`Introduction.
`
`On September 24, 2019, the Examining Attorney issued a final office action in which he
`
`maintains his refusal for registration of the mark L 'ESCALE RESTAURANT BAR
`
`("Applicant's Mark") for use in connection with "restaurant, bar, cafe and cocktail lounge
`
`services; provision of facilities for meetings, conferences, banquets, exhibitions and social
`
`functions facilities for special occasions" in Class 43. In his Office Action, the Examining
`
`Attorney insists that U.S. Registration No. 2985616 for the mark PORTS OF CALL
`
`("Registrant's Mark") for use in connection with "catering services" in Class 42 is confusingly
`
`similar to Applicant's Mark.
`
`Despite Applicant's July 19, 201 9 response (the "Response") objecting to the refusal and
`
`asserting that the doctrine of foreign equivalents (the "Doctrine") should never have been applied
`
`in this instance, the Examining Attorney nevertheless takes the position that a likelihood of
`
`confusion would exist between the Registrant's Mark and Applicant's Mark, and does so from
`
`the mistaken belief that "l'escale" translates to "the port of call." Applicant herewith attaches the
`
`Response with associated exhibits as Exhibit 1, and incorporates the same herein by reference.
`
`This Request for Reconsideration is intended to supplement the arguments and evidence
`
`previously submitted; Applicant respectfully requests that it be read in conjunction with the
`
`

`Response. A careful assessment of these arguments should lead to no other result but a
`
`withdrawal of the refusal.
`
`Amendment to Description of Services.
`
`As a threshold matter, Applicant notes that it is herewith deleting "provision of facilities
`
`for meetings, conferences, banquets, exhibitions and social functions facilities for special
`
`occasions" from its recitation of services, leaving only "restaurant, bar, cafe and cocktail lounge
`
`services." And while Applicant is aware that a provider of catering services often fi.mctions as a
`
`restaurant (and vice versa), the very evidence provided by the Examining Attorney shows that
`
`the Registrant is not such a dual provider. See infra. As stated in the Response, to refuse
`
`registration of Applicant's mark in this instance elevates form over function to a degree that
`
`defeats the very purpose of the Trademark Act.
`
`The Marks Are Not Similar.
`
`As noted in its Response, the essence of the Examining Attorney's position has nothing
`
`to do with the visual or phonetic similarities between Applicant's and Registrant's Marks; there
`
`are, in fact, none, and it would be folly to assert otherwise. Rather, his position is that the French
`
`word "l' escale" translates in English to "the port of call" and therefore, under the Doctrine, a
`
`French-speaking consumer would stop and translate "L 'Escale" as "the port of call" and be
`
`confused as to the source of the services. In his original office action, he bases this misguided
`
`view on a single online dictionary source that shows "escale" translating to "port of call." Yet
`
`Applicant provided overwhelming evidence in its Response that " l' escale" is more appropriately
`
`translated as "the stopover", and argued that the Doctrine should be applied only when "the
`
`

`relevant English translation is literal and direct, and no contradictory evidence of shades of
`
`meaning or other relevant meanings exists." See TMEP § 1207.0l(b)(vi) (emphasis added).
`
`This argument apparently prompted the Examining Attorney to seek new supporting
`
`evidence for his erroneous translation. In this final refusal, he therefore attaches three additional
`
`dictionary definitions, all of which, in fact, support Applicant's view that that the primary
`
`definition of " l' escale" is "the stopover" and not "the port of call." See pages 21-24 of the final
`
`office action, which, at most, indicate that "port of call" is merely an alternative definition of
`
`"escale". Yet "[c]aution must be exercised in translating the non-English term to determine its
`
`meaning in English. If the foreign word mark could be translated in several ways, it is the
`
`prima,y and common translation which is the foreign equivalent to English." See J. THOMAS
`
`McCARTHY, McCARTHY ON TRADEMARKS AND UNFAIR COMPETITION, § 23:38 (5th ed. 2019)
`
`(emphasis added; internal quotations and citations deleted). The Examining Attorney' s own
`
`evidence shows that "port of call" is not the primary or most common definition of "escale."
`
`Faced with irrefutable proof that his original translation (and subsequent application of
`
`the Doctrine) was improper, the Examining Attorney attempts to make an end-rnn around his
`
