`

`King
`
`Frances S. Wolfson, Interlocutory Attorney:
`
`On April 1, 2003, applicant filed a proposed amendment to
`
`its application Serial No. 78/061,974, with opposer's consent.
`
`By the proposed amendment applicant seeks to change the
`
`identification of goods from "pharmaceutical preparations,
`
`namely preparations for the treatment of infectious diseases,
`
`oncological preparations, analgesics, preparations for the
`
`treatment and symptoms of diabetes, preparations for the
`
`treatment of opthalmological conditions and diseases,
`
`preparations for the treatment of central nervous systems
`
`diseases and disorders, preparations for the treatment of
`
`Parkinson's disease, gynecological preparations, anti-
`
`inflammatory pharmaceutical preparations, preparations for the
`
`treatment of cardiovascular diseases and conditions, hormonal
`
`preparations and preparations for the treatment of migraines;
`
`and intra ocular lens" to "intraocular lenses."
`
`
`
`Inasmuch as the amendment is clearly limiting in nature
`
`as required by Trademark Rule 2.71(b), and because opposer
`
`consents thereto, it is approved and entered.
`
`See Trademark
`
`Rule 2.133(a).
`
`If this resolves the dispute herein, opposer is allowed
`
`until thirty days from the mailing date of this order to file
`
`a withdrawal of the opposition, failing which the opposition
`
`will go forward on the application as amended.
`
`See Trademark
`
`Rule 2.106(c).
`
`Proceedings are suspended pending opposer's response to
`
`this order.
`
`Opposer’s motion to extend time filed May 21,
`
`2003 is accordingly moot; trial dates will be reset if the
`
`opposition is not dismissed following opposer's response to
`
`this order.
