`The identification of goods in classes 3, 5, 8, 21, 25, 29,

`30, 31, 32 and 41 remains unchanged.

`Upon consideration of the proposed amendment to the
`
`identification of the goods and services in International
`
`
`

`Classes 16, 35 and 36, the Board finds that the amendment is
`
`clearly limiting in nature as required by Trademark Rule
`
`2.71(b), and because opposer consents thereto, it is approved
`
`and entered. See Trademark Rule 2.133(a).
`
`With regard to the goods and services in International
`
`Classes 9 and 38, applicant seeks to delete International
`
`Classes 9 and 38 in its entirety. In an opposition to an
`
`application having multiple classes, if the applicant files a
`
`request to amend the application to delete an opposed class,
`
`the request for amendment is, in effect, an abandonment of
`
`the application with respect to that class, and is governed
`
`by Trademark Rule 2.135. In view thereof, and because
`
`opposer consents thereto, application Serial No. 77044437
`
`stands abandoned with respect to International Classes 9
`
`and 38.
`
`The contingency in opposer's withdrawal having now been
`
`met, the opposition is dismissed without prejudice.
`
