`APPLICANT’S MOTION TO EXTEND SUSPENSION OF PROCEEDINGS AND
`EXTEND TIME TO RESPOND TO OPPOSER’S MOTION TO STRIKE
`
`Pursuant to 37 CFR § 2.117, Applicant hereby moves to extend suspension of these
`
`proceedings pending termination of a civil action that would have a bearing on the Board case
`
`and an extension of time to respond to Opposer’s motion to strike.
`
`I.
`
`
`
`Introduction:
`
`Discovery in this case opened July 6, 2012. Initial disclosures are due August 5, 2012.
`
`The case is currently suspended, pending disposition of Opposer’s motion to strike Applicant’s
`
`affirmative defense.
`
`
`
`Opposer served its initial disclosures on July 6, 2012. On that same day, Opposer filed,
`
`in the U.S. District Court for the Central District of California, a civil action against Applicant
`
`for, among other things, trademark infringement, false designation of origin and unfair
`
`competition, Civil Case No. SACV12-01106 CJC (JPRx) (the “Civil Action”). A copy of this
`
`complaint is attached hereto as Exhibit A.
`

`II.
`
`Continued Suspension is Warranted Because the Civil Action has a Bearing on the Board
`
`Proceeding.
`
`
`
`Under 37 CFR § 2.117, whenever it shall come to the attention of the Board that the
`
`parties are engaged in a civil matter which may have a bearing on the case, proceedings before
`
`the Board may be suspended until termination of the civil action. Where the civil action in a
`
`federal district court involves issues common with those in a proceeding before the Board,
`
`suspension is warranted because the decision of the federal district court may be binding upon
`
`the Board, while the decision of the Board is not binding upon the court. See, e.g., New Orleans
`
`Louisiana Saints LLC v. Who Dat? Inc., 99 USPQ2d 1550, 1552 (TTAB 2011).
`

`
`The relief sought in the Civil Action includes the relief sought in the Board proceeding,
`
`namely, denial of Applicant’s application Ser. No. 85/250,946. See, Exhibit A ¶¶ 25-27.
`
`
`
`Moreover, the material facts alleged in the Civil Action are the same as in the instant
`
`Board proceeding. See generally, Exhibit A. For example, as the basis for the Civil Action,
`
`Opposer alleges ownership of the trademark PEDEGO and registrations containing the same,
`
`namely, Registration Nos. 3,770,790 and 4,122,995. Id. at ¶¶ 8-9. In both the Civil Action and
`
`the Board proceeding, Opposer alleges that Applicant’s use of the mark PRODECO
`
`TECHNOLOGIES has caused actual confusion, and attached emails allegedly sent to Opposer
`
`that were intended to be sent to Applicant. Id. at ¶ 12. Opposer alleges that Applicant adopted
`
`the mark PRODECO TECHNOLOGIES in a willful attempt to trade on Opposer’s goodwill. Id.
`
`at ¶ 13.
`
`Finally, the Board proceeding is in its early stages (discovery opened only eleven (11)
`
`days before the filing of this motion). Because the parties have just begun discovery, it would
`
`not be unfair or inequitable or to suspend the proceedings.
`

`Conclusion:
`
`
`
`Because the Civil Action present the courts with issues that may have a bearing on the
`
`Board’s decision in the instant opposition proceedings, suspension is warranted pending final
`
`disposition of the civil action.

`Plaintiff PEDEGO is a Delaware Limited Liability Company with a place of
`
`business in Irvine, California.
`

`On information and belief. defendant PRODECO is or purports to be a Florida
`
`Corporation having a principle place of business at 2590 North Powerline Road, Pompano
`
`Beach, FL 33069.
`
`JURISDICTION AND VENUE
`
`4.
`
`This Court has subject matterjurisdiction over this lawsuit under 28 U.S.C. §
`
`1338 because the action arises under the trademark laws of the United States, and pendant
`
`jurisdiction ofany and all state causes ofaction under 28 U.S.C. § I367.
`
`5.
`
`This Court has personal jurisdiction over defendant because has transacted
`
`business in the Central District of California. Further, on information and belief. the defendant
`
`systematically and continuously directs business activities toward and into the Central District
`
`of California by inter alia selling products carrying the infringing trademark through the
`
`resident dealer Pedal or Not, lnc., I515 7th Street, Santa Monica, CA 9040].
`
`In addition, actual
`
`consumer confusion caused by defendant has occurred within the Central District of California.
`

