`1, David Y. Rochlen, Jr., being hereby warned that willful false statements and the like so

`I am the President and CEO of Surf Line. My responsibilities as PresidentJ'CEO
`
`include overall management of the enterprise, including design, manufacture and marketing of
`
`the company’s products. I make this Testimonial Declaration in support of Surf Line’s Notice of
`
`Opposition against Applicant Robert Charles White’s (“White”) trademark application to register
`
`TOE JAMS for “clothing, namely, socks, shoes, shirts, pants, underwear and ties” (Serial No.
`
`76/244,120).

`Surf Line has been a family business since its beginning, and I grew up in it,
`
`Background
`
`working part time when I got old enough to do so.
`
`I graduated from the University of Califomia
`
`in Los Angeles with a Bachelor’s degree in History in December, 1985. The following month, I
`
`joined Surf Line as a full-time employee doing various jobs. In 1987, I became Trade Show
`
`Supervisor, with management responsibility for Surf Line’s participation in clothing trade shows.
`
`In 1.990 I became a Merchandise Assistant, and in 1992 I became Vice-President.
`
`I became the
`
`President in 1997. As a result of this background and experience, I am thoroughly familiar with
`
`the history, development and marketing of Surf Line and its JAMS® and JAMS WORLD®
`
`brands, with the customs and practices prevalent in the clothing industry with respect to the
`
`development and marketing of clothing, and with the marketing and advertising activities of Surf
`
`Line and its competitors. Furthermore, I am all too familiar with the policing and enforcement of
`
`Surf Line’s trademarks.
`

`
`I make this Testimonial Declaration to introduce certain facts and evidence into
`
`the record relating, among other things, to the history of Surf Line and its JAMS brands of
`
`clothing, Surf Line’s advertising and marketing of the JAMS brands, and how the applied-for
`
`TOE JAMS trademark resembles Surf Line’s JAMS trademarks.
`
`History ofSurfLine and JAMS
`
`4.
`
`Surf Line manufactures, markets and sells clothing and other products, including
`
`T-shirts, swimming trunks, pants, shirts and shorts in the United States and internationally,
`
`primarily under the JAMS, JAMS WORLD and other JAMS-related marks such as JAMS
`
`MAN® and JAMS FAST® (collectively “the JAMS Marks”).
`
`5.
`
`The founder of Surf Line was David Y. Rochlen, my father, who was a great
`
`waterrnan and a leader in Hawaii’s fashion industry. In the early l960’s, he opened a small surf
`

`
`shop in Honolulu. Noticing a shortage of colorfiil, lively clothing suitable for surfers, who were
`
`for the most part colorful and lively people, my father created his own surf clothing — beginning
`
`with long, colorful, baggy print shorts that he sold under the mark JAMS. The first pair of
`
`JAMS shorts hit Makaha Beach in Hawaii in 1964. The product became an immediate hit, and
`
`within a year expanded to the mainland. By 1965, the company had incorporated and the
`
`product had become the subject of a “Fashion” page in Life magazine. A copy of that article is
`
`annexed hereto as Exhibit A. Propelled by my father's unique vision and aesthetic, the business
`
`grew and expanded from a surf shop selling family-made clothing to a business that today
`
`employs 102 people, operates its own factory and warehouse, and purchases fabric and sells
`
`garments internationally.
`

`As the business evolved, people began using the brightly colored, loose-fitting
`
`garments not only as surfing trunks, but as walking shorts and casual clothing, and the JAMS
`
`brand became an active and leisure wear brand, which was applied to such other items of
`
`clothing as shirts, hats, T-shirts, jackets, athletic shorts, sweat clothes, dresses, and many other
`
`garments and items such as back packs and sun glasses.
`

`The swimwear and shorts sold under the JAMS trademark have survived nearly
`
`forty years of fashion transformations as the company has evolved into the Surf Line of today.
`
`To quote from our website, it has “come out of the surf, up the beach, across the boardwalk, and
`
`halfway to town.” See: http://www.jamsworld.com./our storeaspz. See Exhibit G armexed
`
`hereto, which is discussed in paragraph 13 of this declaration.
`

