`In the Final Office Action dated April 6, 2018, the Examining Attorney maintained
`
`their Section 2(d) refusal to register applicant's proposed mark is "HEALER'S" (special
`
`form as shown above) used in connection with "dietary supplemental drinks in the
`
`nature of vitamin and mineral beverages; Dietary supplements for human consumption ;
`
`Dietary and nutritional supplements; Dietary beverage supplements for human
`
`consumption in liquid and dry mix form for therapeutic purposes; Dietary food
`
`supplements; Medicinal drinks; Natural dietary supplements" in Class 5. The cited
`
`registrant's marks are
`
`1. U.S. Registration No. 4472372, "PHYTOHEALERS" (standard character)
`
`used in connection with "Dietary and nutritional supplements; Herbal supplements;
`
`Herbal topical creams, gels, salves, sprays, powder, balms, liniment and ointments for
`
`the relief of aches and pain; Herbs for medicinal purposes; Medicinal creams for skin
`

`The Examining Attorney continues to discount the trademark significance of the
`
`term PHYTO because he deems the term to be merely descriptive of the cited
`
`registrant's goods. Applicant respectfully disagrees with this characterization.
`
`Applicant herein traverses the Examining Attorney's allegations, submitting that
`
`the marks are not confusingly similar, as alleged, since the common term "HEALER" is
`
`weak and they are different in appearance, pronunciation, connotation, and meaning
`
`especially in light of the number of similar marks presently being used on identical or
`
`closely related goods. In addition, the circumstances under which the respective
`
`products are purchased and the high degree of care exercised by consumers when
`
`purchasing such products obviates any likelihood of confusion. Accordingly, Applicant
`
`respectfully requests the Examining Attorney to reconsider and withdraw the 2(d)
`
`refusal.
`
`I.
`
`THE MARKS ARE SUFFICIENTLY DISSIMILAR TO PREVENT CONSUMER
`CONFUSION
`
`Applicant's mark is similar to the cited marks in that they contain the word
`
`"HEALER". However, given that the products branded with the respective marks are
`
`"healers' in that they are meant to restore the user's health , the term HEALER is highly
`
`suggestive if not descriptive. Attached hereto as Exhibit A is the definition of this term
`
`obtained online from www.merriam-webster.com. There we learn the term means:
`
`a : to make free from injury or disease : to make sound or whole heal a wound
`
`b : to make well again : to restore to health heal the sick
`

`
`When compared in their entirety, the marks are different in terms of their
`
`appearance, sound, connotation , and commercial impression as the following shows.
`
`II.
`
`THE MARKS ARE DISSIMILAR IN APPEARANCE
`
`As stated before, Applicant's mark consists of the seven letter word "HEALER'S"
`
`in an old fashioned stylized typeface. Above the wording, a pestle and two leaves
`
`appear. The first cited registration is for the much visually longer twelve letter mark
`
`PHYTOHEALERS and the second cited mark is for another twelve letter mark
`
`presenting the black colored word "Phyto", and grey colored word "Healers" with a white
`
`colored person within a green colored leaf in between "Phyto" and "Healers" words.
`
`Ill.
`
`THE MARKS DIFFER IN THEIR PRONUNCIATION
`
`The cited marks begin with the distinctive sounding word PHYTO (pronounced
`
`"fahy-toh") whereas applicant's mark lacks any sort of similar sounding term. Confusion
`
`is, therefore , not apt to occur due in part to the different ways the respective marks are
`
`pronounced.
`
`IV.
`
`THE MARKS HAVE DISSIMILAR CONNOTATIONS AND CREATE
`DIFFERENT COMMERCIAL IMPRESSIONS
`
`HEALER'S and PHYTOHEALERS evoke very different images in the minds of
`
`relevant consumers. Applicant's mark, with its old drugstore style typeface and its
`
`pestle, creates a strong association with old time medical practices whereby a
`
`pharmacist or druggist prepared a specific treatment compound for each patient. The
`
`cited registrant's marks, on the other hand, create a totally different connotation. The
`
`cited registrant's marks, through their use of the term PHYTO and the image of a joyous
`
`person forming the veins of the leaf design , create a strong association with present day
`
`practice of using the efficacious natural plant based ingredients in herbal supplements
`
`based on the most recent scientific discoveries. Thus, the respective marks, when
`
`considered in their entirety, clearly create totally different commercial impressions and
`
`connotations.

`V.
`
`THE COMMON TERM "HEALER" IS WEAK IN LIGHT OF THE NUMBER AND
`NATURE OF SIMILAR MARKS IN USE ON SIMILAR GOODS
`
`A strong and distinctive trademark is entitled to greater protection, however, than
`
`a weak or commonplace one. Conversely, therefore, a weak or commonplace mark is
`
`entitled to less protection than a strong and distinctive mark. SquirtCo v. Seven-Up Co.,
`
`207 USPQ 897 (8th Cir. 1980); Sure-Fit Products Co. v. Saltzen Drapery Co. , 117
`
`USPQ 295 (C.C.P.A. 1958); Waples Platter Cos. v. General Foods Corp. , 196 USPQ 50
`
`(N.D. Tex. 1977)(''The relative strength of a trademark is but a legal shorthand for the
`
`breadth of protection to be afforded the mark.").
`
`If the common element of conflicting
`
`marks is a word that is "weak", then this reduces the likelihood of confusion . Nestle 's
`
`Milk Products, Inc. v. Baker Importing Co. , 86 USPQ 80 (C.C.P.A. 1950)(HYCAFE,
`
`NESCAFE); Clark Equipment Co. v. Baker-Lull Corp. , 129 USPQ 220 (C.C.P.A.
`
`1961)(no confusion between YARDLOADER and CARLOADER or YARDLIFT on
`
`fork-lift trucks). Further, in the case of weak marks, even slight differences between the
`
`marks may be deemed sufficient to avoid a finding that confusion is likely. See In re
`
`Dayco Products-Eaglemotive Inc. , 9 USPQ2d 1910, 1912 (TTAB 1988)("As such, we
`
`find the term to be a relatively weak mark and we agree with applicant that the scope of
`
`protection afforded such a mark is considerably narrower than that afforded a more
`
`arbitrary designation.").
`
`Applicant encourages the Examining Attorney, in reconsidering her likelihood of
`
`confusion analysis, to give appropriate weight to one of the DuPont Factors-the
`
`number and nature of similar marks in use on similar goods. While prior decisions and
`
`actions of other trademark examining attorneys in registering different marks are without
`
`evidentiary value and are not binding upon the Office, whether a mark is "strong" or
`
`"weak" is a very important element in deciding likelihood of confusion and should be
`
`appropriately weighed and considered in deciding a case on its own facts. Thus, in a
`
`"crowded" field of similar marks, each member of the crowd is relatively "weak" in its
`
`ability to prevent use by others in the crowd. Puma-Sportschuhfabriken Rudolf Dass/er,
`
`K.G. v. Superga S.p.A. , 210 USPQ 316 (TTAB 1980); General Mills, Inc. v. Health
`
`Valley Foods, 24 USPQ2d 1270 (TT AB 1992).
