`Applicant’s request for reconsideration is denied.   See 37 C.F.R. §2.63(b)(3).  The trademark
`examining attorney has carefully reviewed applicant’s request and determined the request did not: (1)
`raise a new issue, (2) resolve all the outstanding issue(s), (3) provide any new or compelling evidence
`with regard to the outstanding issue(s), or (4) present analysis and arguments that were persuasive or
`shed new light on the outstanding issue(s).  TMEP §§715.03(a)(ii)(B), 715.04(a).  
`
`Accordingly, the following requirement(s) and/or refusal(s) made final in the Office action dated
`February 1, 2023, are maintained and continued: 
`

`Merely Descriptive
`
`
`See TMEP §§715.03(a)(ii)(B), 715.04(a).  
`
`Again here, registration is sought for the compound mark NURSECON in connection with the
`following services: arranging and conducting special events for social entertainment purposes. 
`Previously provided evidence, as well as the attached additional evidence establishes that applicant's
`applied-for mark is merely descriptive of these services because it immediately conveys information
`about the services, namely, that they are nurse conventions.  Applicant again asserts that the NURSE
`element is not descriptive claiming now that NURSE is not descriptive because of its multiple
`meanings.  However, this argument is not persuasive.
`
`Determining the descriptiveness of a mark is done in relation to an applicant’s goods and/or services,
`the context in which the mark is being used, and the possible significance the mark would have to the
`average purchaser because of the manner of its use or intended use.  See  In re The Chamber of
`Commerce of the U.S., 675 F.3d 1297, 1300, 102 USPQ2d 1217, 1219 (Fed. Cir. 2012) (citing  In re
`Bayer Aktiengesellschaft, 488 F.3d 960, 963-64, 82 USPQ2d 1828, 1831 (Fed. Cir. 2007)); TMEP
`§1209.01(b). Descriptiveness of a mark is not considered in the abstract.  In re Bayer Aktiengesellschaft,
`488 F.3d at 963-64, 82 USPQ2d at 1831.     “That a term may have other meanings in different contexts
`is not controlling.”  Robinson v. Hot Grabba Leaf, LLC, 2019 USPQ2d 149089, at *5 (TTAB 2019)
`(citing  In re Canine Caviar Pet Foods, Inc., 126 USPQ2d 1590, 1598 (TTAB 2018)); TMEP
`§1209.03(e). “It is well settled that so long as any one of the meanings of a term is descriptive, the term
`may be considered to be merely descriptive.”  In re Mueller Sports Med., Inc., 126 USPQ2d 1584, 1590
`(TTAB 2018) (quoting  In re Chopper Indus., 222 USPQ 258, 259 (TTAB 1984)).
`
`Here, the evidence establishes that in the context of applicant's special events services, the wording is
`descriptive as conveying conferences/conventions for nurses whether retired, practicing, students or
`family members attending with someone with nursing credentials.  As further shown in the evidence
`attached here, applicant's own advertising describes the services as having "over 3,000 nurses for The
`Ultimate Nursing Conference" and is touted as bringing together, nurses and nursing students.  Please
`see the attached evidence.  Furthermore, previously provided evidence describe attendees as nurses,
`nursing students, retired nurses and certified or licensed healthcare workers and their guests.  Please see
`Page 9, February 1, 2023, Final Office Action, PDF.  As such here, contrary to applicant's claim, the
`descriptive meaning is clear.
`

