`
`PATRICK G. THURMOND, CSR, RPR
`
`(903) 595-1415
`
`
`
`DEPOSITION OF TOM HULSEY
`
`A.
`
`Correct.
`
`Q.
`
`Even though I know it speaks for itse1f, it's in
`
`out1ine form,
`
`so I do want to ask you some questions about
`
`your work history.
`
`First of a11, you obtained,
`
`I note from your
`
`résumé, your bache1or of science degree from the University
`
`of Arkansas. What was your Iine of study?
`
`A.
`
`Q.
`
`It was industriai education,
`
`industria1 arts.
`
`And when you obtained two semesters of
`
`post-graduate work at Penn State University, what was that
`
`course of study?
`
`A.
`
`That was in some advanced mathematics, ca1cu1us
`
`courses, auto;CAD courses,
`
`three courses in computer-aided
`
`design.
`
`Q.
`
`what I'd 1ike for you to do, without me having to
`
`interrupt you with one question after another,
`
`is for you to
`
`f1esh out,
`
`so to speak, or to articu1ate for the members of
`
`the TTAB, your work history as it re1ates to the fastener
`
`' Iine of work and products --
`
`A.
`
`Q.
`
`A.
`
`Right.
`
`-- and the meta1-bui1ding industry.
`
`We11,
`
`that started a coup1e of years after
`
`graduation with a company ca11ed Varco-Pruden, that's Iisted
`
`here.
`
`They are a stee1-bui1ding manufacturer, and these
`
`bui1dings are he1d together, of course, by bo1ts and screws

`PATRI(H’< G. THURMOND, CSR, RPR
`
`(903) 595-1415
`
`
`
`DEPOSITION OF TOM HULSEY
`
`and that sort of thing.
`
`Part of my responsibiiity at Varco-Pruden was
`
`in research and deveiopment,
`
`to deveiop wa11— and
`
`roof-fastening systems,
`
`redesign their fasteners,
`
`if you
`
`wi11,
`
`their screw fasteners,
`
`to hoid the buiidings in piace.
`
`So that 1ed to a 1ot of other R&D products,
`
`seaiants and that sort of thing, a11 somewhat
`
`fastener—re1ated.
`
`But
`
`I got a thorough knowiedge of the
`
`preengineered steei-buiiding industry going through those
`
`types of product and how they appiied to the stee1 buiidings.
`
`So it gave a good basis for that.
`
`Then,
`
`iater on,
`
`I was contacted by a fastener
`
`company in Pennsyivania, Construction Fasteners,
`
`their name
`
`at the time,
`
`they have since been purchased, and now their
`
`name is SFS intec,
`
`I beiieve is their name now.
`
`But at the
`
`time it was Construction Fasteners.
`
`And I was with that
`
`company for about 28 years.
`
`‘My iatest tit1e was vice
`
`president of technicai services and appiications engineering.
`
`That was a research-and-development
`
`type of position.
`
`But
`
`in addition to that,
`
`I worked very cioseiy
`
`with the buiiders,
`
`their customers,
`
`those peopie that used
`
`the fasteners and instaiied those fasteners in the steei
`
`buiidings and post-frame buiidings, as we11.
`
`So it was broad
`
`spectrum of construction, using screws and boits of a11
`
`types.

