`Pursuant to Fed. R. Civ. P. 56(c), Applicant, KidzArt Texas, LLC (“Applicant”), through counsel
`
`undersigned, hereby subn1its the following Response to Opposer Kidsart, Inc. ’s (“Opposer”) Motion for
`
`Summary Judgment. For the reasons explained below, Applicant respectfully requests that the
`
`Trademark Trial and Appeal Board (“TTAB”) deny Opposer’s motion and grant Applicant judgment in
`
`its favor because the term “kidsart” is generic and does not identify a particular source.
`
`I.
`
`INTRODUCTION
`
`Opposer’s motion fails to note several important points which are necessary to fully understand
`
`the context of the current dispute. There are presently two different registrations/applications at issue
`
`
`here. First, as Opposer’s motion notes, based on an application filed on March 17 2004 (and published
`
`for opposition on May 31, 2005), Applicant has sought to register the mark “KIDZART” on the
`
`principal register for, among other things, “franchise services, namely offering technical assistance in
`
`the establishment and/or operation of educational programs and after—school enrichment programs,” and
`
`for “Educational services, namely conducting classes in the field of art and distributing materials in
`

`connection therewith,” alleging a first use date of August 1997. See USPTO Principal Trademark
`
`Application Serial No. 76/581,686. Kidsart, Inc. opposes this application.
`
`Second, Applicant also has anMg registration for the mark “KIDZART”. This application
`
`was filed on July 3, 2000, and it has remained in use continuously since that time without opposition.
`
`See USPTO Supplemental Trademark Application (“App.”) Serial No. 76/082,290; Registration No,
`
`2491627 (noting supplemental register date of February 20, 2001). Notably, Opposer did not apply to
`
`register “kidsart” until May 12, 2003 — three years later.
`
`Opposer challenges both Applicant’ s existing registration (seeking cancellation) and its pending
`
`application to register “KIDZART” on the Principal Register, alleging that since 1986 it has utilized
`
`(though never registered) “kidsart” in connection with the offering of the same, or similar services, as
`
`those offered by Applicant. See Opposer’s Motion for Summary Judgment (“Opp. MSJ”) at 4 (citing
`
`Bayles Decl. ‘][ 3).
`
`Opposer’s requests should be rejected because the term “kidsart” is wholly generic and incapable
`
`of protection. In other words, where a descriptive mark—such as “KIDZART”—is capable of acquiring
`
`a secondary meaning, and where the proponent of that mark alleges that it has in fact acquired such a
`
`meaning, there can be no confusion between that distinctive mark and a wholly generic term or phrase
`
`which describes a genus, not a source of services.
`
`Summary judgment can only be granted when the moving party has established M: 1.) that no
`
`genuine dispute exists as to any material facts, and, 2.) that the moving party is entitled to judgment as a
`
`matter of law. See Fed. R. Civ. P. 56(c); Opryland USA, Inc. v. GreatAmerican Music Show, Inc., 970
`
`F.2d, 847, 23 USPQ2d. 1471 (Fed. Cir. 1992); Olde Tyme Foods, Inc. v. R0Lmdy’s, Inc., 961 P.2d 200,
`
`22 USPQ2d 1542 (Fed. Cir. 1992). Opposer’s motion fails and Applicant’s Motion should be granted
`
`because Opposer has n_ot shown that it is entitled to judgment as a matter of law and Applicant
`
`demonstrates herein that “kidsart” is generic as a matter of law.
`
`II.
`
`ARGUMENT
`
`In its motion, Opposer expends a significant amount of argument seeking to establish the
`
`similarity of, and thus the likelihood of confusion between, the KIDSART and KIDZART marks. This

`effort is somewhat unusual insofar as Opposer’s own motion notes that Applicant has agll that the
`
`two marks are nearly identical. See Opp. Mot. at 3 (quoting ‘][ 6 of Applicant’s Answer; “Applicant
`
`admits the allegations contained in Paragraph 6 of the Notice of Opposition that the marks are nearly
`
`identical.”
`
`Because the similarity of the marks is not in dispute, it is not necessary to address that issue.
`
`Instead, the outcome of Opposer’s motion depends upon the fact that Opposer’s mark is generic and
`
`incapable of protection, and for that reason, it provides no valid basis for cancellation of Applicant’s
`
`mark and no confusion can exist between a generic/general term which describes nothing more than a
`
`common activity and a descriptive term which has acquired a secondary meaning such that it identifies a
`
`specific provider of services.
`
`a. “KidsArt” is Generic
`
`It is well—established that some marks are entitled to significant protection, while others are
`
`entitled to no protection at all. In this regard, four familiar categories of terms have been identified for
`
`classifying marks.
`
`In ascending order of protection, they are: generic, descriptive, suggestive, and
`
`arbitrary or fanciful. See Abercrombie & Fitch Co. v. Hunting World, Inc., 537 F.2d 4, at 9 (2d Cir.
`
`1976). Determining the specific category for a given mark is a question of fact. See WSM, Inc. 1/.
`
`Hilton, 724 F.2d 1320, 1325-1326 (C.A.Mo. 1984). However, “. . .summary judgment must be granted

