`KENTUCKY DISTILLERS’ ASSOCIATION’S MOTION
`TO SUSPEND FOR CIVIL ACTION
`
`Pursuant to 37 C.F.R. §2.117(a) AND TBMP 510.02(a), Opposer/Counter-
`
`Defendant/Applicant, Kentucky Distillers’ Association (“KDA”) by and through its
`
`undersigned counsel respectfully requests the Trademark Trial and Appeal Board
`
`(“TTAB”) to suspend the opposition and cancellation proceedings, Consolidated
`
`Proceedings under Parent Opposition 91193207, Opposition Proceeding Nos. 91194466,
`
`91194467, 91194468 and 91194469 and Counterclaims for Cancellation in this matter,
`
`wherein the parties are engaged in a civil action that will have a bearing on the issues
`
`before the TTAB. The KDA also requests the TTAB suspend the opposition and
`
`cancellation proceedings as listed above until the final termination of the civil action,
`
`which includes any resolution of any appeal.
`
`The suspension of the opposition and cancellation proceedings pending resolution
`
`of the civil action is appropriate under 37 C.F.R. §2.117(a) which provides:
`
`[w]henever it shall come to the attention of the Trademark
`Trial and Appeal Board that a party or parties to a pending
`case are engaged in a civil action or another Board
`proceeding which may have bearing on
`the case,
`proceedings before the Board may be suspended until
`termination of
`the civil action or
`the other Board
`proceedings.
`
`Pursuant to this provision, “[o]rdinarily, the Board will suspend proceedings in
`
`the case before it if the final determination of the other proceeding will have a bearing on
`
`the issues before the Board.” TBMP 510.02(a).
`

`In further support of its Motion, the KDA states as follows:
`
`1.
`
`The KDA owns numerous federal trademark registrations in the mark
`
`“KENTUCKY BOURBON TRAIL®” including “KENTUCKY BOURBON TRAIL®”
`
`with design, U.S. Trademark Registration No. 2,584,119, “KENTUCKY BOURBON
`
`TRAIL®”, U.S. Trademark Registration No. 3,556,684, “KENTUCKY BOURBON
`
`TRAIL®” with design, U.S. Trademark Registration No. 3,556,715 and “KENTUCKY
`
`BOURBON TRAIL®”, U.S. Trademark Registration No. 3,710,981 (collectively with
`
`U.S. Trademark Application Serial No. 77/649,426 referred as to “BOURBON TRAIL
`
`Marks”).
`

`The KDA is also the owner of U.S. Trademark Application Serial No.
`
`77/649,426 filed on January 14, 2009 under Trademark Act Section 1(b), 15 U.S.C. §
`
`1051(b) for the mark “KENTUCKY BOURBON TRAIL” (collectively with U. S.
`
`Trademark Registration No. 2,584,119, U.S. Trademark Registration No. 3,556,684, U.S.
`
`Trademark Registration No. 3,556,715, and U.S. Trademark Registration No. 3,710,981
`
`referred to as “BOURBON TRAIL Marks”).
`

`On December 30, 2009, the KDA filed Notices of Opposition against
`
`Sazerac’s applications to register the mark “BUFFALO TRACE DISTILLERY ON THE
`
`BOURBON TRAIL” with design including “BUFFALO TRACE DISTILLERY ON
`
`THE BOURBON TRAIL” with design, U. S. Trademark Application Serial No.
`
`77/801,630, “BUFFALO TRACE DISTILLERY ON THE BOURBON TRAIL” with
`
`design, U.S. Trademark Application Serial No. 77/801,708, “BUFFALO TRACE
`
`DISTILLERY ON THE BOURBON TRAIL” with design, U. S. Trademark Application
`
`Serial No. 77/801,615, and “BUFFALO TRACE DISTILLERY ON THE BOURBON
`
`
`

`
`TRAIL” with design, U. S. Trademark Application Serial No. 77/801,608. The KDA
`
`asserts in its Notices of Opposition that the registration of the marks “BUFFALO
`
`TRACE DISTILLERY ON THE BOURBON TRAIL” with design as identified above
`
`should be refused based on various grounds including, likelihood of confusion between
`
`the marks “BUFFALO TRACE DISTILLERY ON THE BOURBON TRAIL” and the
`
`KDA’s “BOURBON TRAIL Marks” and dilution of the KDA’s “BOURBON TRAIL
`
`Marks”. See Opposition Proceedings Nos. 91193207, 91193209, 91193210 and
`
`91193212.

`On February 4, 2010, Sazerac filed its Answers to the KDA’s Notices of
`
`Opposition against Sazerac’s applications to register the mark “BUFFALO TRACE
`
`DISTILLERY ON THE BOURBON TRAIL” with design and with its Answers filed
`
`Counterclaims for Cancellation seeking to cancel the KDA’s federal registered
`
`trademarks in the mark “KENTUCKY BOURBON TRAIL®” on various grounds
`
`including, alleged genericness of the KDA’s KENTUCKY BOURBON TRAIL® marks,
`
`alleged descriptiveness of the KDA’s KENTUCKY BOURBON TRAIL® marks, and
`
`alleged fraud on the United States Patent and Trademark Office. The KDA denies any
`
`and all allegations as set forth in Sazerac’s Answers and Counterclaims for Cancellation.