`DEPOSITION OF TOM HULSEY
`
`After the company Construction Fasteners was
`
`so1d to SFS,
`
`I had moved to Seaitite Bui1ding Fasteners.
`
`I
`
`was emp1oyed there in 2002,
`
`I beiieve, January of 2002.
`
`Q.
`
`Is that Sea1tite Bui1ding Fasteners in Tyier,
`
`Texas?
`
`A.
`
`0.
`
`In Ty1er, correct.
`
`And, of course, you have a professionai
`
`re1ationship with Joe Hargis and Bruce Crouch,
`
`I
`
`take it?
`
`A.
`
`0.
`
`Yes, very c1ose re1ationship.
`
`Going back to Construction Fasteners, Inc., at
`
`Ieast its previous name,
`
`I note in your Iist of
`
`responsibi1ities and activities in which you were invo1ved,
`
`it says you served on the SPRI Technicai Committee that
`
`deve1oped ANSI standards for fasteners used in the roofing
`
`industry, and so on. First of a11, what is ANSI,
`
`the ANSI
`
`standards?
`
`A.
`
`American Nationa1 Standards Institute is ANSI.
`
`The
`
`SPRI organization, or Sing1e§P1y Roofing Institute, was an
`
`institute deve1oped strict1y, as the name impiies, sing1e—pIy
`
`roofing, putting down sing1e membranes on roofs for
`
`waterproofing purposes, over conventiona1 bui1dings,
`
`to
`
`rep1ace aspha1t and that type of thing.
`
`Part of the deve1opment
`
`in that was to deve1op
`
`fasteners that wou1d ho1d the rigid insu1ation board that's
`
`used in the roof constructions to the stee1 decking.
`
`And
`
`PATRICK G. THURMOND, CSR, RPR
`
`(903) 595-1415
`
`
`
`
`
`DEPOSITION OF TOM HULSEY
`
`it's a fastening system,
`
`incidenta11y, it's a screw-and—p1ate
`
`combination type of thing.
`
`That particuiar technicai committee was part
`
`of the Sing1e-P1y Roofing Institute, and I chaired the
`
`fastener committee of that technicai committee for two or
`
`three years.
`
`Q.
`
`with respect to Construction Fasteners, it notes,
`
`at the very beginning,
`
`that you were responsibie for the
`
`design,
`
`the deveiopment, and testing of new fasteners and
`
`reiated products for use in stee1-framed and wood-framed
`
`buiiding construction.
`
`Can you give us a 1itt1e more detaii, what did
`
`you do on a day—to-day basis in that respect?
`
`A.
`
`First, you define the need. There has to be a need
`
`for a fastener to so1ve a prob1em or there is no need in
`
`trying to deveiop one.
`
`17
`
`18
`
`19
`
`20
`
`21
`
`22
`
`23
`
`24
`
`25
`
`Once you define the need,
`
`then you determine
`
`what ioads, or what properties that fastener must have to
`
`withstand the stresses it's going to be placed under.
`
`Once those have been estabiished,
`
`then you
`
`deveiop a thread profiie, or a geometry, or a shape or a head
`
`configuration that best solves the objectives for the
`
`fastener that you have defined origina11y.
`
`And then you deveiop prototypes and test those
`
`to see if they do meet that criteria.
`
`And then you determine
`
`PATRICK G. THURMOND, CSR, RPR
`
`(903) 595-1415
`
`
`
`DEPOSITION OF TOM HULSEY
`
`its manufacturing cost, and if it's economicai
`
`to pursue
`
`that.
`
`Then you manufacture the fastener and then
`
`give it to the marketing and sales guys and say, Here you go.
`
`Q.
`
`Before we get to your emp1oyment history and
`
`experience with Sea1tite Buiiding Fasteners in Tyier,
`
`I note
`
`_ on the second page of your résumé that you are an inventor of
`
`eieven US patents and one Canadian patent for fasteners and
`
`fastening systems.
`
`I don't expect you to go through, nor do I
`
`think anybody here wants you to go through a11 the patents,
`
`but can you give us an examp1e of one or two of those
`
`patents.
`
`A.
`
`One particuiar one was a bimetai fastener, part of
`
`the fastener is stain1ess stee1 and part carbon steei.
`
`The
`
`objective in that fastener was to deveiop a screw that cou1d
`
`attach rigid insuiation board in the Singie-P1y Roofing
`
`Institute arena that we taiked about to stee1 decking,
`
`without having to predri11 the ho1e, and then once insta11ed,
`
`the screw wou1d not red—rust.
`
`we know,
`
`from past experience -- and over this
`
`many years of experience you 1earn a few things as you go --
`
`stain1ess stee1 wi11 not red-rust in the environments it's
`
`exposed in in construction.
`
`But it wi11 not dri11 a ho1e.
`
`It's too soft.