`if no reasonable [fact finder] could return a verdict for the nonmoving party.
`
`Freedman Seating Co. v.
`
`American Seating Co., 420 F.3d 1350, 1356 (Fed. Cir. 2005) (quoting Anderson v. Liberty Lobby, Inc.,
`
`477 U.S. 242, 248, 106 S.Ct. 2505, 91 L.Ed.2d 202 (1986).
`
`Of this group, a generic term is not eligible for trademark protection, cannot be registered, and a
`
`trademark infringement action cannot be predicated on its use. See American Cyanamid v. Connauglit
`
`Laboratories, Inc., 800 F.2d 306, 308 (2d Cir. 1986). “A term or phrase is generic when it is commonly
`
`used to depict a genus or type of product, rather than a particular product.” Murphy Door Bed Co. v.
`
`Interior Sleep Systems, Inc., 874 F.2d 95 (2d Cir.1989) (emphasis added). A generic term “implies
`
`reference to every member of a genus and the exclusion of individuating characteristics.” Eastern Air
`
`Lines, Inc. v. New York Air Lines, Inc., 559 F.Supp. 1270, 1274 (S.D.N.Y.1983).

`Evaluating whether a term is generic involves a two—part test: (1) What is the class of goods at
`
`issue? and (2) Does the relevant public understand the designation primarily to refer to that class of
`
`goods or services? See H. Marvin Ginn Corp. v. International Assoc. ofFire Chiefs, Inc., 782 F.2d 987,
`
`990, 228 USPQ 528, 530 (Fed. Cir. 1986). The pivotal question is whether the principal significance of
`
`the word to the consuming public is as an indication of the nature or class of the article rather than as an
`
`indication that it emanated from a particular source (even if possibly an anonymous one).
`

`Featliercombs, Inc. v. Solo Products Corp., 306 F.2d 251, 256 (2d Cir.), cert. denied, 371 U.S. 910, 83
`
`S.Ct. 253, 9 L.Ed.2d 170 (1962); see also McGregor—Doniger Inc. v. Drizzle, Inc., 599 F.2d 1126, 1131
`
`(2d Cir. 1979). Evidence of the public’s understanding of a term can be obtained from any competent
`
`source, including dictionary definitions, research databases, newspapers and other publications. See In
`
`Re NortlilandAluminum Products, Inc., 777 F.2d 1556, 227 USPQ 961 (Fed. Cir. 1985); In Re Analog
`
`Devices, Inc., 6 USPQ2d 1808 (TTAB 1988).
`
`Most importantly, a multi—word term or phrase will be generic if the evidence shows that each of
`
`the constituent words is generic and that the separate words retain their generic significance when joined
`
`to form a compound that has “a meaning identical to the meaning common usage would ascribe to those
`
`words as a compound.” In Re Gould Paper Corp., 834 F.2d 1017, 5 USPQ2d 1110, 1111-12 (Fed. Cir.
`
`1987).
`
`In Gould Paper, the applicant sought registration for the mark “SCREENWIPES” for goods
`
`described as “pre—moistened, anti—static cloth for cleaning computer and television screens.” Gould
`
`Paper, 834 F.2d at 1017.
`
`The PTO refused to register the mark on the basis that it was “merely descriptive” of the goods.
`
`See id.
`
`In response, Gould argued that although the terms “screen” and “wipe” are words that are
`
`commonly used,
`
`the unique combination formed by the union of these two words renders the
`
`“SCREENWIPE” mark distinctive. The PTO disagreed and the Court of Appeals affirmed, finding:
`
`Whether compounded as “screen wipe”—two words—or “screenwipe”—one word—either is
`ordinary grammatical construction. Nothing is left for speculation or conjecture in the
`alleged trademark.
`The compound immediately and unequivocally describes the
`
`... Gould has simply
`purpose, function and nature of the goods as Gould itself tells us.
`joined the two most pertinent and individually generic terms applicable to its product,
`and then attempts to appropriate the ordinary compound thus created as its trademark.

