`NOTICE OF OPPOSITION

`The St. John Companies, Inc. (hereinafter referred to, alternatively, as the

`“Opposer” or “St. John”), a corporation organized under the laws of California, and with
`
`a business address of 25 167 Anza Dr., Valencia, California, 91355, believes that it would
`
`be damaged by grant to Applicant of a registration for “EASYID” based on the
`
`Application, and therefore opposes same.

`The grounds for opposition are:
`

`Applicant seeks registration of the mark EasyID for use on “blank paper
`
`labels, laser printing paper” in International Class 016 and for use on “non-metallic
`
`identification wristbands for use in hospital patient admissions; blank plastic labels” in
`
`International Class 020. Opposer hereby submits that, in relation to the goods in the
`
`Application and the goods on which the mark is actually used by Applicant, the mark is
`

`rendered merely descriptive or generic. The mark does not function as a source of-origin
`
`because the mark is descriptive in the ordinary sense of the word; namely the mark
`
`EasyID merely refers to easy identification by the use of labels and wristbands.

`The mark is used by Applicant only on products that can be designed to be
`
`compatible with EasyID software (for which Appliance already has a registration) and _
`
`thus, the use of the mark on these additional products is generic in the sense that it
`
`signifies that these products can be used with EasyID software, rather than identifying the
`
`source of the products themselves.

`In addition, on information and belief, the mark is used by numerous third
`
`parties. The generic or merely descriptive nature of “EasyID” is thus further evidenced
`by the use ofthe term “EasyID” to describe a myriad ofother goods and services ranging
`
`from identification card makers

`(http://www.irby.com/IrbyCircuit/Vol2Nol/easyid.htm). True and correct copies of these
`
`websites are attached hereto as Exhibit A.

`Disputes as to the mark purportedly represented in the Application are the
`
`subject of two cases: PHG Technologies, LLC v. The St. John Companies, Inc., Case
`
`LA/40363240.2/3220363-0000315954

`No. 3:05—CV-630 and PHG Technologies LLC v. Tz'meMed Labeling Systems, Inc;
`
`LaserBand, LLC and Holden Graphic Services, Case No. 3:05-CV-1091, both filed in the
`
`United States District Court for the Middle District of Tennessee. True and correct
`
`copies of Applicant’s complaints (without their exhibits) in these cases are attached
`
`hereto as Exhibit B.
`

`Thus, Applicant is not entitled to exclusive rights to use the mark.
`
`Opposer respectfully submits that the mark is, therefore, not registrable under section
`
`2(e)(1) of the Trademark Act, 15 U.S.C. § l052(e)(l), and/or on the grounds that it is
`
`merely descriptive or generic.

`Accordingly, it is requested that registration be refused and that such other

`and further relief as the Board deems just be granted.

`A Furthermore, under TMEP §716.02, the Examining Attorney has the

`§716.02(d) pending the outcome of the current litigation matters.

`all the features of EasylD and more. SST ContactlD Jr reads the information from
`both tracks 1 and 2 of drivers‘ licenses, storing the name, address, DL number,
`expiry date and birth date contained on the license. This information is easily
`downloaded to a computer, and with the SST ContactlD software (purchased
`separately) you can create a customer database, mailing labels, and more. This
`data can also be shared with other software programs. SST ContactlD not only
`makes age verification a snap, it also helps you build a stronger business through
`smart customer management.