`It is further noted that considering the combined terms to assess the meaning of the mark does not
`improperly dissect applicant's applied-for mark.  As acknowledged by applicant, m arks comprising
`more than one element must be considered as a whole and should not be dissected. However, contrary
`to applicant's assertion, a trademark examining attorney may consider the significance of each element
`separately in the course of evaluating the mark as a whole.  See  DuoProSS Meditech Corp. v. Inviro
`Med. Devices, Ltd., 695 F.3d 1247, 1253, 103 USPQ2d 1753, 1756-57 (Fed. Cir. 2012) (reversing
`Board’s denial of cancellation for SNAP! with design for medical syringes as not merely descriptive
`when noting that the Board “to be sure, [could] ascertain the meaning and weight of each of the
`components that ma[de] up the mark”);  In re Hotels.com, L.P., 573 F.3d 1300, 1301, 1304, 1306, 91
`USPQ2d 1532, 1533, 1535, 1537 (Fed. Cir. 2009) (holding HOTELS.COM generic for information and
`reservation services featuring temporary lodging when noting that the Board did not commit error in
`considering “the word ‘hotels’ for genericness separate from the ‘.com’ suffix”).  
`
`
`Here, the significance of each element was properly considered separately in the course of evaluating
`the mark as a whole, as well as the significance of the resulting whole and both were sufficiently
`considered in determining that as combined here, NURSECON remains descriptive.  The plain
`meanings of NURSE and CON combine to provide descriptive meaning to applicant's services that
`when combined as presented in the applied-for NURSECON mark, immediately and directly tells
`consumers applicant's special events service involve conventions/conferences for nurses.   Again,
`applicant's applied-for mark is a compound term formed with the descriptive words NURSE, which
`describes the audience and consumer, and CON, which indicates the special event. Thus, the evidence
`establishes that as related to applicant's services, each term retains its descriptive meaning individually
`as well as combined.  
`
`Generally, where the individual components of a mark retain their descriptive meaning in relation to the
`goods and/or services, the combination results in a composite mark that is itself descriptive and not
`registrable.  In re Zuma Array Ltd., 2022 USPQ2d 736, at *7 (TTAB 2022); In re Fat Boys Water
`Sports LLC, 118 USPQ2d 1511, 1516 (TTAB 2016); TMEP §1209.03(d); see, e.g., DuoProSS
`Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1255, 103 USPQ2d 1753, 1758 (Fed. Cir.
`2012) (holding SNAP SIMPLY SAFER merely descriptive for various medical devices, such as
`hypodermic, aspiration, and injection needles and syringes); In re Fallon, 2020 USPQ2d 11249, at *12
`(TTAB 2020) (holding THERMAL MATRIX merely descriptive of a heat-responsive, malleable liner
`that is an integral component of an oral dental appliance).  Only where the combination of descriptive
`terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in
`relation to the goods and/or services is the combined mark registrable.  See In re Omniome, Inc., 2020
`USPQ2d 3222, at *4 (TTAB 2019) (citing In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ
`382, 384 (C.C.P.A. 1968); In re Shutts, 217 USPQ 363, 364-65 (TTAB 1983)); In re Positec Grp. Ltd.,
`108 USPQ2d 1161, 1162-63 (TTAB 2013).
`
`In this case, both the individual components and the composite result are descriptive of applicant’s
`services and do not create a unique, incongruous, or nondescriptive meaning in relation to the goods
`and/or services.  
`
`Finally, with respect to the third-party registrations applicant now submits to support registration, these
`registrations do not support registration here. Specifically, applicant's request includes a chart of 5
`registrations along with copies of the registrations.  However, the relied upon registrations do not
`support applicant's assertions.  Of the 5 registrations, 4 registrations combine the descriptive term CON
`with other suggestive matter with applicant having to provide an explanation to link the term
`
`

`descriptively.  However, applicant provides no evidence establishing that the additional mark element
`is descriptive in the context of the provided goods and/or services.  Unlike the relied upon registrations,
`in this case, there is evidence showing that CON is not combined with suggestive matter but instead,
`has been combined with a term that is also descriptive and immediately and directly conveys
`information about the services, namely, the user and target consumer.  Moreover, other previously
`provided third-party registrations clearly establish that when a descriptive term is combined with the
`descriptive term CON as here, the resulting mark is treated similarly descriptive.  Specifically, the
`record includes multiple third-party registrations on the Supplemental Register and/or with the
`descriptive terms disclaimed.  Theses previously provided t hird-party registrations are probative
`evidence on the issue of descriptiveness as the relevant wording or term is disclaimed, registered under
`Trademark Act Section 2(f) based on acquired distinctiveness, or registered on the Supplemental
`Register.  E.g., In re Morinaga Nyugyo Kabushiki Kaisha, 120 USPQ2d 1738, 1745 (TTAB 2016)
`(quoting  Inst. Nat’l des Appellations D’Origine v. Vintners Int’l Co., 958 F.2d 1574, 1581-82, 22
`USPQ2d 1190, 1196 (Fed. Cir. 1992));  In re Box Solutions Corp., 79 USPQ2d 1953, 1955 (TTAB
`2006).     In addition, also included in the record is applicant's own prior registration on the
`Supplemental Register, establishing prior descriptive treatment.  Please see the June 22, 2022, Office
`Action and the February 1, 2023, Final Office Action.
`
`Finally, in terms of applicant's challenge that this prosecution is improperly maintained, the examining
`attorney points applicant to the May 10, 2022, correspondence advising applicant that due to a
`processing error, the inadvertently issued registration was cancelled.  Applicant was previously advised
`that prior to the issuance of the registration, it had been determined that refusal was required but due to
`processing limitations, the case could not be timely withdrawn and the resulting registration was issued
`in error.
`
`Accordingly, the refusal under  Trademark Act Section 2(e)(1) is  maintained.
`
`If applicant has already filed an appeal with the Trademark Trial and Appeal Board, the Board will
`be notified to resume the appeal.   See TMEP §715.04(a).  
`
`If applicant has not filed an appeal and time remains in the response period for the final Office
`action, applicant has the remainder of that time to (1) file another request for reconsideration that
`complies with and/or overcomes any outstanding final requirement(s) and/or refusal(s), and/or (2) file a
`notice of appeal to the Board.  TMEP §715.03(a)(ii)(B).