`In this instance, the terms remain as generic in the compound as individually, and
`the compound thus created is itself generic.
`
`Id. at 1018-19 (citing Cummins Engine Co. v. Continental Motors Corp, 359 F.2d 892, 53 CCPA 1167,
`
`149 USPQ 559 (1966) (“TURBODIESEL” generic for engines having exhaust driven turbine
`
`superchargers); In re Abcor Dev. Corp., 588 F.2d 811, 815, 200 USPQ 215, 219 (CCPA 1978) (Judge
`
`Rich, concurring) (“GASBADGE” generic for a gas monitoring badge)) (emphasis added) (internal
`
`citations omitted).
`
`Here, as was the case with Gould Paper’s “SCREENVVIPES”, “kidsart” is generic because words
`
`comprising the mark, “KIDS” and “ART”, are generic by themselves, and when placed together as
`
`“KIDSART” the term identifies a broad genus or type of general activity—children’s art—rather than a
`
`particular source (Opposer or Applicant or someone else). This generic phrase does not give any
`
`indication of the unique identity of the individual source of such goods or services. On the contrary, the
`
`phrase “KidsArt” includes any/every possible provider of children’s art activities, including both
`
`Opposer and Applicant, but also potentially millions of other similar businesses.
`
`Indeed, as set forth in the declaration of Maria Crin1i Speth submitted herewith, a recent Goo gle
`
`search for “kids art” returned in excess of ninety—one million hits (91,600,000) for a wide variety of
`
`species of businesses offering goods and services within the larger “children’s art” genus. The search
`
`returned hits for art galleries, art classes, art services, art supplies, and so forth. More importantly, the
`
`list of sources associated with this generic phrase is virtually 1in1itless,
`
`including the website
`
`www.Art.com, the retail store Target and its site www.target.com, art supplier “Alex Art Supplies”, and
`
`even online auction site www.ebay.com. Hundreds of similar examples are attached to Ms. Speth’s
`
`declaration showing the widespread use of the words “kids art” to describe the common genus of art-
`
`related children’s activities in websites, news reports, community calendars and elsewhere.
`
`Some of the thousands examples of the generic usage of “kids art” include: (1) “Scribbles kids
`
`art site;” (2) “Romanian kids art displays the artwork of students from Timisoara;” (3) “Kids’ art. Click
`
`on an artist to see their work;” (4) “We have one of the largest kids’ art collections on the Web;” (5)
`
`“Kids art lessons by Tumbnai1s;” (6) “Artsonia kids art museum;” (7) “the kids art page;” (8) “the kids’
`

`art show;” (9) “kids art education supplies” and (10) “kids art classes.” Declaration of Maria Crimi
`
`Speth and exhibits thereto.
`
`Because it describes a class or type of activity and not a specific source, the generic phrase
`
`“kidsart” provides a consumer with no information concerning the identity of Opposer or any other
`
`specific service provider. This is the very definition of generic; “If the name brings to the mind of the
`
`public the type of product instead of connoting a single source of that product, it is generic. American
`
`Angus Ass 'n v. Sysco Corp., 829 F.Supp. 807, 825 (W.D.N.C. 1992) (citing McCarthy, Trademarks and
`
`Unfair Competition, § 12:2 at 522 (2d ed. 1984)) (emphasis added).