`On February 4, 2010, Sazerac filed a Notice of Opposition against the
`
`KDA’s application to register the mark “KENTUCKY BOURBON TRIAL” with design,
`
`U.S. Trademark Application Serial No. 77/649,426 seeking refusal of the KDA’s
`
`application for registration on various grounds including, alleged genericness of the
`
`KDA’s mark, “KENTUCKY BOURBON TRIAL” with design and alleged
`
`
`

`descriptiveness of the KDA’s mark, “KENTUCKY BOURBON TRIAL” with design
`
`The KDA denies any and all allegations as set forth in Sazerac’s Notice of Opposition.
`

`On April 8, 2010 the KDA filed Notices of Opposition against Sazerac’s
`
`applications to register the mark “TM SINCE 1879 TOM MOORE DISTILLERY ON
`
`THE BOURBON TRAIL” with design including “TM SINCE 1879 TOM MOORE
`
`DISTILLERY ON THE BOURBON TRAIL” with design, U.S. Trademark Application
`
`Serial No. 77/846,763, “TM SINCE 1879 TOM MOORE DISTILLERY ON THE
`
`BOURBON TRAIL” with design, U.S. Trademark Application Serial No. 77/846,755,
`
`“TM SINCE 1879 TOM MOORE DISTILLERY ON THE BOURBON TRAIL” with
`
`design, U.S. Trademark Application Serial No. 77/846,688, and “TM SINCE 1879 TOM
`
`MOORE DISTILLERY ON THE BOURBON TRAIL” with design, U.S. Trademark
`
`Application Serial No. 77/846,674. See Opposition Proceeding Nos. 91194466,
`
`91194467, 91194468 and 91194469. The KDA asserts in its Notices of Opposition that
`
`the registration of the marks “TM SINCE 1879 TOM MOORE DISTILLERY ON THE
`
`BOURBON TRAIL” with design as identified above should be refused based on various
`
`grounds including, falsely suggesting a connection with the KDA and the KDA’s
`
`KENTUCKY BOURBON TRAIL®, likelihood of confusion between the marks “TM
`
`SINCE 1879 TOM MOORE DISTILLERY ON THE BOURBON TRAIL” and the
`
`KDA’s “BOURBON TRAIL Marks” and dilution of the KDA’s “BOURBON TRAIL
`
`Marks”. See id.
`

`On April 8, 2010, the parties filed a Stipulated Motion to Consolidate
`
`Opposition Proceedings Nos. 91193207, 91193209, 91193210, 91193212 and 91193680
`
`based on the Proceedings involve parallel parties, similar marks and common issues of
`
`
`

`
`law and fact. The Board granted the parties Motion on April 14, 2010. See Order of
`
`Consolidation attached hereto as Exhibit A. Discovery has yet to commence in the
`
`pending consolidated TTAB proceedings.

`On April, 27, 2010, the parties filed a Stipulated Motion to Consolidate all
`
`of the pending TTAB proceedings, including Consolidated Proceedings under Parent
`
`Opposition 91193207, Opposition Proceeding Nos. 91194466, 91194467, 91194468 and
`
`91194469 and Counterclaims for Cancellation proceedings wherein the parties state in
`
`support of its Motion for Consolidation that the proceedings as listed above involve
`
`parallel parties, similar marks and common issues of law and fact. See Filed Stipulated
`
`Motion to Consolidate All Proceedings, Exhibit B. This Stipulated Motion is still
`
`pending before the Trademark Trial and Appeal Board. Discovery has yet to commence
`
`in the pending consolidated TTAB proceedings under Parent Opposition 91193207 and
`
`Opposition Proceeding Nos. 91194466, 91194467, 91194468 and 91194469. In light of
`
`the filed Stipulated Motion, it is undisputed between the parties that the pending TTAB
`
`proceedings which include the Consolidated Proceedings under Parent Opposition
`
`91193207, Opposition Proceeding Nos. 91194466, 91194467, 91194468 and 91194469
`
`involve common issues of law and fact.
`

`On April 30, 2010,
`
`the KDA
`
`filed a civil action against
`
`Applicant/Counterclaimant/Opposer, Sazerac Company, Inc. (“Sazerac”) which is
`
`currently pending in the United States District Court for the Western District of Kentucky
`
`and styled Kentucky Distillers’ Association v. Sazerac Company, Inc., et al., Civil Action
`
`No. 3:10-cv-00307-JGH (the “Kentucky Lawsuit”). See Exhibit C.