`In the mid-1980’s, the JAMS brand enjoyed an enormous surge in popularity.
`
`Wholesale sales surpassed $35 million at its peak, and we were forced to launch more than a
`
`dozen lawsuits to protect the JAMS trademark. Fortunately, most settled rather quickly.
`
`

`
`Annexed as Exhibit B are photographs of JAMS trunks or pants and other paraphernalia from
`
`that decade, including licensed sneakers that resulted from the popularity, gloves and a necktie.
`

`
`In 1987, Surf Line introduced a line of men’s, women’s and children’s casual
`
`wear clothing under the JAMS WORLD trademark. Today, Surf Line makes and sells a variety
`
`of swimming trunks, shirts, shorts, T-shirts, dresses and other garments under the JAMS and
`
`JAMS WORLD trademarks. Copies of some labels used over the years for garments sold under
`
`the JAMS, JAMS WORLD and other JAMS trademarks are aimexed hereto as Exhibit C. In
`
`September, 1991, Surf Line opened its JAMS WORLD retail store in Santa Monica, California.
`
`Today, more than 500 United States retailers carry some or all of Surf Line’s line of JAMS and
`
`JAMS WORLD casual clothing, which is generally sold to better department and clothing
`
`stores. More than half of Surf Line’s United States JAMS brand sales in recent years have been
`
`to the states of California, Florida and Hawaii, but it has sold clothing to retailers in almost
`
`every state and Puerto Rico during the last ten years.
`

`
`To give an idea of the breadth and diversity of the JAMS brands and their
`
`clothing lines, I annex as Exhibit D product line booklets from the Summer season of 1993
`
`illustrating the available merchandise falling into the categories of Mens, Womens and Toddlers
`
`& Boys 4-7 wear. A more succinct illustration is found in the Spring, 1997 brochure annexed as
`
`Exhibit E.

`Each of these registrations shows that it is subsisting, more than five years old, and has become
`
`incontestable under the provisions of Section 15 of the Trademark Act. We also have
`
`registrations of JAMS MAN and Design, JAMS FAST and several other marks, none of which
`
`add anything to the case we already have made. Our records show that Surf Line also owns
`
`

`more than thirty-five trademark registrations for JAMS marks in more than twenty jurisdictions
`
`outside the United States (including the European Community).
`
`The Marketing and Success ofthe JAMS Brands
`
`13.
`
`In 1964, the JAMS trunks sold itself on the beach, and they quickly developed
`
`“fad" status. Since then, Surf Line has actively marketed its JAMS brands, sometimes using
`
`coop advertising, catalogs, magazine ads, stickers, posters, T-shirts, exhibiting at trade shows
`
`and, now, the JAMS WORLD website. Annexed as Exhibit G is a copy of our current website,
`
`illustrating our current line of merchandise. We also engage a national sales manager and
`
`regional sales representatives to service retailers and solicit new accounts. Since 1964, Surf Line
`
`has sold more than $200,000,000 JAMS brand garments, and has spent more than $6,000,000
`
`marketing and promoting its marks. 2003 was an economically troubled year for Surf Line and
`
`much of the clothing business (we also were dealing with the impact of our founder’s death), but
`
`we had more than eight million dollars in wholesale sales of garments, which was significantly
`
`above our forty-year average.
`

`
`Like any successfiil company selling branded consumer products, Surf Line
`
`guards its brands against imitation. Surf Line, through counsel, monitors trademark filings in the
`
`clothing class with the United States Patent and Trademark Office, the Ofiicial Gazette of the
`
`United States Patent and Trademark Office, and various reports, notices and/or inquiries directed
`
`to us or our counsel. Enforcement measures include letters, negotiation, and, if necessary,
`
`litigation. Since I have been employed, there have been scores — perhaps hundreds of such
`
`enforcement actions. Most conflicts have been resolved satisfactorily, but there have been more
`
`than a dozen litigations, all but one of which settled to our satisfaction. The one that did not
`
`settle, we won. See Exhibit 1.
`