`A similar situation was addressed in Gear, Inc. v. L.A. Gear California, Inc., 670 F.Supp. 508
`
`(S.D.N.Y. 1987).
`
`In that case, the Plaintiff, Gear, Inc. registered “gear” as a mark for a variety of
`
`products, including luggage, tote bags, gym bags, textile fabrics and for bath accessories including
`
`shower curtains. See Gear, 670 F.Supp. at 511. The Defendant, L.A. Gear, registered the phrase “L.A.
`
`Gear” as a mark in connection with footwear and clothing, among other things. Id. After discovering
`
`Defendant’s use of the “L.A. Gear” mark, Plaintiff commenced an action for, inter alia, trademark
`
`infringement, and Defendant counterclaimed for cancellation of Plaintiff’s “Gear” mark. Id.
`
`After a preliminary discussion of the applicable legal standards, the court found, as a matter of
`
`law, that the term “gear” was generic as applied to clothing, and for that reason, Defendants were
`
`entitled to judgment as a matter of law on Plaintiff’s infringement claim because the term “gear”, as
`
`applied to clothing, did nothing more than describe a general class of products known as “apparel” rather
`
`than a specific individual source of apparel. See id. at 516-17. This was true even though Plaintiff had
`
`enjoyed significant publicity and advertising for its products; “[N]o matter how much money and effort
`
`the user of a generic term has poured into promoting the sale of its merchandise and what success it has
`
`achieved in securing public identification, it cannot deprive competing manufacturers the product of the
`
`right to call an article by its name.” Id. at 517 (quoting Abercrombie & Fitch, supra, 537 F.2d at 9).
`
`In order to disprove a term as generic, the user must show the “primary significance of the term
`
`in the minds of the consuming public is not the product but the producer.” American Angus Ass 'n, 829
`
`F.Supp. at 825 (quoting McCarthy, supra, at 523) (citing Kellogg Co. v. National Biscuit Co., 305 U.S.

`111, 59 S.Ct. 109, 83 L.Ed. 73 (1938) (emphasis in original)). Opposer can make no such showing as is
`
`so plainly demonstrated by the widespread generic use of “kids art.”
`
`Opposer has not introduced any evidence that any consumer has ever associated 0pp0ser’s
`
`unique business with the mark “KIDSART”; it is just as likely that consumers looking for any children’ s
`
`art provider would reach Opposer without ever actually recognizing a distinction between Opposer and
`
`any other similar provider. For instance, suppose a neighborhood dry cleaning business on Main Street
`
`has a sign out front that simply reads: “DRYCLEANER”, but the business is actually operated by an
`
`entity called “Acme Cleaners Corp., Inc.” A patron of this business may refer to it as “my dry cleaner”,
`
`and a person passing by may see the sign and think, “that’s a dry cleaner business,” but they would
`
`never connect this specific term with Acme Cleaners Corp., nor would the generic term “DRY
`
`CLEANER” establish the unique identity of that business as opposed to any other cleaner in town. It
`
`would therefore not serve as a valid basis to cancel the mark of that is capable of acquiring secondary
`
`meaning, such as “DRI—KLEANER” or “VALLEY DRY CLEANER”.
`
`Here, the facts reflect that “kids art” or “kidsart” are common words to describe nothing more
`
`than a type of activity, not a source, just as a “dry cleaner” is a type of business, not a unique place or
`
`entity. Regardless of its prior use of this unregistered mark, allowing Opposer to defeat more
`
`descriptive and unique marks which identify unique providers of children’s art services would grant
`
`Opposer a monopoly over the entire genre of children’s art. Such is not the purpose of either a valid
`
`opposition or cancellation proceeding. Accordingly, Opposer’ s motion should therefore be denied in its
`
`entirety and this tribunal should grant Applicant’s Cross—Motion.
`
`III.
`
`CONCLUSION
`
`Opposer is not entitled to judgment as a matter of law. A generic mark, even one used for many
`
`years, does not provide a sufficient basis to deny registration of a unique (albeit similar) mark which
`
`does distinguish the proponent from its competitors. Having failed to establish any legal basis for its
`
`position, Opposer’s motion should be denied and Applicant’s Cross—Motion should be granted.
`

`On or about January 25, 2005, I conducted an Internet search for the words
`
`“kids art” (together in quotes, meaning the search included only sites where the two words were
`
`found directly adjacent to each other) through www.google.com. The search returned in excess
`
`of 1,000,000 hits. A copy of the first 100 search results is attached hereto as Exhibit A.

`After reviewing the search results, I concluded that the phrase “kids art” is
`
`associated with countless providers of children’s art classes, art supplies, art galleries, and so
`
`forth. The various goods and services associated with the generic concept of “kids art” includes
`
`retailers such as Target stores, the auction site www.ebay.com, online art dealer www.art.com,
`
`and even the National Gallery of Art and its associated website www.nga.gov[kids[kids.htm.
`

`
`Next, I conducted ami Internet search for the phrase “KIDSART” (one word)
`
`through www.google.com. The search returned in excess of 54,000 hits. A copy of the first
`
`100 search results is attached hereto as Exhibit B. The results of this search for “KIDSART”
`
`included numerous links to the same sites that were also within the group of sites listed in my
`

`initial search for “kids art”, including wvvw.Art.com, www.target.com, and many other similar

`numerous links to generic art-related sites and sources, the search for “KIDZART” returned
