`Applicant files this response to the Board’s Order dated July 9, 2004 seeking information

`as to whether the parties have filed a petition for bankruptcy and information regarding other
`
`pending related cases. Applicant responds that it has not filed a petition for bankruptcy but that
`
`Applicant is aware that Opposer filed a petition for bankruptcy in the United States Bankruptcy
`
`Court in the Western District of Texas on September 17, 2002 (Case No. 02-54469). Applicant
`
`attaches as E);lr;ib;i_t 1 the notice Applicant received from the Bankruptcy Court regarding
`
`Opposer’s petition.
`
`Opposer and Applicant are also parties to another opposition proceeding, Opposition No.
`
`91150703. Applicant attaches as Exhibit 2 a copy of the Notice of Opposition filed by Opposer
`
`Mark Nutritionals, Inc. in that case. Applicant has also filed a Motion to Resume in Opposition
`

`No. 91150703. The Board issued a notice on May 5, 2004 resuming those proceedings and

`resetting discovery and testimony periods.

`Mark Nutritionals, Inc. (“Opposer”), a California corporation having its principal place of

`business at 13311 San Pedro Avenue, San Antonio, Texas 78216, believing that it will be
`
`damaged by registration of the DIET SOLUTIONS mark claimed in Serial No. 76/192,166 for
`
`“dietary supplements” in International Class 5, hereby opposes the same.

`As grounds for opposition, Opposer alleges as follows, with knowledge concerning its

`1. By the application herein opposed, Applicant, Nutrition & Fitness IMG, Inc.

`2. The Applicant filed for the instant application on January 11, 2001, on an intent to

`use basis.

`3. Opposer is the owner of the world famous “BODY SOLUTIONS” mark for; e.g.,

`dietary supplements (many of which are available on its b0dys0luti0ns.c0m website) and retail

`store services. These goods are related to, travel in substantially the same channels of trade, and

`are marketing to the same consumers as the goods for which Applicant now seeks registration of
`
`the subject alleged trademark.

`4. Opposer’s mark is the term “ BODY SOLUTIONS,” which trademark is used by

`consumers to identify dietary supplements and related products coming from a single source,

`the substantial advertising and promotional efforts made in connection therewith, Opposer has

`developed enormous secondary meaning and goodwill in its BODY SOLUTIONS® mark.
`
`10. The alleged trademark proposed for registration by the Applicant, namely, DIET
`
`SOLUTIONS, is confusingly similar, indeed is almost identical, to Opposer’s common law
`
`BODY SOLUTIONS trademark.
`
`11. The asserted mark in Application Serial No. 76/ 192,166. sought to be registered by
`
`Applicant “so resembles a mark registered in the Patent and Trademark Office or a mark .
`

`
`previously used in the United States by another and not abandoned,” namely Opposer’s BODY
`
`SOLUTIONS® trademark, “as to be likely when applied to the goods of Applicant, to cause
`
`confusion, or to cause mistake, or to deceive,” so that the registration of Applicant’s alleged
`
`trademark should be denied and refused in accordance with Section 2(d) of the Trademark Act of
`
`1946, 15 U.S.C. § 1052(d).
`
`12. The asserted trademark herein is not a “trademark by which the goods of the
`
`Applicant may be distinguished from the goods of others,” namely the goods sold by Opposer
`
`under its BODY SOLUTIONS® mark, which Opposer has used since well prior to the filing date
`
`of Applicant’s intent to use application, and Opposer has never abandoned its trademark, so that
`
`registration of Applicant’s alleged mark should be denied in accordance with Section 2(d) of the
`
`Trademark Act of 1946, 15 U.S.C. § 1052(d).
`
`13. If the Applicant is permitted to use and register the DIET SOLUTIONS designation
`
`for its goods, as specified in the application herein opposed, confusion in the trade resulting in
`

`damage and injury to the Opposer would be caused and would result by reason of the substantial
`
`similarity between Applicant’s mark and Opposer’s mark. Persons familiar with Opposer’s
`
`goods would be likely to buy Applicant’s goods as and for products made and sold by Opposer.

`Furthermore, any defect, objection, or fault found with Applicant’s products marketed under its
`
`alleged trademark would necessarily reflect upon and seriously injure the reputation that Opposer
`
`has established for its products sold under its trademark.
`
`14. If Applicant is granted a registration for the alleged trademark herein opposed, it
`
`would obtain thereby at least the prima facie exclusive right to use said mark. Such registration
`
`would be inconsistent with Opposer’s right to use its trademark BODY SOLUTIONS® to
`
`describe Opposer’s goods and retail services.
`
`15. By virtue of Opposer’s extensive use, sales, advertising, and promotion, the BODY
`
`SOLUTIONS® mark has become famous and distinctive throughout the United States as an
`
`exclusive designation of Opposer’s products and services, and became famous before Applicant
`
`commenced use of the DIET SOLUTIONS designation, as alleged herein.
`
`16. Applicant’s use of the DIET SOLUTIONS designation has caused, and will continue
`
`to cause, dilution of the distinctive quality of the BODY SOLUTIONS® mark as a unique source
`
`identifier for Opposer in the minds of consumers and will tarnish the BODY SOLUTIONS®
`
`mark.
`
`17. Applicant’s use of Opposer’s famous BODY SOLUTIONS® mark constitutes
`
`trademark dilution in violation of the Federal Trademark Dilution Act of 1995, Section 43(c) of
`
`the Lanham Act, 15 U.S.C. § 1125(c).
`
`18. WHEREFORE, the Opposer prays that the Board reject application Serial No.
`
`76/192,166 and that the registration of the mark therein sought for the goods therein specified be
`
`denied and refused, and that this Opposition be sustained.