`The civil action filed by the KDA seeks a declaration that the KDA’s
`
`trademarks, KENTUCKY BOURBON TRAIL® are valid and enforceable and to enjoin
`
`Sazerac, a former member of the KDA and the KDA’s KENTUCKY BOURBON
`
`TRAIL® from continuing to infringe upon the KDA’s trademark rights, from diluting the
`
`KDA’s trademarks and seeks any other damages and remedies which may be available to
`
`the KDA.
`

`In light of the above, it is clear that the Kentucky Lawsuit involves similar
`
`and related issues of fact and law as those issues before the TTAB regarding the pending
`
`opposition and cancellation proceedings, Consolidated Proceedings under Parent
`
`Opposition 91193207, Opposition Proceeding Nos. 91194466, 91194467, 91194468 and
`
`91194469 and Counterclaims for Cancellation. Therefore, the TTAB proceedings should
`
`be suspended because the issues of the Kentucky Lawsuit “overlap with” and have a
`
`“bearing on” the resolution of the issues before the TTAB. Whopper-Burger, Inc. v.
`
`Burger King Corp., 171 U.S.P.Q. 805, 807 (T.T.A.B. 1971)(granting a suspension of the
`
`TTAB proceedings where the court’s determination of the issues will “have a direct
`
`bearing on the question of the rights of the parties…and may in fact completely resolve
`
`all the issues”); General Motors Corp. v. Cadillac Club Fashions Inc., 22 U.S.P.Q. 2d
`
`1933, 1937 (T.T.A.B. 1992)(granting a suspension of the TTAB proceedings where
`
`“decision of the district court” will be dispositive of the issues before the Board”);
`
`Trademark Rule 2.117(a). In fact, the decision of the district court in the Kentucky
`
`Lawsuit will be dispositive of the issues before the TTAB in the pending proceedings;
`
`therefore, a suspension of the TTAB proceedings is appropriate in this matter. See
`
`General Motors Corp., 22 U.S.P.Q. 2d at 1937. However, even if the decision of the
`
`
`

`district court in the Kentucky Lawsuit was not entirely dispositive of the issues before the
`
`TTAB in the pending proceedings, suspension of the TTAB proceedings would be
`
`appropriate because as stated above, the decision of the district court in Kentucky has a
`
`“bearing on” the rights of the parties in the TTAB proceedings. See Martin Beverage
`
`Co., Inc. v. Colita Beverage Company, 169 USPQ 568, 570 (TTAB 1971)(holding that
`
`suspension of Board case is appropriate even if the civil action before the district court is
`
`not be dispositive of the Board case where the decision of the district court will have a
`
`bearing on the rights of the parties in the Board Case). In light of the above, the KDA’s
`
`request for a suspension of the pending TTAB proceedings which include Consolidated
`
`Proceedings under Parent Opposition 91193207, Opposition Proceeding Nos. 91194466,
`
`91194467, 91194468 and 91194469 should be granted.
`

`Finally, a suspension of the pending TTAB proceedings will save the
`
`KDA, Sazerac and the TTAB resources, time, effort and expense. Presently, the parties
`
`are litigating the same issues in two separate forums with the possibility of inconsistent
`
`decisions; therefore, a suspension of the TTAB proceedings would minimize the
`
`unnecessary use of time and resources by both parties and the TTAB where the outcome
`
`of the district court in Kentucky is binding on any decision rendered by the TTAB. See
`
`The Toro Company v. Hardigg Industries, Inc., 187 U.S.P.Q. 689, 692 (T.T.A.B.
`
`1975)(granting a suspension of the TTAB proceedings in light of a civil action and
`
`recognizing “the decision of the Federal District Court would be binding upon the Patent
`
`and Trademark Office, a decision by the Board would not be binding or res judicata as to
`
`the issues before the court.”). The KDA states further that the suspension of the TTAB
`
`proceedings will not prejudice or inconvenience either party. Therefore, in the interests of
`
`
`

`judicial economy and to avoid unnecessary duplicate effort, the KDA’s request for the
`
`TTAB to suspend the Consolidated Proceedings under Parent Opposition 91193207,
`
`Opposition Proceeding Nos. 91194466, 91194467, 91194468 and 91194469 and
`
`Counterclaims for Cancellation should be granted.
`
`
`
`WHEREFORE, in light of the above, the KDA respectfully requests an Order of
`
`this Board to suspend the pending opposition and cancellation proceedings, Consolidated
`
`Proceedings under Parent Opposition 91193207, Opposition Proceeding Nos. 91194466,
`
`91194467, 91194468 and 91194469 and Counterclaims for Cancellation pursuant to 37
`
`C.F.R. § 2.117 and TBMP 510.02(a) pending the outcome and termination of the civil
`
`action now pending before the United States District Court for the Western District of
`
`Kentucky.

`Nature of Action

` The Kentucky Distillers’ Association (“KDA”) is an association formed
`
`in 1887 in the Commonwealth of Kentucky to promote the state’s bourbon and distilled
`
`spirits industry. At least as early as 1999, the KDA created and adopted the mark
`
`KENTUCKY BOURBON TRAIL® to be used in connection with its tourist attraction
`
`which features Kentucky bourbon distilleries who are members of the KDA. As part of
`
`the KENTUCKY BOURBON TRAIL® promotion, visitors to the featured distilleries
`
`can learn about the art, science and history behind the Kentucky’s signature Bourbon
`
`industry, and promotion of the same.
`

`The KDA has filed this action seeking a declaration that the KDA’s
