`Applicant Bell hereby moves the Trademark Trial and Appeal Board pursuant to 37

`C.F.R. §2.1l7(a) and (c), for an order suspending the above-captioned proceeding on the grounds
`
`that a civil action is pending, the final determination of which action is likely to have a bearing
`
`on the case before the Board in this opposition proceeding.
`
`In support of this motion, applicant submits the following:
`

`The Opposer is engaged in a pending civil action no. 08-5635 as plaintiff
`
`against Nordic Group of Companies, Ltd., Flambeau, Inc., and Duncan Toys Company filed on
`
`December 3, 2008, pursuant to 15 U.S.C. 1114 and 1121 of the Lanham Act in the United States
`
`District Court for the Eastern District of Pennsylvania (“Civil Action”). A copy of the complaint
`
`filed by Opposer in that action is attached as Exhibit A.
`
`2.
`
`In the Civil Action, Opposer alleges that use of the Applicant’s mark on
`

`
`

`
`Applicant’s goods by Applicant’s licensee is likely to cause confusion, which is the same
`
`allegation Opposer makes in the notice of opposition in this proceeding.
`

`
`The issue is joined in the Civil Action as to whether use of the mark which
`
`is the subject of the opposition proceeding violates any trademark rights of Opposer.
`
`4.
`
`The determination of such Civil Action is accordingly likely to bear on the
`
`outcome of this subsequently filed opposition.
`
`5.
`
`The consent of Opposer to this motion was sought on March 23, but
`
`consent has not been given.

`Plaintiff Noasha .l.,,I..,C.‘ (“Plaintiff" or “Noasha“) brings this action against
`
`Defendants Nordic Group of Companies, Ltd., Flambeau, Inc., and Duncan Toys Company for
`
`trademark infringement, unfair competition, and deceptive and unfair trade practices. Beginning
`
`in February 2008, Plaintiff marketed and offered for sale its collectibie line: of laser-etched
`
`marbles under its registered trademark, Warbles® (the "Warbles® Mark“). Subsequent to
`
`February 2008, Defendants have offered for sale and advertised a collectible line of marbles with
`
`figures cast inside them under at least the following names "Warball.” "Warballs.” and “Warball.
`

`The Game." In a failed opposition to Plaintiffs Warbies® Mark before the United States
`
`Trademark Trial and Appeal Board, Defendant Nordic Group of Companies, Ltd. admitted that
`
`there was a likelihood of confusion between the Warb]es® Mark and the Warball name.
`
`Consequently, Defendants‘ actions constitute infringement ofthe Warbles® Mark, as well as
`
`unfair conipetition and deceptive and unfair trade practices.

`Defendant Flambeau, inc. (“Flambeau“) is a Wisconsin corporation with its
`
`principal place of business at 801 Lynne Avenue, Baraboo, WI 53913. Upon information and
`
`belief, Defendant Flambeau is a whol1y~owned subsidiary of Defendant Nordic Group.
`

`Defendant Duncan Toys Company ("Duncan") is, upon information and belief.
`
`either a division or wholly/«owned subsidiary of Defendant Flambeau, with its principal place of
`
`business at 15981 Valplast Road Middlefield, OH 44062. Duncan is a major manufacturer of
`
`children‘s toys in the United States.
`
`JURISDICTION AND VENUE
`

`This Court has subject matter jurisdiction over Noasha‘s claims pursuant to 15
`
`U.S.C. §l121 and 28 U,S.C‘.§§ I331, l338(a), l338(b) and 1367.
`

`Defendants have transacted business and committed tortious acts within the State
`
`of Pennsylvania by setting or facilitating the distribution and sale of products likely to cause
`
`confusion. or to cause mistake. or to deceive. with respect to Plaintiff‘ s Warbles® Mark.
`
`8.
`
`Venue is proper in this District pursuant to 28 U.S.C.
`
`l39l(b)(l) and (b)(2)
`
`because a substantial part of the events giving rise to Plaintiff‘s claim occurred here and because
`
`Defendants are subject to personal jurisdiction in this District.
`
`FACTUAL ALLEGATIONS
`
`A.
`
`THE WARBLES® MARK
`
`9.
`
`On November 1}, 2007, Noasha filed a trademark application, assigned serial
`
`number 77326677. for its collectible warrior marbles product. “Warbles®" (the “Warbles®
`
`Application“).
`
`10.
`
`On April 22, 2008, the Warbles® Application was published for opposition.
`
`I I.
`
`On April 25, 2008, Trish Bell filed a Notice of Opposition (“Bell Opposition“)
`
`with the United States Trademark Trial. and Appeal Board (“TTAB”), seeking to prevent the
`
`issuance of the Warbles® Application.
`
`12.
`
`The domestic representative for Ms. Bell. who resides in Canada, was listed as
`
`Dana Roberts, General Counsel of Defendant Nordic Group.
`
`13.
`
`Upon infonnation and belief, one or more of the Defendants have licensed a
`
`collectible marble game from Trish Bell.
`
`14.
`
`The Bell Opposition included a complaint, which alleged, among other things,
`
`that the Warbles® Mark was likely to cause confusion with Ms. Bell“s trademark application,
`
`numbered 77/421,508, for the name "Warball”’.

