`NOTICE OF OPPOSITION

`Nabob Rx (“Opposer”), is a partnership existing under the laws of California
`
`presently located at 1098 Foster City Blvd., Ste. 106-707, Foster City, California 94404-
`
`2302. Opposer became the owner of the Mark TheraF1ex on January 7, 2003. Opposer,
`moreover, believes that it will be damaged by registration ofthe mark shown in US
`
`Trademark Application Ser. No. 76047937 and hereby opposes the same, including all
`

`the goods and services in Class 5 as set forth in the Application. As grounds for
`
`opposition, Opposer alleges:
`
`1.
`
`Opposer is the owner of a US trademark registration for the term
`
`THERAFLEX for inter alia, pharmaceutical, veterinary and sanitary preparations and
`
`dietetic substances adopted for medical use.
`
`2.
`
`Opposer’s registration is: THERAFLEX, Reg. No. 76047937, registered
`
`January 7, 2003.
`
`3.
`
`The THERAFLEX Mark has been used by Opposer since at least 1994
`
`and there have been extensive sales under the THERAFLEX trademark throughout the
`
`United States.
`
`4.
`
`By virtue of such use by Opposer, valuable good will has been established
`
`in its THERAFLEX Mark and the public has come to associate the THERAFLEX Mark
`
`with Opposer and to know the THERAFLEX Mark as an indication of products and
`
`services that emanate from Opposer.
`
`5.
`
`As a result of such use, Opposer’s THERAFLEX Mark is famous,
`
`distinctive and well known to purchasers.
`
`6.
`
`On October 10, 2005, Applicant filed a registration on an intent-to-use
`
`basis §l(B). Applicant latter amended its basis for registration to §l(A) to register the
`
`mark THERAFLEX for dietary and nutritional supplements related to arthritis and other
`
`musculoskeletal disorders in International Class 5.
`

`The mark THERAFLEX sought to be registered by Applicant is strikingly
`
`similar in sound, appearance, meaning and commercial impression if not identical to
`
`

`
`Opposer’s long-used THERAFLEX Mark. See Attachment 1, Applicant’s ad for its
`
`arthritis pain relief supplements.
`

`
`The goods covered in the Applicant’s application are closely related to
`
`Opposer’s THERAFLEX products now in use (see Attachment 2, Applicant’s intemet
`
`campaign that integrates a paid placement in a blog to searches to Applicant’s paid links,
`
`many of which use the precise names of Opposer’s products).
`

`
`The goods covered in the Applicant’s application are likely to be sold
`
`through wholesale and retail channels of trade and directly to the public via telephone,
`
`direct mail or the world wide web sales or to the suppliers of such goods, which are
`
`closely related to Opposer’s channels of trade for THERAFLEX products now in use.
`
`For example, Applicant recently changed the address of its website from
`
`http://www.drlinchitz.com to http://www.theraflexforpain.com (see Attachment 3)
`

`
`The mark THERAFLEX sought to be registered by Applicant is so similar
`
`to Opposer’s THERAFLEX Mark for its topical analgesic creams for musculoskeletal
`
`issues as to be likely to cause confusion, or to cause mistake, or to deceive the purchasing
`
`public by creating the erroneous impression that Applicant’s goods are authorized,
`
`licensed, or sponsored by Opposer, or in some other way connected with Opposer, all to
`
`Opposer’s great injury and harm. See Attachment 4, consumer correspondence
`
`underscoring the aforementioned and the undermining of Opposer’s good will and
`
`causing Opposer undo hardship.
`

`Registration of the mark in Applicant’s application and use of Applicant’s
`
`mark are likely to dilute Opposer’s established THERAFLEX Mark.
`

`If the Application is permitted to register, such registration would
`presumptively entitle Applicant to prima facie exclusive ownership and rights to the mark
`
`THERAFLEX and would, therefore, cause confusion among consumers of the relevant
`
`services as to the separate and distinct sources of Applicant’s goods and Opposer’s goods
`
`and services and the relationship of Opposer to Applicant, thereby damaging Opposer’s
`
`goodwill in its THERAFLEX Marks, diluting the value thereof and causing Opposer’s
`
`business and reputation irreparable harm, all to the detriment of Opposer who as
`
`expended considerable sums and efforts in promoting its THERAFLEX Marks. See
`
`Attachment 5, Opposer’s clinical study of the product underpinning its THERAFLEX
`
`Mark and published in the prestigious peer review journal: Cranio: The Journal of
`
`Craniomanidular Practice.
`
`13. WHEREFORE, Opposer prays that this Opposition be sustained and that
`
`registration of US Trademark Application Serial Number 78730037 for THERAFLEX be
`
