`by registration ofthe mark shown in pending Application Serial No. 79/071,926, and hereby

`As grounds for this Opposition, it is alleged:

`1. Opposer is a leading manufacturer and supplier of a full

`line of dermatological

`preparations and pharmaceutical preparations, among other goods.

`2. Opposer is the owner of
`
`the following five U.S. trademark registrations:

`(i) Registration No. 2,003,997 for the mark TARO (in typed form) for "house
`
`mark for dermatological preparations; pharmaceutical preparations, namely
`
`analgesics, nasal decongestants, antibiotics, antifungal preparations, nasal
`
`spray preparations, medical
`
`lubricating
`
`jelly, medicated skin care preparations,

`steroid preparations, steroid-antibiotic preparations, topical corticosteroid

`preparations, anticonvulsant preparations" in Class 5. This registration is valid
`
`and subsisting, and is incontestable.

`(ii) Registration No. 2,459,912 for the mark i. (lined for the color
`
`red) for "house mark for pharmaceutical preparations; pharmaceutical
`
`preparations, namely, topical antifungal preparations and medicated skin care
`
`preparations" in Class. 5. This registration is valid and subsisting, and is
`
`incontestable.

`(iii) Registration No. 3,017,240 for the mark TARD (the colors red
`
`and black claimed) for "full
`
`line of pharmaceutical products intended for the
`
`treatment of dermatological, cardiovascular, neurological, hematological,
`
`gynecological, allergic and infectious disease conditions" in Class 5. This
`
`registration is valid and subsisting.

`(iv) Registration No. 3;060,625 for the mark TAROPHARMA (in typed
`
`form) for "dermatological products, namely, pharmaceuticals for the treatment
`
`of dyschromia, hyperpigmentation, ectoparasites, skin conditions such as

`psoriasis, dermatitis and inflammation, itching and blood vessel constriction"

`in Class 5. This registration is valid and subsisting.

`(v) Registration No. 3,446,559 for the maJ TamP ha rma I
`
`(the colors black, red, and white claimed) for "pharmaceuticals, namely,
`
`medicinal creams for skin care and dermatological preparations" in Class 5 and
`
`"providing on-line information in the field of
`
`pharmaceuticals" in Class 44.
`
`This registration is valid and subsisting.
`
`Pursuant to Trademark Rule 2.122(d), TARR printouts of
`
`information for these five
`
`registrations, dated today and showing the current status and title of the registrations, are
`
`attached at Exhibit A. The marks in these five registrations are collectively referred to herein
`
`as "Opposer's Marks."
`
`3. Aroma Forest France ("Applicant") owns opposed Application Serial No.
`
`79/071,926 ("Applicant's Application") for the mark SARO for, in pertinent part, the
`
`following goods:
`
`Pharmaceutical preparations, namely, anticoagulants, antidepressants; sanitary
`
`preparations for medical purposes; dietetic substances adapted for medical use,
`
`namely, dietetic foods, dietetic sugar; medicinal tea; therapeutic medicated
`
`preparations for the bath; bath salts for medical purposes; biological preparations for

`vitamin preparations, in Class 5 ("Applicant's Class 5 Goods").

`4. The earliest date upon which Applicant may rely for priority is its filing date of
`
`March 19, 2009.
`
`5. Since long prior to March 19, 2009, Opposer has used Opposer's Marks,
`
`thereby establishing valuable common law rights in Opposer's Marks.
`
`6. By virtue of both its registrations and prior common law use, Opposer has
`
`priority in Opposer's Marks.
`
`7. Applicant's applied-for trademark SARO, when used in connection with
`
`Applicant's Class 5 Goods, so closely resembles Opposer's Marks that there is a likelihood of
`
`confusion, mistake, and deception.
`
`8. If Applicant's Application is permitted to register, Opposer wil therefore be
`
`damaged.
`
`WHEREFORE, Opposer respectfully requests that this Opposition be sustained and
`
`that Application Serial No. 79/071,926 be refused registration in Class 5.