`Venue is proper and reasonable in this district under 28 U.S.C. § l39l(b)(l) and
`
`28 U.S.C. § l39l(b)(2) because defendant resides in the district and a substantial part of the acts
`
`or omissions giving rise to this claim for false designation oforigin and unfair competition
`
`occurred in this district and defendant has significant contacts with the district.

`FACTS
`

`PEDEGO, including predecessors in interest. is a company that has designed,
`
`manufactured. marketed and sold electric bikes as early as 2007.
`
`8.
`
`PEDEGO is the owner of the trademark and designation PEDEGO. PEDEGO
`
`has used the PEDEGO trademark and designation throughout the United States in interstate
`
`commerce in conjunction with electric bikes since at least as early as March I I, 2009. As such,
`
`PEDEGO has established priority of use. The PEDEGO trademark and related design are
`
`inherently distinctive and recognized by the relevant consuming public as plaintiffs marks.
`

`PEDEGO is the owner of U.S. Trademark Registration Nos. 3,770,790 and
`
`4,1 12,995 for PEDEGO(+Design) and PEDEGO respectively. True and correct copies of said
`
`registrations are attached hereto as Exhibit A.
`

`
`PEDEGO has the used the PEDEGO mark in a variety of media including print
`
`and Internet advertisements. An exemplary use of the plaintiffs PEDEGO trademark is shown
`
`in Exhibit B attached hereto.
`

`
`Defendant is also in the business of producing and selling electric bikes.
`
`Defendant has adopted the confusingly similar trademark PRODECO. An exemplary use of the
`
`defendants PRODECO trademark is shown in Exhibit C attached hereto.
`
`I2.
`
`On information and belief. defendanfs unlawful use of the PRODECO
`
`trademark has caused actual confusion amongst consumers and initial interest confusion as to
`
`the origin of their respective products and services. Attached hereto as Exhibit D are emails
`
`unintentionally sent to plaintiff that were intended to be sent to defendant.
`
`13.
`
`On information and belief, defendant has adopted the designation PRODECO in
`
`a willful attempt to piggyback off ofplaintiffs goodwill and reputation in the electric bikes
`
`industry. and to divert business away from plaintiff and to defendant.
`
`I4.
`
`Plaintiffinvests substantial sums in producing its goods and in marketing its
`
`PEDEGO trademark. Plaintiff has established substantial goodwill and brand recognition with
`
`the consuming public.
`
`I5.
`
`Moreover, on information and belief, defendant’s services are inferior to
`
`plaintiff‘ s services resulting in consumer confusion as to the quality as well as source of
`
`plaintiffs services
`
`16.
`
`Plaintiff has been irreparably harmed and has suffered economic loss as well as
`
`the loss of good will from defendant’s unlawful and willful acts. Because damages will
`
`constitute an insufficient remedy. plaintiffrequires equitable relief in the form ofa permanent
`
`injunction restraining defendants continued activity.

`violated Section 43 ofthe Lanham Act (15 U.S.C. § I l25(a)) by using, in connection with their

`goods and advertisement, false designations of origin which are likely to cause confusion or

`cause mistake or to deceive as to the affiliation, connection, or association of plaintiff with

`defendant and as to the origin, sponsorship, or approval of defendant’s service and commercial
`
`activities.

`California common law. all to the damage of plaintiff as previously alleged.

`PRAYER FOR RELIEF

`WHEREFORE, plaintiff asks that this Court grantjudgment against defendant for the

`Defendant, its officers, agents, servants. employees. and attorneys. and all

`persons in active concert or participation with any of them, be temporarily restrained,
`
`and preliminarily and permanently enjoined from:

`penalty of perjury setting forth in detail the manner and form in which defendant has
