`Overlap Between Cosmetics and Skin Care Products and Cosmetic Medical Services

`On March 2 and 3, 2010, I conducted a Google Search for companies that provide
`
`both cosmetic medical services as well as cosmetics and/or skin care products.
`
`I printed out what is

`attached as Opposer’s Exhibit PX 28. Each printout identifies the date each website was accessed
`
`and printed and the source (i.e., the URL). The search shows that:
`
`a) At Brite Smile Brite Skin Med Spas, which are located throughout the United States,
`
`patients can receive cosmetic dentistry and teeth whitening services, cosmetic
`

`medical services such as Botox and Restylane injections, cosmetic services such as
`
`facials and also purchase skin care products from the PRIORI skin care product line.

`At the Essence Medispa in Highland, New York, consumers can receive European
`
`facials, eye treatments, and massages, as well as have their teeth whitened and
`
`receive Botox injections.
`
`At the Rezvive Salon & Spa in San Diego, California, consumers can purchase
`
`cosmetics from prestige skin care and makeup brand BARE ESCENTUALS and
`
`also have a dentist perform cosmetic teeth whitening.
`
`At the Platinum Skin Care & Medi Spa in Chesterfield, Michigan, customers can get
`

`Botox injections and get their teeth whitened using the Brite White system, as well
`
`as receive facials and purchase skin care products from the Platinum skin care line.
`
`At the Spa at Monmouth Beach in Monmouth Beach, New Jersey, consumers can
`
`receive facials and skin care services, have make-up applications, and have their
`
`teeth whitened.

`At the New Image Med Spa in Columbus, Georgia, customers can both purchase
`
`JANE IREDALE cosmetics, and receive Beyond WhiteSpa laser teeth whitening.

`Through its Red Door Spas, prestige skin care and makeup brand Elizabeth Arden
`
`both sells ELIZABETH ARDEN branded cosmetics and provides “Medi Spa
`
`procedures” such as Botox, Restylane, and Juvederm injections.

`In its Northern California locations, Kaiser Permanente offers both cosmetic medical
`
`procedures such as Botox injections, Endermologie Cellulite Treatment, Collagen
`
`and Juvederm injections, and laser hair removal, and skin care services such as

`facials and make-up consultations and also offers for sale skin care and cosmetic
`
`products.

`Chrysalis Cosmetics, a cosmetic surgeon’s office in Sacramento, California, offers
`
`invasive and non-invasive cosmetic medical services such as Botox injections, breast

`augmentation, liposuction, and Restylane injections, offers skin care consultations
`
`and facials, and also sells five different lines of skin care products, including JANE
`
`IREDALE, OBAGI, and PEVONIA BOTANICA.

`At the Nova Cosmetic Center and Medical Spa in Orlando, Florida, customers can
`
`get cosmetic medical procedures such as Botox and Juverderm injections, facial
`
`chemical peels, and laser hair removal, purchase skin care products from the SKIN
`
`MEDICA line, and purchase cosmetics from the GLO MINERAL line
`

`At Maxwell Aesthetics Cosmetic Surgery & Medi Spa in Tucson, Arizona,

`customers can both receive Botox and Restylane injections, and purchase skin care
`
`products from the OBAGI skin care line and cosmetics from the TRUE MINERAL

`At the Skin Deep Medical Spa locations in Glenview, Illinois and Highland Park,

`Illinois, customers can both receive Botox injections, and purchase skin care

`products from several different skin care lines, including ELASTICA, JAN

`MARINI, SKINCEUTICALS, and SKIN MEDICA.

`m) At the Vitality Anti-Aging Center and Medical Spa in Hickory, North Carolina,

`consumers can both receive Botox injections and laser hair removal, and purchase

`skin care products from the Obagi skin care line and makeup from the BLINC and

`JANE IREDALE cosmetics lines.

`injections and purchase skin care products from the SKINTX line and makeup from

`the TRUE line.

`Further, on March 3, 2010, I entered the phrase CLINIQUE DENTIQUE in the

`Google search finder. The Google search triggered sponsored links for Clinique, as well as
`
`Sephora, Macy’s, Neiman Marcus, and Boscov’s, all of which sell Clinique products. In the regular
`
`search results, there were references to Applicant. A copy of the search results are attached as
`
`Opposer’s Exhibit PX 29.

`Teeth whitening is the most commonly requested cosmetic dentistry procedure. Teeth whitening falls into the cosmetic
`procedures category because it is designed to enhance your appearance by reducing tooth discoloration and staining to
`elicit a brighter, whiter smile.

