`I am over 21 years of age and competent to testify in this matter.
`
`I am an employee and partial owner of R.K. Stratman, Inc., a corporation of the
`
`state of Missouri having a place of business located at 6808 Parr Road, Wentzville,
`
`Missouri 63385.
`
`3.
`
`In approximately 1969, I, Ron Stratman, d/b/a R.K. Stratman Co.. began selling
`
`T-shirts bearing the name ‘BLACK HILLS" at the annual Sturgis Motorcycle Rally &
`
`Races held in and around Sturgis, South Dakota and the Black Hills region of South
`
`Dakota and Wyoming. which is now generally referred to as the Sturgis Motorcycle
`
`Rally or something similar (hereinafter “the Rally").
`
`4.
`
`Between approximately the years 1969 and 1985, R.K. Stratman Co. sold
`
`clothing including T-shirts bearing the name “BLACK HILLS" at various retail locations
`
`each year at the Rally.
`
`5.
`
`In approximately the mid 1970s, R.K. Stratman Co. began making and selling T-
`
`shirts and other products bearing the name “BLACK HILLS" as a wholesaler to Harley-
`
`Davidson, lnc.’s dealers, as well as other Rally vendors, for resale at the Rally.
`
`6.
`
`R.K. Stratman, Inc. was formed in approximately 1985 as the successor of R.K.
`
`Stratman Co.
`
`7.
`
`Since approximately 1985 through the present. R.K. Stratman, Inc. has sold T-
`
`shirts and clothing bearing the name “BLACK HILLS" as a wholesaler to Harley-
`
`Davidson, Inc. and Harley-Davidson lnc.’s dealers and other Rally vendors for resale at
`
`the Rally.

`Between the years 1996 and 2001, R.K. Stratman, Inc. has sold, at wholesale. to
`
`Harley-Davidson, lnc.'s dealers and other Rally vendors, between at least $750,000 and
`
`$1,000.000 per year in T-shirts and clothing bearing the names "BLACK HlLLS” and/or
`
`“BLACK HILLS RALLY", including the designs depicted in Exhibits A-E hereto.

`R.K. Stratman, Inc. has never entered into any license or any similar agreement
`
`with the Sturgis Chamber of Commerce for the use of the name “BLACK HILLS" or any
`
`other mark.
`
`16.
`
`R.K. Stratman, Inc. continues to use the name “BLACK HILLS" and/or “BLACK
`
`HILLS RALLY” in commerce on or in connection with sale of T—shirts and clothing as a
`
`wholesaler to Harley-Davidson lnc.‘s dealers and other Rally vendors for resale at the
`
`Rally.
`
`I declare further that all statements made herein of my own knowledge are true:
`
`that all statements made herein on information and belief are believed to be true; and
`
`further that these statements were made with the knowledge that willful false statements
`
`and the like are punishable by fine or imprisonment, or both, under Section 1001 of Title
`
`18 of the United States Code.
