brief, if filed, including a reply brief for a summaryjudgment motion, shall
`
`be filed within 15 days from the date of service of the brief in response to the
`
`motion (20 days if 37 CFR § 2.119(c) applies). The time for filing a reply brief will
`
`not be extended, even upon the parties’ consent. [Note 9.: 37 CFR § 2.127(a) and
`
`37 CFR § 2.127(e)(1). See Ron Cauldwell Jewelry, Inc. v. Clothestime Clothes, Inc.,
`
`63 USPQ2d 2009, 2010 (TTAB 2002) (approval of consented motion to extend
`
`time to file reply brief vacated).]
`
`b)
`
`No further papers (including surreply briefs) will be considered by the Board.
`
`[Note 10.: 37 CFR § 2.127(a) and 37 CFR § 2.127(e)(1); Pioneer Kabushiki Kaisha v.
`
`Hitachi High Technologies, 73 USPQ2d 1672, 1677 (TTAB 2005) (because 37 CFR §
`
`2.127(a) prohibits the filing of surreply briefs, Opposer’s surreply to applicant's
`
`motion was not considered); No Fear Inc. v. Rule, 54 USPQ2d 1551, 1553 (TTAB
`
`2000).]
`
`c)
`
`The filing of reply briefs is discouraged, as the Board generally finds that reply
`
`briefs have little persuasive value and are often a mere reargument of the
`
`points made in the main brief. [Note 11.: No Fear Inc. v. Rule, 54 USPQ2d 1551,
`
`1553 (TTAB 2000); and Johnston Pump/General Valve Inc. v. Chromalloy
`
`American Corp., 13 USPQ2d 1719, 1720 n.3 (TTAB 1989) (”The presentation of
`
`one's arguments and authority should be presented thoroughly in the motion or
`
`the opposition brief thereto”).]

`You are not required to file a response to a motion to strike. However, it is
`common practice to respond and rebut the defendant's motion. Rule
`502.02(b) requires that "A brief in response to a motion, except a motion
`for summary judgment, must be filed within 15 days from the date of
`service of the motion (20 days if service of the motion was made by first
`class mail, ‘Express Mail,‘ or overnight courier). [Note 5.]"
`
`The form of a responsive brief is the same as that which would be used in
`federal district court. Although, this is a response for an FTC motion to
`strike, the same format can be used for a trademark hearing (click here).
`
`Hope this helps.

`
`III. CONCLUSION
`
`For reasons set forth above, Opposer belief in its own understanding of what constituted a
`"reply brief”, under FRCP 502.02(b), Opposer’s decision to forego submission of a BRIEF IN
`RESPONSE TO APPL|CANT’S MOTION TO STRIKE MATTERS FROM NOTICE OF OPPOSITION
`
`meets the standard set forth under Somero v. Hendry General Hospital, 467 So.2d 1103, 1106
`(Fla. 4th DCA 1985) as "reasonable misunderstanding” of the cited FRCP; as Opposer currently
`contends that, as its AMENDED NOTTICE OF OPPOSITION should and must
`include the
`
`OPPOSER’S ADDED CLAIMS, under Section IV, by which OPPOSER affirms it will be damaged by
`the registration of Serial No. 85414764 ASSISTMELIVE in Class 42, as such registration would
`constitute not only Trademark Infringement, pursuant to Section 13 of the Trademark Act of
`1946 (15 U.S.C. § 1063), but also VIOLATION of Opposer’s COPYRIGHT PROTECTION of the mark
`ASSISTME [VAAOO0176484], see EX'§~¥iBlT 2, VIOLATION of OPPOSER’S FIRST AMENDMENT
`
`RIGHT of PRIVACY, as the Opposer’s use of COMMERCIAL SPEECH [see, Friedman v. Rogers, 99 S.
`Ct. 887 (1979), Virginia State Bd. of Pharmacy v. Virginia Citizens Consumer Council, Inc., 425 U.S.
`
`748, 761-62 (1976)], Opposer’s copyrighted design serves as Opposer’s private trade name,
`ASSISTME, but also as registration of the Applicant's app|ied—for mark ASSISTMELIVE would
`
`invariably produce a direct contravention of the Anticybersquatting Consumer Protection Act
`[The Protection Act (ACPA), 15 U.S.C. § 1125(d)], as the Applicant's registration of the domain
`[assistme|ive.com] continues to dilute Opposer’s ”hub & spoke" Online marketing channels
`centralized around Opposer’s main Online marketing channel [assistme.com].
