`REQUEST FOR RECONSIDERATION
`
`The Examiner maintained the refusal to register Applicant's DIRECT HELIX mark, Ser.
`
`No. 88089407 on the ground that the mark is likely to cause confusion with registrations owned
`
`by Bissell Homecare, Inc. for the marks CLEANVIEW HELIX, Reg. No. 3655678 and
`
`POWERHELIX, Reg. No. 4064449 (the "Cited Registrations").
`
`Applicant maintains its position that there is no likelihood of confusion between
`
`Applicant's DIRECT HELIX mark and the marks set forth in the Cited Registrations as the
`
`shared tenn "helix" is descriptive when used in connection with goods that include helix-shaped
`
`components or involve helical movement. Therefore, HELIX is not the dominant portion of the
`
`parties' marks and the other terms comprising the marks are distinguishable. Applicant re(cid:173)
`
`alleges and re-submits its arguments set forth in the August 23, 2018 office action response
`
`attached hereto as Exhibit A. Applicant respectfully requests that the Examiner reconsider the
`
`final refusal to register DIRECT HELIX and pe1mit Applicant's mark to publish.
`
`Registrant's use of "HELIX" in the Cited Registrations is highly descl'iptive and should be
`
`affo1·ded little weight in a likelihood of confusion analysis
`
`Marks must be compared in their entireties and the mere fact that the marks include the
`
`shared tenn "HELIX" does not necessarily make them confusingly similar. Descriptive or
`
`generic portions of a mark should be given less weight in making a likelihood of confusion
`
`determination. Hewlett-Packard Company v. Packard Press Inc., 281F.3d1261 , 1265-66
`
`(Fed. Cir. 2002); see also Giant Food, Inc. v. Nation's Foodservice, Inc., 710 F.2d 1565,
`
`1570 (Fed. Cir. 1983) (greater force and effect may be given to a dominant feature of a
`
`mark). Contrary to the Examiner's conclusion, the common element "HELIX" is not the
`
`dominant portion of the parties' marks and should be given little weight, if any, in
`
`determining whether there is a likelihood of confusion between the parties' marks.
`
`The Examiner provides no support that the term "HELIX" is the dominant portion of
`
`the parties' marks other than merely concluding that "both applicant's mark and Registrant's
`
`marks feature the term ' HELIX' as the dominant feature of the marks" without providing
`
`evidentiary support for the same. To the contrary, the tenn "HELIX" is not the dominant
`
`p01tion of the parties' mark. Rather, the Examiner should focus on the first tem1s of the
`
`parties' marks, "DIRECT," "POWER," and " CLEAN." Cases recognize that the first term
`
`is often the dominant part of a mark that is recognized and remembered by consumers. See,
`

`e.g., Coca-Cola Co. v. Carlisle Bottling Works, 43 F.2d 101 (E.D. Ky. 1929) ("[T]here is more
`
`apt to be infringement where there is similarity, ... in the front part of the trademark. That part
`
`comes first, is the most prominent, and it is likely to be dominating."); Presto Products Inc. v.
`
`Nice-Pak Products Inc., 9 USPQ2d 1895, 1897 (TT AB 1988) ("it is often the first part of a mark
`
`which is most likely to be impressed upon the mind of a purchaser and remembered"); Palm Bay
`
`Imports, Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 73 USPQ2d 1689 (Fed. Cir.
`
`2005) (in the mark VEUVE CLIQUOT, VEUVE is "a 'prominent feature ' as the first word in the
`
`mark and the first word to appear on the label."); In re Paper Doll Promotions, Inc., 84 USPQ2d
`
`1660, 1668 (TTAB 2007) (first part of mark is dominant); Eveready Battery Company, Inc. v.
`
`Green Planet, Inc. , 91USPQ2d1511 , 1518 (TTAB 2009) (SLICK is the first and therefore
`
`dominant te1111 in SLICK ULTRA PLUS). The first term in Applicant's mark is DIRECT
`
`whereas the first te1111s in the Cited Registrations are CLEAN and POWER which are completely
`
`different in appearance, sound and meaning and the commercial impression these terms create
`
`are different.
`
`Secondly, the Examiner cannot reasonably support his position that the tem1
`
`" HELIX" is not descriptive when used in connection with Registrant's vacuum cleaners.
`
`The Examiner states that "Registrant 's specimens and website referencing Registrant's ' Helix(cid:173)
`
`dirt separation system,' 'Exclusive Helix System' and 'Helix Cleaning Technology' use the term
`
`HELIX with a capital letter 'H '" which, he argues, suppo11s trademark use. However, the
`
`Examiner has not submitted any case law to support his argument that the simple capitalization
`
`of the first letter of the term "Helix" would change a descriptive te1111 into a non-
`
`descriptive tem1. Indeed, the terms "Exclusive," "System," "Cleaning" and "Technology" are
`
`also capitalized and are certainly not trademarks of the Registrant. As such, this argument is
`
`unpersuasive and must be discounted because Board decisions consistently say otherwise. See,
`
`e.g., Goodyear Tire & Rubber Co. v. Continental General Tire Inc., 70 USPQ2d 1067, 1076
`
`(TT AB 2003) ("the mere fact that applicant often capitalizes the term ["Intelligent" for tires]
`
`cannot salvage a tenn that the record shows otherwise to be a descriptive term"); Jn re Mecca
`
`Grade Growers, LLC, Serial No. 86358219 (March 12, 2018) [not precedential] (Affirming
`
`refusal to register MECHANICALLY FLOOR-MALTED as generic. "Applicant's attempt to
`
`appropriate this te1m for itself with the use of initial capitalization on its website is futile."); Jn
`
`re CTI Electronics C01p., Serial No. 85150436 (November 3, 2015) [not precedential]
`

`("Applicant's use of initial capitalization or other stylization of the term, or its use of the T M or
`
`trademark symbol in its advertising does not transform "industrial mouse" as the name of a
`
`category of heavy-duty computer pointing devices into a trademark. ").
`
`Further, the Examiner states "there is nothing in the cited specimens or websites that
`
`indicate that either Registrant or anyone else is using the tem1 'HELIX' descriptively in
`
`connection with vacuum cleaners." As set fo1th above, applicant maintains that use of the term
`
`"Helix" by Registrant on its website and in the specimens submitted in support of the Cited
`
`Registrations are descriptive. Indeed, the very examples cited by the Examiner, namely, "Helix(cid:173)
`