`Ms. Bell‘s trademark application for the name "Warball". numbered 77/421,508
`
`(the “Bell Trademark Applicatioif‘), was filed on March 13, 2008, long after Noasha filed the
`
`Warbles® Application.
`

`
`According to the Bell Opposition, Ms. Bell intended to associate the “‘Warball’"
`
`name with a game involving marbles.
`
`17.
`
`On June 3, 2008, Noasha filed a motion to dismiss the Bell Opposition.
`
`18.
`
`Neither Ms. Bell, nor Defendant Nordic Group on her behalf, responded to
`
`Noashzfs motion to dismiss.
`
`19.
`
`On or about July 1 l, 2008, the TTAB dismissed the Bell Opposition with
`
`prejudice due to the failure to respond to Noasha‘s motion to dismiss.
`
`20.
`
`The Bell Trademark Application has been SUS}3C11d€2d by the USPTO.
`
`21.
`
`On November 25, 2003. the United States Patent and Trademark Office
`
`("USPTO") registered the Warbles® Mark on the Principal Trademark Register and assigned it
`
`Registration Number 3538303.
`
`B.
`
`DEFENDANTS’ INFRINGEMENT OF THE WARBLES® MARK
`
`22.
`
`Noasha has developed a line of‘ collectible marbles with laser-etched figures
`
`inside of them. which are marketed and sold under the name “‘Warbles®"‘ using the Warblcs-®
`
`Mark.
`
`23.
`
`Noasha first offered Warbles® for sale at the 2008 Toy Fair ("Toy Fair“) trade
`
`show, which was held in New York City fiom February 17 through 21, 2008. The Toy Fair is
`
`the largest toy industry trade show in the United States.
`
`24.
`
`At the Toy Fair, representatives of Noasha were approached by representatives of
`
`Defendant Duncan who examined the Warbles® product.

`
`On February I9, 2008. during the Toy Fair, Defendant Flambeau filed a
`
`trademark application with the USPTO, numbered 77400633. for the name "Warha1l.“
`
`26.
`
`Since the Toy Fair, Noasha has made significant sales of its Warblesfl’) product
`
`bearing the Warbles® Mark.
`
`27.
`
`Defendants have developed a collectible marble game under the name “Warhol!”
`
`("Warball Game") and have offered the game for sale on at least one occasion at an industry
`
`trade Show that took place subsequent to the Toy Fair.
`
`28.
`
`Defendants have also developed a website marketing the Warball Game. The
`
`website is located at htt.p:f/www.warballs.com.
`
`29.
`
`Defendant Nordic Group sought to enforce a trademark for the Warball Game, on
`
`behalf of Ms. Bell, through the Bell Trademark Application and the Bell Opposition.
`
`30.
`
`On June 23, 2008., Defendant Flambeau abandoned its trademark application,
`
`numbered 77400633, for the "Warball" name.
`

`
`Despite the facts that: (1) the Bell Tradeinark Application (which was filed after
`
`the application for the WarblesC3) Mark) has been suspended; (2) the Bell Opposition has been
`
`dismissed with prejudice; and (3) Defendant Flarnbeau has abandoned its trademark application
`
`for the "Warball" name, Defendants continue to offer the Warball Game for sale and to advertise
`
`it using the name "Warball."
`
`32.
`
`Defendants” continued use and offer for sale of the Warball Game using the name
`
`‘“Warbal1“ constitute a willful and deliberate infringement of the Warbles® Mark, as well as
`
`unfair competition and unfair and deceptive trade practices, for at least the following reasons: (1)
`
`Defendants admitted in the Bell Opposition that there was a likelihood of confusion, mistake or
`
`deception between the Warbles® Mark and the Defendants‘ now~dead application for the name

`The foregoing willful and deliberate acts of Defendants are likely to cause
`
`confusion. mistake or deception as to the origin. sponsorship or approval of Defendants‘
`
`advertising and goods with Noasha and its Wat-bles® Mark and therefore constitute unfair and
`
`deceptive acts and practices in violation of 73 Pa. Cons. Stat. §20l—3.
`
`PRAYER FOR RELIEF
`
`VVHEREFORIL Noasha respectfully prays that the Court enter judgment in its favor on
`
`each and every claim for relief set forth above and award them relief including, but not limited
`
`to, the following:

`
`violations alleged herein;

`Awarding Noasha monetary relief,

`including damages sustained by Noasha,

`Defendants‘ profits, the costs of this action. treble damages and/or statutory damages pursuant to
