`On July 18, 2019, the Examining Attorney issued a Final Office Action in connection with
`US. Trademark Application Serial No. 88/290,320 for
`the NAVATEX trademark (the
`“Application’s Mark“), owned by Nautica Apparel, Inc. (“Cited Registrant”), based on an alleged
`likelihood of confusion with the US. Registration No. 5224534 for the NAVTECH trademark. In
`response, Applicant submits this timely filed Request for Reconsideration.
`
`When common elements ofconflicting marks are “weak,” because the terms are descriptive
`or in common use by many sellers in the market, then any likelihood of confusion is reduced.
`McCarthy, J. Thomas, iMcCarfhy on Trademarks and Unfair Competition, § 23:48 (5th ed.). Even
`if two marks contain common elements, they are not likely to be confused if ''the matter common
`to the marks is not likely to be perceived by purchasers as distinguishing sources because it is
`merely descriptive or diluted." TMEP § 1207.01(b)(iii); see, cg, Shem Mfg. Co. v. Ritz HowlI Ltd,
`393 F.3d 1238, 73 USPQ2d 1350 (Fed. Cir. 2004). "[W]here a party chooses a trademark which is
`inherently weak, he will not enjoy the wide latitude of protection afforded the owners of strong
`trademarks. Where a party uses a weak mark, his competitors may come closer to his mark than
`would be the case with a strong mark without violating his rights. " Sure-Fir Prods, Co. v. Saifzson
`Drapery Ca, 254 F.2d 158, 160 (CCPA 1958). Wide spread third-party use of a term may be
`offered as evidence ofa term's weakness and dilution with respect to a particular field and weighs
`in favor of narrowing the scope of its protection against subsequent applications. Pizza Inn, Inc. v.
`Russo, 221 USPQ 281, 283 (TTAB 1983); Palm Bay bnporrs, Inc. v. Votive C/icqaot Ponsardin
`Maison Fondee E17 1722, 396 F.3d 1369 (Fed. Cir. 2005).
`
`Applicant notes that the Trademark Register is replete with active third-party registrations
`and applications for NAV-fonnative marks for clothing and footwear. A representative sample of
`these marks are included in Table 1, below. Attached to and incoiporated herein at Exhibit A are
`registration certificates and TSDR printouts from the USPTO database. These show that each
`owner of a NAV-formative mark is entitled to correspondingly narrow trademark protection. By
`extension, the evidence confirms that consumers are accustomed to distinguishing between Nav-
`formative marks 7 especially when the parties” goods are so different. No one can own any
`trademark in the abstract, and the Cited Registrant does not own sufficiently strong trademark
`rights to prevent Applicant, or others, from using similar looking or sounding NAV-formative
`marks, except in narrow cases where the parties’ products are identical or overlapping.

`The Cited Mark is a weak mark afforded a narrow scope ofprotection due to the crowded
`field in which it exists. Considering the existence of and the Trademark Office”s treatment of the
`foregoing applications and registrations in Table I, along with the Cited Marks co-existence on
`the register with those marks, Applicant’s Mark should be similarly re gisterable.

`In addition to the foregoing, there is no similarity in the appearance and sound of the
`respective marks. The only similar element between both marks is the inclusion of the fonnative
`“NAV-”, which, as explained above, is commonly used for goods in Class 25. Moreover, Cited
`Mark’s suffix “-tech” provides a connotation distinct from that of Applicant’s Mark. “Tech” is
`an abbreviation for the word “technology”. See Exhibit B. As such, Cited Registrant’s
`NAVTECH mark implies that the clothing items provide some technical benefit or include a new
`or technologically advanced material or structure. This is further evidenced by Cited Registrant’s
`own website that promotes the “innovative fabrics” and “NAVTEC H PERFORMANCE
`FEATURES” including “ACTIVE STRETCH”, “MOISTURE WICKING”, “WATER
`REPELLENT” and “REFLECTIVE LINING”. See Exhibit C. In contrast, the suffix “-atex” or
`
`“-tex” of Applicant’s NAVATEX Mark has no discernable meaning.