`
`15.
`
`Surf Line is a nationwide source in the clothing market, a forty year survivor in a
`
`business in which many fail, and it has a unique business philosophy which sets it apart (See
`
`Exhibit G, “History and Philosophy”/Philosophy). Surf Line is a company with a distinct, I like
`
`to think benign, attitude. Our website sums up our philosophy as‘. “Jams World ® is a lifestyle.
`
`Neither age not sex is a criterion for buying Jams World®. The target customer is anyone who
`
`gets in front of the Jams World® arrow. Jams World® designs are created to please the
`
`company, and its ‘point of view’. The company ‘sings and dances’ to its own tune, and hopes it
`
`pleases the customer.”
`
`“Our credo is color, freedom, difference and love.”
`
`“This seems to be what life is all about.”
`
`Our Objections to TOE JAMS
`
`16.
`
`This proceeding is directed against Mr. White’s trademark application to register
`
`TOE JAMS for “clothing, namely, socks, shoes, shirts, pants, underwear and ties.” As a
`
`businessman, my first objection to TOE JAMS is its meaning —- the “gunk” or dirt that collects
`
`between the toes. (See Exhibit H.) This is a particularly distasteful juxtaposition of images and
`
`ideas for the JAMS brand philosophy of “color, freedom, difference and love.” My second
`
`reaction as a businessman is that we have already won this case, and we should not have to pay
`
`to do it again. By winning this case, I mean we tried a case in Honolulu some years ago against
`
`a Mr. Ahakuelo, who thought it would be a good idea to sell HAWAIIAN TOE JAMS T-shirts,
`
`among other “Hawaiian
`
`Jam” T-shirts. At the end of the day, it was not a very good idea
`
`at all. I annex a copy of the published decision in that case as Exhibit 1.
`
`

`I am advised, however, that the Board will analyze certain other factors to
`
`determine whether the TOE JAMS mark may be registered by Mr. White.
`
`18.
`
`I have been asked by counsel to bring my experience to bear by providing purely
`
`factual information with respect to the following matters: (1) the characteristics of the JAMS
`
`trademark and other of Surf Line’s JAMS marks, specifically whether any describes the clothing
`
`in any way that may be subject to similar use by others; (2) the similarity of the parties’ marks;
`
`(3) the similarity of the parties’ products; and (4) the similarity of the parties’ products’ retail
`
`outlets and purchasers. While I carmot, and do not intend to, argue about these factors, I can
`
`address each on the basis of my own factual knowledge and experience.
`
`19.
`
`Characteristics ofthe SurfLine ’s JAMS Marks. The term “JAMS” is not
`
`descriptive in any way of Surf Line’s clothing or other products and services sold under its
`
`JAMS brands. I note that a court has already held it not to be “generic.” See Exhibit I.
`
`20.
`
`Similarity of the Parties ' Trademarks. Both parties’ marks contain the word
`
`JAMS, which is a common word for fruit preserves, basketball shots from above the rim and
`
`improvisational musical get-togethers — none of which has any apparent significance, or even
`
`any relationship, to either parties’ products. TOE JAMS, as I have mentioned above, has a
`
`moderately disgusting meaning.
`
`21.
`
`Similarity ofthe Parties ’ Products. Mr. White has applied to register his mark
`
`for “clothing, namely, socks, shoes, shirts, pants, underwear and ties.” Surf Line has long sold
`
`“clothing” under its JAMS brands. Less generally and more specifically, Surf Line has sold
`
`JAMS and JAMS WORLD sneakers and slippers, and sells them today. Surf Line sells men’s,
`
`women’s and children’s shirts and has done so for many years. The same can be said for pants,
`
`particularly if one views swimming trunks as “pants.” “Underwear” in the form of T-shirts has
`
`

`
`been a staple of Surf Line’s JAMS brand clothing lines for years. Surf Line has on occasion
`
`sold JAMS and JAMS WORLD ties, but not for some years. One such tie is shown in Exhibit
`
`B.
`
`22.
`
`Similarity ofRetail Outlets and Purchasers. Surf Line’s products are sold
`
`through retail stores throughout most of the fifty states. It is my understanding that Applicant
`
`has not begun selling any products under the TOE JAMS mark. I am advised that Applicant’s
`
`Response to Interrogatory No. 1 states “While the Applicant has not contacted any specific
`
`retailers at this time, he does intend to contact general clothing retailers such as department
`
`stores, discount stores, and novelty clothing stores.” Department stores and specialty clothing
`
`stores are channels through which Surf Line sells many of its garments; Surf Line generally
`
`attempts to avoid discount stores.
