`proceeding, and notifies Opposer, Balance Bar Company, of Applicant’s reliance upon the
`
`attached printouts of websites showing evidence of third-party use of products containing the
`
`term BALANCE in the title. These printouts are relevant to the lack of a likelihood of consumer
`
`confusion because they show that the field of marks employing the term BALANCE and
`
`variations thereof is crowded, such that the common element shared by each member of the
`
`crowd is relatively weak and not a particularly distinctive element. True and correct printouts of
`
`the following websites are attached hereto as Exhibits 41-70: Each printout identifies on its face
`
`the date on which the document was accessed and printed, as well as the applicable URL