`
`So, by the addition of a carbon stee1 tip that
`
`can be heat-treated and hardened,
`
`that wi11 provide the
`
`driiiing through the stee1 deck.
`
`Now you have the best of both worids.
`
`You
`
`have a fastener that can be insta11ed in steei decking,
`
`securing the insu1ation board in a wet environment, usua11y
`
`found in reroofing, as they ca11 it, or retrofitting an o1d
`
`G301-bO~Jl\)
`
`\l
`
`roof.
`
`Now, once insta11ed,
`
`the fastener wi11 be
`
`there.
`
`It wi11 not red rust and not degrade.
`
`That was one
`
`of the patents.
`
`And there is -- another patent was simp1y a
`
`meta1 p1ate that is used in conjunction with a screw of a
`
`certain geometry that wi11 a11ow it to resist the wind upiift
`
`ioading that wou1d be imposed on that roof. That's a coup1e
`
`of them.
`
`Q.
`
`Now,
`
`te11 us about your work experience with
`
`Seaitite Buiiding Fasteners in Tyier, what it is you do,
`
`again on a day-to-day basis.
`
`A.
`
`On a day-to-day basis, it's sti11 deveioping
`
`fasteners where there is a need.
`
`It's working with our
`
`customers in seiecting the appropriate fastener for their
`
`needs in construction.
`
`It is giving training seminars to our sa1es
`
`peopie to make them aware of what their customers are needing

`and 1ooking for.
`
`I a1so generate technicai data;
`
`that is, pu11
`
`out and pu11 over data, as we ca11 it, for the specific
`
`fasteners in construction app1ications for preengineered
`
`bui1dings and wood-frame buiidings.
`
`So it gives our customers‘ engineering
`
`departments a basis from which to design their assemb1ies.
`
`It gives them the strength criteria they can use.
`
`They app1y
`
`their factors of safety for that and design their bui1dings.
`
`Q.
`
`From what
`
`I can gather from your resume, beginning
`
`in 1964, you have had rough1y 42 years of experience with
`
`fasteners and fastener products?
`
`A.
`
`Q.
`
`Correct.
`
`Now, by virtue of the work experience that you have
`
`had, have you become famiiiar with, or know1edgeab1e about,
`fasteners, not oniy in the meta]-buiiding industry, but
`
`fasteners throughout various markets?
`
`A.
`
`Abso1ute1y. Being in the fastener industry for
`
`that 1ong, you see a11 types of attachment devices, fasteners
`
`for different app1ications.
`
`And working in the patent area,
`
`you find a11 types of fasteners that are usua11y -— that
`
`usua11y come up in the patent prosecution -- that interfere

`
`They are machine threads, for Tack of a better term,

`
`0.
`
`withstanding to1erances or certain Toads?
`
`Yes, sir.
`
`How is that distinguishab1e from the B&B
`
`Hardware product?
`
`A.
`
`The Sea1tite Bui1ding Fasteners products are what
`
`is termed se1f-dri11ing fasteners that driT1s their own pi1ot
`
`hoTe and then is fo11owed by the threads that then tap their
`wk¢>rr\».3C3z
`way into the substrate, or form making threads into the
`
`substrate it's being insta11ed into.
`
`The products I saw in the Sea1tight B&B
`
`Hardware products are a11 machine threads.
`
`They require a
`
`predriT1ed and pretapped hoTe with threads made in that screw
`
`to be instaT1ed;
`
`They don't form their own threads.
`

`

`
`A.
`
`No.
`
`The appTication of the SeaTtite Ty1er
`
`fasteners is to ho1d metaT pane1s onto stee1 or wood framing.
`
`There is no pressure exerted on that that wouTd require them
`
`to be a pressure seaT connection.
`
`They must seaT against water infi1tration, but
`
`that's rainwater. That's under zero pressure differentiaTs
`
`from inside to outside the bui1ding.
`
`It's just water running
`
`off the roof; it has to sea1 the hoTe.
`
`They are not sea1ed by 0-rings;
`they are
`sea1ed by washers that are made for preengineered type of
`
`construction.
`
`And that is a meta1 washer with a rubber1ike
`
`compound bonded to it so that there is a Tittie cushion
`
`between the fastener and the meta1 pane1, un1ike their
`
`fastener -- and it states metaT-to-metaT contact for
`
`securing, and the 0+ring is captured underneath their
`
`fastener head.
`
`By contrast,
`
`the SeaTtite Bui1ding Fasteners
`
`in TyTer have the washer that separates the head from the
`work piece so there is £:fmeta1—to-meta1 contact, because it
`
`wouTd damage the painted surface.
`
`It's an entireTy different concept. There is
`
`no pressure seaT, vacuum or direct externai pressure that has
`
`to be met. There is no psi ratings on these fasteners.