`The Teeth Whitening Procedure: In-Office vs. At-Home
`
`Teeth whitening can be performed either in-office or at home by you. While in-office whitening is considered to be much
`quicker and more effective, many appreciate at-home whitening for its ease of use and low cost. How exactly do the two
`options differ?

`In-Office Whitening
`
`The advantage of having your teeth whitened in our office is that this approach is safe, fast, and most effective. Typically,
`your teeth can be whitened 2-6 shades with one office session, dramatically improving your appearance in the shortest
`possible time. Shade charts are used during the consultation stage of treatment to customize the perfect shade of white for
`your teeth. in-office whitening is unique in this respect, as we have more control over achieving

`your specific teeth whitening goals.

`The application of the whitening gel occurs in 1-3 sessions over the course of the visit. A
`special lamp is used to activate the whitening gel and speed up the whitening process. Once
`the gel is activated, it remains on the teeth for 20 minutes until the next application. While you
`are treated you can watch your own DVD or one of ours.

`
`Microdermabrasion is a cosmetic procedure in which the stratum corneum (dead
`outermost surface of the skin) is partially or completely removed by light abrasion.
`Different methods include mechanical abrasion from jets of zinc oxide or aluminum
`oxide crystals, fine organic particles, or a roughened surface. After trying many
`different systems, we chose the Be|laDerma system for our microdermabrasion
`clients. Be|laDerma is considered by physicians to be one of the most effective and
`safest microdermabrasion machines available. Microdermabrasion is a gentle and
`minimally invasive procedure not to be confused with Dermabrasion, which is an
`invasive procedure done to take off a deeper layer of tissue.
`
`Microdermabrasion is used to rejuvenate skin, treat acne, remove sun-damaged
`skin and scars, reduce uneven skin tone and remove dark spots (age spots.) The
`procedure is comfortable and requires no anesthesia. Microdermabrasion can be used medically for scar removal whn the
`scar is raised above the surrounding skin, but is less effective with sunken scars.

`Microdermabrasion can be very effective in the treatment of acne, with regular
`treatments providing the greatest improvement. Microdermabrasion should not
`be used on patients who have taken the medication Accutane (lsotretinion) in the
`
`
`previous twelve months.
`
`There are microdermabrasion machines that use diamond or other tipped wands
`and do not use crystals. For multiple reasons we chose a system that uses
`abrasive crystals. Dr. Weinman believes that the crystal-free machines produce
`microscopic tearing of the skin rather than the even abrasion that is produced by
`crystals. This abrasion is felt to be less traumatic for the dermis. It is also felt that
`there are multiple contamination issues with non-crystal microdermabrasion that
`are not seen with the crystal machines.
`
`At Essence Medispa, we utilize physician-grade skin products in conjunction with the BellaDerma session to provide our
`clients with the finest microdermabrasion procedure in the Hudson Valley. These products are only available through a
`physician’s office.

`1. How long does whitening take?
`
`The whitening gel is on your teeth for three 8-10 minute cycles, totaling about 30 minutes. This is in
`addition to the time it takes to prepare and protect your gums and soft tissues making the total
`procedure time about one hour.

`2. Should I do anything to prepare for the appointment?
`
`No. there is no preparation on your part needed.
`
`3. I've heard that teeth whitening hurts, will this cause my teeth to be sensitive?
`
`Although every person is unique, our teeth whitening system causes less sensitivity than the other
`leading teeth whitening systems because of two important factors.

`- Our whitening gel is only on ;your teeth for three 8-10 minute cycles, while the other leading
`systems leave the bleach on your teeth for three to four 20 minute cycles. Half of the contact
`time with your teeth means less sensitivity.
`
`° Our light is a cool LED light vihich does not have the potential for sunburn. This is not true for
`many of the other leading systems.
`If, however, you do experience any sensitivity post
`treatment, you may take iduprofen or Tylenol. You can also call our dentist with any
`questions.

`4.‘Haw long will the teeth whitening treatment last?
`
`Vlfith proper at home maintenance, your white smile should last for years. Home maintenance
`
`includes proper brushing with an ultrasonic toothbrush, flossing, whitening toothpaste and mouth
`rinse, touch up kits, and of course, regular visits to your general dentist.

`5. Can I have my teeth whitened if I am pregnant?
`
`Sorry, we cannot whiten your teeth lif you are pregnant or nursing.

`6. What should l avoid after my tteatment?

`Your teeth are very prone to relistaining in the first 48 hours post treatment. Therefore, we
`recommend that you avoid the folloi/ving products for two days after your teeth have been whitened:
